Abstract
การวิจัยครั้งนี้มีวัตถุประสงค์เพื่อศึกษา (1) สาเหตุของการกำเนิดแนวพระราชดำริสิทธิสตรี ในพระบาทสมเด็จพระจอมเกล้าเจ้าอยู่หัว (2) ปัจจัยและกระบวนการที่มีผลต่อแนวพระราชดำริสิทธิสตรีในพระบาทสมเด็จพระจอมเกล้าเจ้าอยู่หัว (3) ผลกระทบจากแนวพระราชดำริสิทธิสตรี ในพระบาทสมเด็จพระจอมเกล้าเจ้าอยู่หัว
การวิจัยครั้งนี้เป็นการวิจัยเชิงคุณภาพด้วยวิธีการทางประวัติศาสตร์โดยดำเนินการ 2 ส่วน ได้แก่ การศึกษาและวิเคราะห์จากเอกสารประวัติศาสตร์รวมตลอดถึงผลงานทางวิชาการที่เกี่ยวข้อง และการสัมภาษณ์วิเคราะห์แบบเจาะลึกกลุ่มตัวอย่างผู้เชี่ยวชาญด้านประวัติศาสตร์ จำนวน 4 ท่าน โดยใช้แบบสัมภาษณ์ที่ไม่มีโครงสร้างจากนั้นนำข้อมูลมาวิเคราะห์ในเชิงพรรณนา
ผลการวิจัยพบว่า (1) ความเป็นปัจเจกบุคคลของพระบาทสมเด็จพระจอมเกล้าเจ้าอยู่หัว และการเกิดลัทธิการล่าอาณานิคม เป็นสาเหตุให้พระองค์ปรับปรุงประเทศเพื่อความทันสมัยในหลายด้าน รวมทั้งในเรื่องของการมอบสิทธิเสรี ภาพและสิทธิสตรี แก่ประชาชนของพระองค์ (2) สถาบันพระมหากษัตริ ย์มีอำนาจสูงสุดและอิทธิพลแนวคิดในเรื่องสิทธิเสรี ภาพและสิทธิสตรี ของ ชาติตะวันตกที่มีต่อสังคมไทย เป็นปัจจัยทำให้พระบาทสมเด็จพระจอมเกล้าเจ้าอยู่หัวทรงเปิดโอกาส ให้สตรีในราชสำนักมีโอกาสเรียนรู้ภาษาอังกฤษ พระองค์ทรงแก้ไขกฎหมายเกี่ยวกับสิทธิสตรีจำนวนหลายฉบับ เช่น การให้สิทธิในการยื่นฎีกาและได้รับชำระความโดยเร็ว สิทธิการเรียนภาษาอังกฤษ แก่สตรี ในราชสำนัก สิทธิในการเลือกคู่ครองของสตรี สามัญชน สิทธิไม่ต้องถูกขายลงเป็นทาส โดยไม่สมัครใจ สิทธิในการเรียกร้องมรดกและสินสมรส สิทธิข้าราชการฝายในทูลลาออกเป็นต้น (3) แนวพระราชดำริสิทธิสตรีได้ส่งผลให้สตรีมีสิทธิตัดสินใจในการเลือกดำเนินชีวิตตนมากขึ้น แม้ยัง ไม่ถึงขั้นเท่าเทียมกับเพศชายเพราะสังคมไทยยังอยู่ในระบบไพร่และทาส แต่นับเป็นการวางรากฐาน สิทธิสตรีที่สำคัญ และถือเป็นจุดริเริ่มของการพัฒนาสิทธิสตรีในประเทศไทยในสมัยรัชกาลต่อมา
The first purpose of this study was to study about the cause of the establishment towards the royal rights of women in King Mongkut. The second purpose was to study about the factors and processes affecting the royal practice of the rights of women in King Mongkut. The last purpose was to study about the impact of the royal initiative of women rights in King Mongkut. This research was a qualitative research with historical methods by conducting 2 parts which are studying and analyzing from historical documents as well as related academic work. Also, there was an in-depth analysis of a sample of 4 historical experts using the unstructured interview form. The data were analyzed in a descriptive way. The research results were found that (1) the individuality of King Mongkut and the beginning of colonialism cause His Majesty to modernize the country in many ways, including providing the liberties and women rights to his popularity.(2) The monarchy had the highest power so, the influence on the concept of rights, liberties and women of the West on Thai society was a factor that allowed His Majesty to provide the women to have the opportunity to learn English. It was including the revision in many women's rights laws which were the granting the right to file a petition and receiving the payment as soon as possible, the right to learn English for women in the royal court, the right to choose a partner for ordinary women, the right to not attend to involuntarily sold into slavery, the right to claim inheritance and marriage property as well as the right that the ladies of the court can resign, etc. (3) The royal concept of women's rights has contributed women to made own decision by themselves. Even it was not as the same level as the male because Thai society was still in slavery system, it laid the foundation for women's rights and was the starting point for the development of women's rights in Thailand during the following reign
