Abstract
การวิจัยเรื่อง การคุ้มครองดูแลบุตรของลูกจ้างก่อนและหลังคลอดมีวัตถุประสงค์เพื่อ (1) เพื่อศึกษาแนวคิดและวิวัฒนาการของการคุ้มครองดูแลบุตรของลูกจ้างในต่างประเทศและในประเทศไทย (2) เพื่อศึกษากฎหมายเกี่ยวกับการคุ้มครองดูแลบุตรของลูกจ้างตามกฎหมายระหว่างประเทศ และกฎหมายต่างประเทศได้แก่กฎหมายของประเทศแคนาดา นอร์เวย์ ญี่ปุ่น มาเลเซีย ฟิลิปปินส์ กัมพูชา ลาว นิวซีแลนด์ สิงคโปร์ และจีน (3) เพื่อวิเคราะห์กฎหมายเกี่ยวกับการคุ้มครองดูแลบุตรของลูกจ้างใน ประเทศไทยเปรียบเทียบกับกฎหมายตามข้อ (2) และ (4) เพื่อนำผลการวิเคราะห์มาสังเคราะห์เป็นแนวทางในการปรับปรุงแก้ไขกฎหมายเกี่ยวกับการคุ้มครองดูแลบุตรของลูกจ้างก่อนและหลังคลอด งานวิจัยเรื่องนี้เป็นการวิจัยทางกฎหมาย โดยการวิจัยเชิงคุณภาพ ด้วยการวิจัยทางเอกสาร จากหนังสือ ตำรา บทความ คำพิพากษาศาลฎีกา วารสาร และเอกสารข้อมูลจากสื่ออิเล็กทรอนิกส์ ทั้งกฎหมายของประเทศไทย และกฎหมายของต่างประเทศ โดยนำข้อมูลทั้งหมดมาวิเคราะห์และเปรียบเทียบหาข้อสรุปและข้อเสนอแนะ ผลการวิจัยพบว่ากฎหมายเกี่ยวกับการคุ้มครองดูแลบุตรของลูกจ้างในประเทศไทย เมื่อวิเคราะห์เปรียบเทียบกับกฎหมายระหว่างประเทศ และกฎหมายของต่างประเทศแล้ว กฎหมายไทยมีข้อบกพร่อง และมีปัญหาที่ต้องแก้ไขเพิ่มปรับปรุงดังนี้ (1) เพิ่มข้อจากัดเกี่ยวกับการทำงานที่อาจก่อให้เกิดอันตราต่อทารกที่อยู่ในครรภ์ (2) เพิ่มข้อจำกัดในการทำงานล่วงเวลาและการทำงานในวันหยุด (3) กาหนดให้มีจำนวนวันลาก่อนคลอดและลาหลังคลอดที่ชัดเจน (4) ให้สามีที่เป็นลูกจ้างมีสิทธิลาเพื่อดูแลภริยาและบุตร (5) ให้มีการตั้งสถานรับเลี้ยงเด็กในสถานประกอบกิจการของนายจ้าง (6) ในระหว่างทำงานต้องมีการพักเพื่อให้นมบุตร (7) เพิ่มเงินสงเคราะห์บุตร (8) บัญญัติกฎหมายใหม่เพื่อคุ้มครองนมมารดา (9) การเลี้ยงดูแลเด็กป่วยต้องแยกออกจากเด็กไม่ป่วย (10) กาหนดคุณสมบัติของพี่เลี้ยงเด็กให้เหมาะสม (11) ยกเลิกการให้เด็กอายุ 3 ขวบแสดงแบบโฆษณานม (12) ให้แต่ละกระทรวงที่มีอำนาจเกี่ยวกับการดูแลเด็กต้องออกกฎกระทรวงให้เป็นไปในแนวทางเดียวกัน
The thesis on the protection and care of workers’ children before and after birth aims to (1) study the concept and development of the protection of children of worker in other foreign countries and in Thailand, (2) study the law on the protection of children of workers in accordance with international laws and regulations, by analyzing the laws of Canada, Norway, Japan, Malaysia, Philippines, Cambodia, Laos, New Zealand, Singapore and China, (3) analyze the laws on the protection of child laborers in Thailand in order to compare with laws from no. (2), and (4) implement the analysis as guideline to improve the law on the protection and care of workers’ child before and after birth. This thesis uses a qualitative legal research approach through scholarly findings, judgment articles of the Supreme Court, digital and print media, and Thai and international laws to analyze, compare, and provide recommendations. The findings indicate that the laws on the protection and care of children of workers in Thailand when compared with the international laws and the laws of other foreign countries have flaws and problems that need to be amended as follows: (1) Increasing the tightened regulations on the work performances that might endanger a fetus; (2) implementing additional restrictions on overtime and working on holiday; (3) allowing maternity leave from work before and after delivery; (4) allowing leave for the male employee to take care of his wife and child(ren); (5) establishing a daycare center at the workplace; (6) allowing breaks from work to feed the newborn baby; (7) increasing the child welfare fund; (8) implementing a new law to protect breastfeeding mothers; (9) separating care of sick children and healthy children; (10) determining the qualification of a caretaker or nanny; (11) prohibiting advertisements of products by 3-year old children and (12) specifying the relevant minister to issue regulations to meet the same guidelines.
