Abstract
การศึกษาค้นคว้าอิสระนี้มีวัตถุประสงค์เพื่อ 1) ศึกษาปัญหากระบวนการดำเนินคดีอาญาของผู้ดำรงตำแหน่งทางการเมือง ตามกฎหมายหรือข้อกำหนดเกี่ยวข้องกับการพิจารณาคดีที่ใช้ในปัจจุบัน (2) ศึกษาการดำเนินคดีอาญาในระบบไต่สวน การค้นหาความจริงโดยศาลฎีกาแผนกคดีอาญาของผู้ดำรงตำแหน่งทางการเมือง ต้องมีความกระตือรือร้น ในการค้นหาความจริงซึ่งจะไม่นําหลักยกประโยชน์แห่งความสงสัยให้จำเลย ตามประมวลกฎหมายวิธีพิจารณาความอาญา มาตรา 277 วรรคสองมาบังคับ (3) เสนอแนะแนวทางการพัฒนาการบังคับใช้กฎหมายหลังจากศาลฎีกาแผนกคดีอาญาของผู้ดำรงตำแหน่งทางการเมือง มีคําพิพากษาหรือคําสั่ง การศึกษาค้นคว้าอิสระนี้เป็นการวิจัยเชิงคุณภาพ ด้วยวิธีการวิจัยจากเอกสารที่เกี่ยวข้องกับความเป็นมาและแนวคิดในการดำเนินคดีอาญาของผู้ดำรงตำแหน่งทางการเมืองในประเทศไทยและต่างประเทศ เพื่อวิเคราะห์สภาพปัญหาและเสนอแนะแนวทางการแก้ไขกฎหมาย โดยได้ศึกษาค้นคว้าจากเอกสาร ทั้งเอกสารที่จัดทําเป็นภาษาไทยและภาษาต่างประเทศ ตำรา หนังสือ วารสาร บทความ วิทยานิพนธ์ ราชกิจจานุเบกษา เว็บไซต์ที่เกี่ยวข้อง และตัวบทกฎหมาย เป็นต้น ผลการศึกษาพบว่า (1) ปัญหาการบังคับใช้ไม่มีประสิทธิภาพที่เพียงพอ เนื่องจากพระราชบัญญัติประกอบรัฐธรรมนูญว่าด้วยวิธีพิจารณาคดีอาญาของผู้ดำรงตำแหน่งทางการเมือง พ.ศ. 2560 และข้อกําหนดเกี่ยวกับการดำเนินคดีอาญาของศาลฎีกาแผนกคดีอาญาของผู้ดำรงตำแหน่งทางการเมือง พ.ศ. 2543 และ พ.ศ. 2562 ยังมีช่องว่าง อาทิเช่น รัฐควรกำหนดให้ในวันยื่นฟ้องจำเลยต่อศาลฎีกาแผนกคดีอาญาของผู้ดำรงตำแหน่งทางการเมือง จะต้องมีตัวหรือคุมตัวจำเลยมาศาล เพื่อป้องกันการหลบของจำเลย และ (2) รัฐควรกำหนดวิธีการปฏิบัติให้ชัดเจนในข้อกำหนดเกี่ยวกับการดำเนินคดีอาญาของศาลฎีกาแผนกคดีอาญาของผู้ดำรงตำแหน่งทางการเมือง เพื่อป้องกันไม่ให้ศาลยึดถือสำนวนของคณะกรรมการป้องกันการทุจริตแห่งชาติเป็นหลักในการพิจารณา แต่ควรใช้เป็นแนวทางในการค้นหาข้อเท็จจริงเพิ่มเติม (3) รัฐควรจัดหน่วยงานสนับสนุนกิจการของศาลฎีกาแผนกคดีอาญาผู้ดำรงตำแหน่งทางการเมืองให้มีหน่วยงานในการติดตามบังคับคดีด้วยตนเองขึ้นตรงต่อศาล ไม่ควรขึ้นตรงต่อกระทรวงยุติธรรม เพราะกระทรวงยุติธรรมมีรัฐมนตรี ซึ่งเป็นผู้ดำรงตำแหน่งทางการเมืองรับผิดชอบ จึงอาจส่งผลกระทบต่อการปฏิบัติงานหรืออนาคตทางราชการของผู้ปฏิบัติได้
This independent study is to (1) study the problems of the criminal proceedings of persons holding political positions. According to the law or regulations relevant to the judicial process currently in use. (2) Studying criminal proceedings in the inquiry system. (Inquisitorial system) truth search by the supreme court's criminal division for political positions. Must be enthusiastic (Active) in the search for the truth. which will not bring the benefit of suspicion to the defendant (hr dubio pro reo) according to the criminal procedure code. This independent smdy is qualitative research by research method from documents related to the backgr ound and concept of criminal proceedings of people holding political positions in Thailand and abroad. To analyze problem situations and to make recommendations for legal resolution by studying and researching documents (Document any research), both documents prepared in Thai and foreign languages, texts, books, journals, articles, thesis, gazette Related websites and laws etc. The results of the study showed that (1) the enforcement problem was not sufficiently effective. Due to the organic act on criminal procedure for persons holding political positions B.E. Such gaps as states should be required on the day of filing a case against defendants in the supreme court, criminal division for persons holding political positions. The defendant must be detained or detained in court. (2) The state should set clear procedures in the supreme court's criminal procedure division for persons holding political positions. This is to prevent the court from upholding the national anti-corruption commission as the basis for consideration. (3) The state should organize the Supreme court's affairs support unit, the criminal department holding political positions, to have a self-monitoring agency directly to the court. Should not be directed to the ministry of justice because the ministry of justice has a minister who holds political positions in charge It may affect the performance or the future of the official government.
