Abstract
การศึกษาคนคว้าอิสระเรื่อง เงื่อนไขการฟื้นฟูสมรรถภาพผู้ติดยาเสพติด ตามกฎหมายว่าด้วยการฟื้นฟูสมรรถภาพผู้ติดยาเสพติดนี้มีวัตถุประสงค์เพื่อศึกษาถึงเงื่อนไขในการเขาสู่ระบวนการฟื้นฟูสมรรถภาพผู้ติดยาเสพติด ตาม พ.ร.บ.ฟื้นฟูสมรรถภาพผู้ติดยาเสพติด พ.ศ. 2545 ในปัญหาการคัดกรองบุคคลเขาสู้่กระบวนการฟื้นฟูสมรรถภาพผู้ติดยาเสพติดและเสนอแนะ แนวทาง เพื่อปรับปรุงแก้ไขกฎหมายให้เหมาะสมยิงขึ้นต่อไปในอนาคต โดยเป็นการวิจัยทางนิติศาสตร์ (Legal Research) โดยการวิจัยเชิงคุณภาพ (Qualitative Research) ด้วยวิธีการวิจัยเอกสาร (Documentary Research) จากเอกสารต่าง ๆ ที่เกี่ยวข้องทั้งหมด เช่น บทบัญญัติของกฎหมายอาทิ พระราชบัญญัติตลอดจน กฎกระทรวง ระเบียบ อีกทั้งมีการทบทวน วรรณกรรมต่าง ๆ ที่เกี่ยวข้องกับการฟื้นฟูสมรรถภาพผู้ติดยาเสพติด ผลจากการศึกษาผู้ศึกษาได้เสนอแนะแนวทางในการปรับปรุงแก้ไขกฎหมาย สรุปได้ว่าควรมีการแก้ไขเพิ่มเติม มาตรา 22 วรรคแรกแห่ง พระราชบัญญัติฟื้นฟูสมรรถภาพผู้ติดยาเสพติด พ.ศ. 2545 โดยให้อำนาจคณะอนุกรรมการในการคัดกรองบุุคคลที่เป็นผู้เสพที่แท้จริงเขาสู่กระบวนการฟืนฟูอันจะทำให้กฎหมายฉบับนี้ความสมบูรณ์ยิงขึ้น
The individual study on ‘The Conditions for the Rehabilitation of Drug Addicted People in Accordance to the Law about the Rehabilitation of Drug Addicted People’ has the objective to explore the conditions for ones to enter the process of the rehabilitation of drug addicted people in accordance to the Drug Addicted Rehabilitation Act 2545 B.E. (2012).In addition , this is to study the proplem of selection the person who should under into the process of rehabilitation and the ways to solve this problem. Therefore, it is necessary that this study is conducted in order to attain ways to amend the law to be more effective in the future. This legal research is a qualitative research that relies on documentary research discipline. Therefore, many documents relevant to the research topic such as the act, ministerial regulations, restrictions and many other literatures that are related to the rehabilitation of drug addicted people are reviewed. The findings from is research enable the researcher to suggest the improvement of the law particularly the first paragraph of Article 22 of the Drug Addicted Rehabilitation Act 2545 B.E. (2012) should be amended in order to authorize the sub-committee to select the real drug-addicted people to attend the rehabilitation process. This will make this law become more effective.
