Abstract
การศึกษาค้นคว้าอิสระ เรื่องมาตรการติดตามเด็กและเยาวชนภายหลังปล่อยจากศูนย์ฝึกและอบรมเด็กและเยาวชน มีวัตถุประสงค์เพื่อศึกษาแนวความคิดและเหตุผลในการติดตามเด็กและเยาวชนภายหลังได้รับการปล่อยตัวจากศูนย์ฝึกและอบรมเด็กและเยาวชน เพื่อศึกษาวิเคราะห์มาตรการทางกฎหมายและแนวทางปฏิบัติของหน่วยงานในกระบวนการยุติธรรม คือ สถานพินิจและศูนย์ฝึกและอบรมเด็กและเยาวชน และครอบครัว ชุมชนที่เด็กและเยาวชนอาศัยอยู่ และเพื่อหาแนวทางการปรับปรุงแก้ไขพระราชบัญญัติศาลเยาวชนและครอบครัวและวิธีพิจารณาคดีเยาวชนและครอบครัวในประเด็นกรณีศึกษา การศึกษาค้นคว้าอิสระนี้เป็นการวิจัยเชิงคุณภาพด้วยวิธีการวิจัยทางเอกสาร โดยทำการศึกษาจากหนังสือ บทความ เอกสาร งานวิจัย ตัวบทกฎหมายที่เกี่ยวข้อง เพื่อใช้เป็นข้อมูลในการศึกษาวิจัย และนำมาวิเคราะห์เพื่อนำไปสู่ข้อสรุปและข้อเสนอแนะของการวิจัยต่อไป และหาข้อมูลจากเอกสารของหน่วยงานที่เกี่ยวข้อง เช่น กรมพินิจและคุ้มครองเด็กและเยาวชน ผลจากการศึกษา พบว่า ภายหลังที่เด็กและเยาวชนได้รับการปล่อยตัวจากศูนย์ฝึกและอบรมแล้ว แม้จะมีการติดตามพฤติกรรมหรือความเป็นอยู่ของเด็กและเยาวชนอีกเป็นระยะเวลา 1 ปี แต่ก็ไม่สามารถที่จะส่งเสริมหรือช่วยเหลือให้เด็กและเยาวชนผ่านพ้นวันเสี่ยงต่อสังคมอาชญากรรมได้ เพราะการติดตามเด็กและเยาวชนไม่ใช่งานหลักของศูนย์ฝึกและอบรม จะมีก็เพียงแต่นักสังคมสงเคราะห์ซึ่งมีในศูนย์ฝึกและอบรมแห่งละ 1-2 คน จำนวน 18 แห่งทั่วประเทศไทย การจะติดตามเด็กและเยาวชนที่ปล่อยจากศูนย์ฝึกและอบรมซึ่งเป็นเด็กและเยาวชนที่มาจากทุกจังหวัด จำนวน 77 จังหวัด นั้นไม่อาจเป็นไปได้ด้วยเงื่อนไขของอัตรากาลังเจ้าหน้าที่และยังไม่มีกฎหมายใดบัญญัติมาตรการการทางานนี้ โดยเฉพาะพระราชบัญญัติศาลเยาวชนและครอบครัวและวิธีพิจารณาคดีเยาวชนและครอบครัวก็ไม่ได้บัญญัติการทางานในเรื่องนี้ การศึกษาพบว่าควรนำรูปแบบขององค์กร 180 ในประเทศเนเธอร์แลนด์มาใช้คือการมี IRC เจ้าหน้าที่ที่เป็นตัวกลางในการจะหาเครือข่ายและส่งเด็กและเยาวชนต่อให้กับเครือข่ายไม่ว่าจะเป็นสถาบันการศึกษา นายจ้าง ครอบครัว ชุมชน องค์กรภาครัฐและเอกชน และต้องมีการกำหนดรูปแบบงานให้ชัดเจนเป็นกฎหมายเพื่อให้มีงบประมาณ อัตรากำลังรองรับต่อไป
The objectives of this research were to study the reasons for and concepts about following up on child and youth offenders after they are released from juvenile detention centers, in order to analyze the legal measures and practices of related agencies in the justice system, including penitentiaries, juvenile training centers, families, and communities, and to seek approaches for revising relevant aspects of the Juvenile and Family Court Act and the Juvenile and Family Criminal Procedure Act. This was a qualitative study based on documentary research consisting of related books, articles, reports, and laws, as well as documents from the Department of Juvenile Observation and Protection, with an aim to analyze the problem, reach conclusions and form recommendations for legislative reform and further research. The results showed that even though the juvenile training centers follow up on the behavior and well being of their charges for one year after their release, it is not possible to effectively assist them or protect them from the risks of life in criminal society because following up is not one of the major tasks of the personnel at the centers. Each of the 18 juvenile training centers in the country employs only one or two welfare officers who are in charge of follow up along with many other jobs, so the work force is not sufficient to thoroughly look after the released youth who come from all 77 provinces. The follow up work is not specifically covered in any law, including the Juvenile and Family Court Act and the Juvenile and Family Criminal Procedure Act. The researcher recommends that Thailand should implement measures similar to that of the 180 Organization in the Netherlands, with an IRC official as a mediator to find a network, such as an educational institution, employer, family, community, or public or private organization, to support the juvenile who is newly released. The framework and details of the follow up measures should be clearly written in a law so that it will be supported with a dedicated budget and personnel.
