สิทธิในการเลือกตั้งของผู้ต้องขังในทัศนะของเจ้าหน้าที่ราชทัณฑ์

Abstract

การวิจัยครั้งนึ้มีวัตถุประสงค์เพื่อ (1) ศึกษาความเป็นไปได้ในการใช้สิทธิทางการเมืองในการเลือกตั้งของผู้ต้องขัง (2) ศึกษาแนวทางและวิธีการในการใช้สิทธิทางการเมืองในการเลือกตั้งของผู้ต้องขัง (3) ศึกษาผลที่คาดว่าจะเกิดขึ้นในการใช้สิทธิทางการเมืองในการเลือกตั้งของผู้ต้องขัง และ (4) เสนอแนะแนวทางในการใช้สิทธิทางการเมืองในการเลือกตั้งของผู้ต้องขัง การวิจัยครั้งนี้เป็นการใช้วิธีวิจัยเชิงปริมาณและเชิงคุณภาพ กลุ่มตัวอย่างคือ ผู้บัญชาการเรือนจำฯ/ผู้อำนวยการฯ จำนวน 10 คน และเจ้าหน้าที่ราชทัณฑ์ จำนวน 450 คน ครอบคลุมพื้นที่เรือนจำและทัณ,ทสถานของกรมราชทัณฑ์ทั่วประเทศ 9 เขต เครื่องมือที่ใช้ในการเก็บข้อมูล คือ แบบสอบถามและแบบสัมภาษณ์ สถิติที่ใช้ในการวิเคราะห์ข้อมูลได้แก่ การหาค่าความถี่ค่าร้อยละ และ การวิเคราะห์ข้อมูลเชิงคุณภาพเป็นการวิเคราะห์เนื้อหา ผกการวิจัยพบว่า (1) ผู้ต้องขังควรจะรับโอกาสการใช้สิทธิทางการเมืองในการเลือกตั้ง (2) แนวทางและวิธีการ ในการใช้สิทธิทางการเมืองในการเลือกตั้งของผู้ต้องขัง ควรให้คณะกรรมการการเลือกตั้งเป็นผู้ดำเนินการและใช้วิธีการเลือกตั้งเช่นเดียวกับการเลือกตั้งทั่วใป (3) ผลที่คาดว่าจะเกิดขึ้นในการใช้สิทธิทางการเมืองในการเลือกตั้งของผู้ต้องขัง ทำให้ผู้ต้องขังมีโอกาสกลับตนเป็นพลเมืองดีภายหลังพ้นโทษ มีความรู้สึกไม่ถูกตัดออกจากสังคม และมีส่วนร่วมทางการเมืองในฐานะประชาชนคนไทย (4) ข้อเสนอแนะแนวทางในการใช้สิทธิทางการเมืองในการเลือกตั้งของผู้ต้องขัง คือ จะต้องมีการพิจารพาแก้ไขรัฐธรรมมูญและกฎหมายเลือกตั้ง

The objectives of this research were to: (1) study the possibility of prisoners’ exercise of their electoral rights (2) study the methods and processes by which prisoners could exercise their electoral rights: (3) predict the probable results of prisoners exercising their electoral rights (4) give recommendations on how prisoners may exercise their electoral rights Both qualitative and quantitative methods were used for this research. The sample consisted of 10 commandcrs/directors and 450 operation-level officers from correctional institutions in all of the Department of Correction’s 9 zones. Data were collected by using questionnaires and interview forms. Data were analyzed by using frequency analysis and percentage. The results were as follows: (1) Prisoners should be given the opportunity to exercise their electoral rights (2) The Election Commission of Thailand should be in charge of setting the methods and processes by which prisoners can exercise their electoral rights and they should be the same as for general elections. (3) The probable results of letting prisoners exercise their electoral rights arc that the prisoners could be rehabilitated to be good citizens, would not feel isolated from society and could participate in politics as Thai citizens. (4) The researcher’s recommendation is that the constitution and electoral laws should be amended to allow prisoners to exercise their electoral rights
