Abstract
การศึกษาค้นคว้าอิสระเรื่องการลงโทษทางอาญาต่อผู้กระทำความผิดเกี่ยวกับการละเมิดเครื่องหมายการค้านี้ มีวัตถุประสงค์ของการศึกษาเพื่อศึกษาความเป็นมา แนวคิด ทฤษฎีเกี่ยวกับการละเมิดเครื่องหมายการค้าและการลงโทษ ศึกษาการลงโทษตามกฎหมายเครื่องหมายการค้าในประเทศไทยเปรียบเทียบต่างประเทศ วิเคราะห์ปัญหาเกี่ยวกับการลงโทษอาญาผู้กระทำผิดเกี่ยวกับการละเมิดเครื่องหมายการค้า และเพื่อเสนอแนวทางในการแก้ไขปรับปรุงกฎหมายเกี่ยวกับการลงโทษผู้กระทำความผิดเกี่ยวกับเครื่องหมายการค้า การศึกษาค้นคว้าอิสระนี้เป็นการศึกษาค้นคว้าและวิจัยเชิงคุณภาพ โดยศึกษาค้นคว้าจากเอกสารซึ่งได้รวบรวมจากเอกสารที่เกี่ยวข้องทั้งภาษาไทยและในรูปผลงานวิจัย หนังสือ ตำรา บทความ รายงานการศึกษา ข้อมูลสถิติ วิทยานิพนธ์ และเอกสารต่าง ๆ ในรูปแบบอื่นรวมทั้งอินเทอร์เน็ต แหล่งข้อมูลของเอกสารจากแหล่งต่าง ๆ กฎหมาย ระเบียบ ข้อบังคับ และคำพิพากษาของศาล โดยการค้นคว้าจากห้องสมุด จากนั้นนำข้อมูลมาเรียบเรียงและวิเคราะห์อย่างเป็นระบบ ผลการศึกษา ผู้ศึกษาขอเสนอให้ปรับปรุง และแก้ไขบท บัญญัติกฎหมายตามพระราชบัญญัติเครื่องหมายการค้า พ.ศ. 2534 เกี่ยวกับการลงโทษในมาตรา 108 109 และการประกาศ โฆษณาคำพิพากษา เพื่อการประชาสัมพันธ์ หรือเผยแพร่ข้อมูลการถูกจับถูกดำเนินคดีให้แก่ผู้บริโภค หรือบุคคลทั่วไปทราบถึงการกระทำความผิด และการรับโทษ เพื่อยับยั้งบุคคลทั่วไปไม่ให้กระทำผิด
This independent study of the criminal penalties for the offense of trademark infringement aims to study the theoretical concept and punishment of trademark infringement, the legal penalties of trademark in Thailand compared with Other counties, to analyze the problems concern with the criminal conviction on the offense of trademark infringement and Propose guidelines to improve and revised law on the punishment of offenders on trademarks. This independent study is a qualitative research in the form of documentary, gathering data from related law document, research test books, thesis, reports, statistical information, decrees and surfing the internet. Analyzed and organized the data systematically. According to this study suggests to improve the law according to the Trademark Act. B.E. 2534 in section 108 109 and concerned with the punishment and publicize the decrees or the case study of the offence and the penalties to all consumers. To decrease the infringement in the future.
