Abstract
การศึกษาค้นคว้าอิสระนี้ มีวัตถุประสงค์เพื่อ 1) ศึกษาการใช้กฎหมายที่เกี่ยวข้องกับวินัยและการรักษาวินัยของมหาวิทยาลัยในกำกับของรัฐแต่ละแห่ง 2) ศึกษาการใช้กฎหมายกลางที่เกี่ยวข้องกับวินัยและการรักษาวินัยที่ใช้บังคับกับส่วนราชการต่างๆ 3) ให้มีมาตรฐานกลางที่เกี่ยวข้องกับวินัยและการรักษาวินัยมหาวิทยาลัยในกำกับของรัฐและให้อำนาจมหาวิทยาลัยในกำกับของรัฐแต่ละแห่ง การวิจัยในครั้งนี้ใช้วิธีการวิจัยเอกสาร โดยทำการค้นคว้าและเก็บรวมรวมข้อมูลจากเอกสารบทความ วารสาร รายงานการวิจัย วิทยานิพนธ์ รายงาน สัมมนา ตำรากฎหมาย หนังสือพิมพ์ และสื่ออิเล็กทรอนิกส์ ระบบออนไลน์ เป็นต้น เพื่อนำข้อมูลที่ได้มาวิเคราะห์ในเชิงเปรียบเทียบ จากที่ศึกษาพบว่า 1) การดำเนินการทางวินัยของมหาวิทยาลัยในกำกับของรัฐแต่ละแห่งมีลักษณะที่จะขัดกับหลักความเสมอภาคหรือไม่นั้น สรุปได้ว่า ไม่ได้ขัดกับหลักความเสมอภาคแต่เป็นเพียงนโยบายที่แต่ละมหาวิทยาลัยกำหนดขึ้นเพียงเพื่อให้บรรลุวัตถุประสงค์ในการบริการวิชาการของตนเองเท่านั้น 2) แต่ควรมีมาตรฐานกลางสำหรับมหาวิทยาลัยในกำกับของรัฐที่ยังไม่มีกฎ ระเบียบ ข้อบังคับที่เกี่ยวข้องกับวินัยและการรักษาวินัย หรือสำหรับมหาวิทยาลัยที่กำลังจะออกนอกระบบต่อไปในอนาคต 3) ให้อำนาจกับมหาวิทยาลัยที่มีลักษณะของผู้ปฏิบัติงานภายในมหาวิทยาลัยแตกต่างจากมหาวิทยาลัยอื่น ออกกฎหมายลำดับรองที่เกี่ยวข้องกับข้อกำหนดทางวินัย
This study intended to 1) study the application of laws related to discipline and discipline maintenance of autonomous universities. 2) study the application of the central laws related to discipline and the maintenance of discipline applicable to government agencies. 3) establish a central standard related to the discipline the maintenance of autonomous university discipline and giving power to autonomous university This research uses the document research method. by researching and collecting information from articles, journals, research reports, theses, reports, seminars papers, legal textbooks, newspapers, and, etc., in order to do for comparative analysis. is the study revealed that 1) the disciplinary action of each autonomous university not against the principle of equality, but it is only a policy that each university has established just to achieve their academic service purposes. 2) there should be a central standard for both the autonomous universities that do not yet have rules, orders, or regulations, related to the discipline and the discipline maintenance, and. the upcoming autonomous universities. 3) authorizing the universities with different characters from for other universities to. issue subordinate legislation related to discipline.
