Abstract
การศึกษานี้มีวัตถุประสงค์ (1) เพื่อศึกษาแนวคิดทั่วไปเกี่ยวกับการกำกับดูแลการทำแท้ง (2) เพื่อศึกษาเปรียบเทียบกฎหมายเกี่ยวกับอำนาจการตัดสินใจที่จะยุติการตั้งครรภ์ของผู้เยาว์ และการได้รับคำปรึกษาจากผู้ประกอบวิชาชีพเวชกรรมของหญิงที่ต้องการยุติการตั้งครรภ์ ระหว่างประมวลกฎหมายอาญาของประเทศไทย และกฎหมายต่างประเทศ (3) เพื่อวิเคราะห์ปัญหาและแนวทาการแก้ไขประมวลกฎหมายอาญา มาตรา ๓๐๕ (4) เพื่อเสนอแนะปรับปรุงแก้ไขประมวลกฎหมายอาญาเกี่ยวกับความผิดฐานทำแท้ง การศึกษาค้นคว้าอิสระนี้เป็นการวิจัยเชิงคุณภาพ ด้วยวิธีการวิจัยเอกสารจากตัวบทกฎหมาย ตำราทางวิชาการ งานวิจัย คำพิพากษาศาลฎีกา บทความจากวารสารหรือนิตยสารทางกฎหมาย ข้อมูลจากเว็บไซต์ทางอินเตอร์เน็ตและของต่างประเทศเกี่ยวกับการยุติการตั้งครรภ์หรือทำแท้งโดยชอบด้วยกฎหมาย เช่น ประเทศสิงคโปร์และสาธารณรัฐฝรั่งเศส เพื่อเป็นข้อมูลในการวิเคราะห์ปัญหา เปรียบเทียบ สรุปและข้อเสนอแนะ ผลการศึกษาพบว่า (1) ประมวลกฎหมายอาญากำหนดให้การทำแท้งไม่เป็นความผิดหากหญิงทำแท้งขณะอายุครรภ์ไม่เกิน 12 สัปดาห์ หากเป็นการกระทำโดยผู้ประกอบวิชาชีพเวชกรรมที่กฎหมายกำหนด โดยมีแนวคิดว่าสิทธิในเนื้อตัวร่างกายของหญิงเป็นสิทธิพื้นฐานของศักดิ์ศรีความเป็นมนุษย์ที่บุคคลย่อมมีสิทธิและเสรีภาพที่จะกระทำการใดไม่กระทำการใดในเนื้อตัวร่างกายของตน และรัฐมีหน้าที่กำหนดให้มีมาตรการส่งเสริมให้บุคคลใช้สิทธิและเสรีภาพโดยจัดให้มีมาตรการในการยุติการตั้งครรภ์ที่ปลอดภัย (2) ในกรณีที่หญิงที่ประสงค์จะทำแท้งเป็นผู้เยาว์ประมวลกฎหมายอาญาไม่ได้กำหนดไว้ แต่พระราชบัญญัติการป้องกันและแก้ไขปัญหาการตั้งครรภ์ในวัยรุ่น พ.ศ. 2559 และกฎกระทรวงกำหนดประเภทของสถานบริการและการดำเนินการของสถานบริการในการป้องกันและแก้ไขปัญหาการตั้งครรภ์ในวัยรุ่น พ.ศ. 2562 กำหนดให้หญิงตั้งครรภ์ที่มีอายุตั้งแต่ 15 ปีขึ้นไปมีสิทธิตัดสินใจที่จะยุติการตั้งครรภ์ทางการแพทย์ที่เป็นไปตามประมวลกฎหมายอาญาได้ด้วยตนเอง แต่สำหรับหญิงอายุต่ำกว่า 15 ปี ไม่มีสิทธิตัดสินใจด้วยตนเอง และไม่ได้กำหนดเงื่อนไขว่าต้องปฏิบัติอย่างไร แต่มาตรการทางกฎหมายของประเทศสิงคโปร์และสาธารณรัฐฝรั่งเศสกำหนดไว้ชัดเจนว่าจะต้องดำเนินการอย่างไร โดยคำนึงถึงการคุ้มครองสิทธิของหญิงตั้งครรภ์ สำหรับการได้รับคำปรึกษาก่อนการทำแท้ง ประมวลกฎหมายอาญาของไทยกำหนดให้เฉพาะหญิงที่มีอายุครรภ์เกิน 12 สัปดาห์ แต่ไม่เกิน 20 สัปดาห์ สามารถทำแท้งได้ หากเข้ารับการตรวจและรับคำปรึกษาทางเลือกจากผู้ประกอบวิชาชีพที่กฎหมายกำหนด ซึ่งแตกต่างจากประเทศสิงคโปร์และสาธารณรัฐฝรั่งเศส ที่กำหนดให้หญิงตั้งครรภ์ทุกรายได้เข้ารับการตรวจและรับคำปรึกษา (3) จากการวิเคราะห์ประมวลกฎหมายอาญายังไม่เหมาะสมกับสภาพปัญหาในปัจจุบัน และหญิงที่ประสงค์จะทำแท้งทุกรายควรได้รับทราบรายละเอียดข้อมูลเกี่ยวกับการทำแท้งเพื่อประกอบการตัดสินใจที่เหมาะสม ไม่เฉพาะแต่หญิงที่มีอายุครรภ์เกิน 12 สัปดาห์เท่านั้น (4) ประมวลกฎหมายอาญาควรมีการแก้ไขเพิ่มเติมกำหนดให้ชัดเจนกรณีของหญิงตั้งครรภ์เป็นผู้เยาว์ว่าต้องปฏิบัติอย่างไรและให้หญิงตั้งครรภ์ทุกรายเข้ารับการตรวจและรับคำปรึกษาก่อนตัดสินใจยุติการตั้งครรภ์
