Abstract
การศึกษาค้นคว้าอิสระเรื่องนี้มีวัตถุประสงค์เพื่อศึกษาแนวคิด ทฤษฎี ความเป็นมาของการยื่นบัญชี แสดงรายการทรัพย์สินและหนี้สินของผู้ดำรงตำแหน่งทางการเมือง ผู้ดำรงตำแหน่งระดับสูง และเจ้าหน้าที่ของรัฐ ศึกษาสภาพบังคับใช้กฎหมายในการยื่นบัญชีแสดงรายการทรัพย์สินและหนี้สิน รวมทั้งปัญหาและอุปสรรคของการ บังคับใช้กฎหมายในการแสดงบัญชีทรัพย์สินและหนี้สิน เพื่อหาแนวทางในการแกไขปัญหาการบังคับใช้กฎหมายเกี่ยวกับการตรวจสอบทรัพย์สินและหนี้สินให้มีประสิทธิภาพมากยิงขึ้น การศึกษาค้นคว้าอิสระนี้ เป็นการวิจัยเชิงคุณภาพด้วยวิธีวิจัยเอกสารจาก ตำรา หรือเอกสารวิชาการ บทความ รายงานวิจัย ที่เกี่ยวข้องกบแนวคิด ทฤษฎี กฎหมาย รวมทั้งสภาพปัญหาที่ทำให้การบังคับใช้กฎหมายเกี่ยวกับการตรวจสอบบัญชีแสดงรายการทรัพย์สินและหนี้สินไม่มีประสิทธิภาพ และไม่สามารถตรวจสอบได้อย่างแท้จริง ผลการศึกษาพบว่า การบังคับใช้กฎหมายในการตรวจสอบบัญชีแสดงรายการทรัพย์สินและหนี้สินยังไม่มีประสิทธิภาพเท่าที่ควร และไม่สามารถตรวจสอบได้อย่างแท้จริง เนื่องจากข้อจำกัดและช่องวางของกฎหมายที่กำหนดให้ต้องแสดงรายการทรัพย์สินและหนี้สินของคู่สมรสที่ถูกต้องตามกฎหมาย รวมทั้งระเบียบและหลักเกณฑ์ เกี่ยวกับการตรวจสอบบัญชีแสดงรายการทรัพย์สินและหนี้สิน ที่ทำให้เกิดการหลีกเลี่ยงไม่แสดงรายการทรัพย์สินและ หนี้สินที่ได้มาในระหว่างดำรงตำแหน่ง การยื่นบัญชีแสดงรายการทรัพย์สินและหนี้สินโดยแสดงเอกสารประกอบ เฉพาะ ณ วันที่มีหน้าที่ยื่นบัญชี ทำให้เกิดการตบแต่งบัญชีก่อนนำมายื่นต่อคณะกรรมการป้องกันและปราบปรามการทุจริตแห่งชาติ การยื่นบัญชีแสดงรายการทรัพย์สินและหนี้สินและเอกสารประกอบล่าช้ากว่าที่กฎหมายกำหนดรวมทั้งขาดความรู้ความเข้าใจในการยื่นบัญชีแสดงรายการทรัพย์สินและหนี้สินและเอกสารประกอบ ผู้ศึกษาจึงเสนอแนะแนวทางในการแก้ไขปัญหาดังกล่าว โดยการแก้ไขพระราชบัญญัติประกอบรัฐธรรมนูญว่าด้วยการป้องกันและปราบปรามการทุจริต พ.ศ. 2542 และที่แก้ไขเพิ่มเติม ให้คณะกรรมการป้องกันและปราบปรามการทุจริตแห่งชาติ มีอำนาจตรวจสอบบัญชีแสดงรายการทรัพย์สินและหนี้สินของภรรยาที่อยู่กินกันโดยมิได้จดทะเบียนสมรส หรือจดทะเบียนหย่าก่อนเข้ารับตำแหน่งหรือหลังเข้ารับตำแหน่ง กำหนดให้แสดงเอกสารประกอบบัญชีแสดงรายการทรัพย์สินและหนี้สินตลอดระยะเวลาที่ดำรงตำแหน่ง และกำหนดให้การยื่นบัญชีแสดงรายการทรัพย์สินและหนี้สิน ถือเป็นเงื่อนไขแห่งความสมบูรณ์ในการลงสมัครรับเลือกตั้งเพื่อป้องกันการยื่นบัญชีแสดงรายการทรัพย์สินและหนี้สินเกินระยะเวลาที่กฎหมายกำหนด รวมทั้งจัดให้มีการประชาสัมพันธ์เผยแพร่ความรู้เกี่ยวกับการยื่นบัญชีแสดงรายการทรัพย์สินและหนี้สิน ทั้งนี้ เพื่อให้การบังคับใช้กฎหมายในการยื่นบัญชีและการตรวจสอบบัญชี แสดงรายการทรัพย์สินและหนี้สินมีประสิทธิภาพมากยิ่งขึ้น และสามารถตรวจสอบได้จริงตรงตามเจตนารมณ์ ของรัฐธรรมนูญ
The purpose of the independent study is to study about the concept, theories and background of the declaration of assets and liabilities belong to the political appointees, high-level politicians and officials, the enforcement of the law concerning the declaration of assets and liabilities including the problems and the difficulties arising from the enforcement of the law concerning the declaration of assets and liabilities in order to seek for the guidelines for the effective enforcement of the law relevant to the assets and liabilities inspection. This independent study is the qualitative research by means of the documentary research and goes through the research from textbooks or the academic documents, the articles, the research documents relating to the concept, theories, laws including the problems rendered the ineffectiveness of the enforcement of law concerning the inspection of the accounts showing the assets and liabilities and the troubles from the actual inability of the inspection. The results of the research are that the enforcement of the laws relating to the inspection of the accounts showing the assets and liabilities is not effective as expected and could not be actually inspected because of the limitation and the gaps of the law which are required to show the assets and liabilities list rendered the avoidance in showing such lists acquiring during the position occupying time. The submission of the accounts showing the assets and liabilities by presenting the adjunct documents only at the time of the account submission which made the window dressing before submitting to the National Counter Corruption Commission. The delayed submission of the lists as well as the documents which is not in line with the laws and the lack of the understandings of the submission of the assets and liabilities list as well as the documents are also the problems. The researcher suggests solving the problems by revising the Organic Law on Counter Corruption B.E. 2542 as amended to empower the National Counter Corruption Commission to inspect the accounts showing the assets and liabilities belong to de facto spouse or the divorced spouse before holding the position or after holding the position, to prescribe that the adjunct document of the assets and liabilities must be shown during the time of position, and to stipulate that the submitting of the accounts shall be the condition for validity of the election candidate in order to prevent the delayed submission which is not in line with the laws, and to publicize information relating to the submission of the accounts showing the assets and liabilities so that the enforcement of the related law and the inspection thereof is more effective and could be actual inspected in accordance with the spirit of the Constitution.
