มาตรการทางกฎหมายในการควบคุมธุรกิจโรงรับจำนำตามพระราชบัญญัติโรงรับจำนำ พ.ศ. 2505

Abstract

การศึกษาค้นคว้าอิสระนี้มีวัตถุประสงค์เพื่อ ศึกษาบทบาทและความสำคัญของโรงรับจำนำ แนวคิดเกี่ยวกับการควบคุมธุรกิจโรงรับจำนำ และความเป็นมาของโรงรับจำนำของประเทศไทย และเปรียบเทียบกับประเทศสิงคโปร์ เพื่อหาแนวทางในการปรับปรุงกฎหมายโรงรับจำนำของประเทศไทย ให้ทันสมัยและสอดคล้องกับสภาวะเศรษฐกิจในปัจจุบัน การศึกษาค้นคว้าอิสระนี้เป็นการศึกษาเชิงคุณภาพ ด้วยการศึกษาข้อมูลจากกฎหมาย หนังสือ ระเบียบ ข้อบังคับ วารสาร บทความ วิทยานิพนธ์ งานวิจัย สื่ออิเล็กทรอนิกส์ และเอกสารทางวิชาการต่าง ๆ ที่เกี่ยวข้องทั้งภาษาไทยและภาษาต่างประเทศ แล้วนำมารวบรวมและวิเคราะห์ เชิงเปรียบเทียบ จากการศึกษา พบว่า พระราชบัญญัติโรงรับจำนำของประเทศไทย มีผลบังคับใช้มานาน จึงทำให้ไม่สอดคล้องกับสภาวะสังคมที่เปลี่ยนแปลงไปในปัจจุบัน ซึ่งทำให้เกิดปัญหาในการบังคับใช้พระราชบัญญัติดังกล่าว เช่น ปัญหาการใช้ธุรกิจโรงรับจำนำเป็นแหล่งฟอกเงิน ปัญหาวงเงินในการรับจำนำ ปัญหาเกี่ยวกับตำแหน่งของเจ้าหน้าที่ของรัฐในการกำกับดูแล ปัญหาเกี่ยวกับอำนาจหน้าที่ของเจ้าพนักงานตรวจโรงรับจำนำ ปัญหาคุณสมบัติของผู้ขอใบอนุญาตในการประกอบธุรกิจโรงรับจำนำ และปัญหาการคุ้มครองผู้มีสิทธิไถ่ถอนจำนำ แต่ไม่มีตั๋วจำนำ (ตั๋วสูญหาย) จากการศึกษา ถึงปัญหาดังกล่าว จึงได้เสนอแนะแนวทางแก้ไขปัญหาที่เกิดขึ้นโดยการบัญญัติเพิ่มเติม และแก้ไขกฎหมายว่าด้วยโรงรับจำนำของประเทศไทยโดยยึดถือแนวทางตามกฎหมายว่าด้วยโรงรับจำนำของประเทศสิงคโปร์ เพื่อให้กฎหมายว่าด้วยโรงรับจำนำของประเทศไทย มีความเหมาะสม และสอดคล้องกับสภาพเศรษฐกิจและสังคมที่เปลี่ยนแปลงไปและเกิดความยุติธรรมในการบังคับใช้กฎหมาย

The objective of this independent study on legal measures regulating Pawnshops under the Pawnshop Act B.E. 2505 (1962) is to study roles and significance of Pawnshops, concepts of pawnshop business regulation and background of Pawnshops in Thailand in comparison with Pawnshops in Singapore in order to find the updated guideline of pawnshop law of Thailand to be up-to-date and consistent with the current economic situation. This independent study is a qualitative study. Legal data, books, rules, regulations, journals, articles, researches, digital media and relevant academic documents both in Thai language and English language were studied. Then data were analyzed. According to the study, the finding indicated that Pawnshop Act of Thailand has entered into force for long time, resulting in inconsistency with the current changing social situation that caused enforcement problems of the said Act such as the problem of use of pawnshop business to be money laundry source, pawn accepting financial limit problem, the government officer position-related problem in governance, pawnshop inspecting official authority-related problem, problem of business engagement applicant’s qualification, and problem of protection of the pawn redemption eligible person but without pawn ticket (ticket loss). According to the study on the said problems, the researcher has therefore suggested corrective guidelines. The Pawnshop Law of Thailand should be amended based on the Pawnshop Law of Singapore so that the Pawnshop Law of Thailand is appropriate and consistent with the changing economic and social situations and justice in law enforcement.