This study aims to 1) examine the general concept of abortion management. 2) compare the criminal codes of foreign nations with those of Thailand regarding decision-making power in adolescent abortion and the requirement to consult with the medical practitioner for the woman seeking to terminate the pregnancy 3) analyze the issues and solution in order to modify Section 305 of the Criminal Code and 4) propose the amendment of the criminal code concerning the abortion. This independent study is qualitative research using legal provisions, academic books, research, Supreme Court decisions, articles from legal journals or magazines, and websites with legal information from other countries, including Singapore and France, that involve pregnancy termination or legal abortion, for analyzing the issues, comparing, summarizing, and proposing the solution. The study has shown that 1) the thai criminal code provides that abortion shall not be illegal if the gestational age is not over 12 weeks with the concept that the right to the body of a woman is a fundamental human right that individuals have the right and freedom to do anything with their body 2) Thai criminal code does not specifically mention abortion for adolescents whether they can receive the consultation before the abortion, but the Act for prevention and solution of the adolescent pregnancy problem,B.E.2559 and Ministerial Regulation on Prescribing Types of Services and Operations of Services in Preventing and Resolving Adolescent Pregnancy Problems, B.E. 2562 state that a woman who the age is over 15 years have the right to terminate the pregnancy by her own determination according to the criminal code. The thai criminal code, however, permits abortion with the gestational age is over 12 weeks but not over 20 weeks, if the woman has an examination and consultation with professional practitioners, in contrast to Singaporean and French laws, which permit every pregnant woman to receive a medical examination and consultation, 3) the analysis of the criminal code indicates that the law is not suitable for the current problems, and any woman who requires an abortion should be informed about her options so that an appropriate decision could be made, not only women whose gestational age is over 12 weeks 4) Thai criminal code should be amended in order to provide a clear guideline in adolescent abortion as well as provide every woman to obtain a medical examination and consultation before deciding whether to have an abortion.
