การศึกษาค้นคว้าอิสระ เรื่อง ปัญหาอำนาจหน้าที่ในการบังคับคดีตามสัญญาประกันในคดีอาญา มีวัตถุประสงค์เพื่อ (1) ศึกษาความหมาย แนวคิดทฤษฎี มาตรฐานสากลและอำนาจในการปล่อยตัวชั่วคราว และการบังคับคดีตามสัญญาประกันทั้งในและต่างประเทศ (2) ศึกษาหลักเกณฑ์วิธีการ เงื่อนไขและดุลพินิจในการงดหรือลดค่าปรับผู้ประกัน ระยะเวลาบังคับคดีและผลกระทบในการบังคับคดี ผู้ประกัน (3) ศึกษาเปรียบเทียบระหว่างการบังคับคดีตามหลักกฎหมายเดิม และตามหลักกฎหมายที่แก้ไขใหม่ (4) ศึกษาและวิเคราะห์ปัญหาการบังคับคดีผู้ประกันตามสัญญาประกันในคดีอาญา และ (5) ศึกษาหาข้อเสนอแนะแนวทางการปรับปรุง แก้ไขปัญหาการบังคับคดีผู้ประกัน พัฒนาระบบการบังคับคดีผู้ประกัน ในคดีอาญาให้มีความชัดเจนและบังคับใช้ไค้อย่างมีประสิทธิภาพต่อไป การศึกษาค้นคว้าอิสระนี้เป็นการศึกษาข้อมูลในทางปฏิบัติและข้อบัญญัติของกฎหมายในทางเอกสาร ทั้งในประเทศและต่างประเทศในรูปแบบการวิจัยเชิงคุณภาพ โดยศึกษาถึงบทบาทอำนาจ หน้าที่ของผู้ดำเนินการบังคับคดีกับผู้ประกันทั้งในอดีตในส่วนอำนาจหน้าที่ในการดำเนินการบังคับคดี ก่อนที่จะมีการแก้ไขประมวลกฎหมายวิธีพิจารณาความอาญา มาตรา 119 (ฉบับที่ 22) พ.ศ.2547 ในช่วงที่ ประมวลกฎหมายวิธีพิจารณาความอาญา มาตรา 119 (ฉบับที่ 22)มีผลบังคับใช้มาตลอดจนเมื่อมีการ แก้ไขเพึ่มเติมประมวลกฎหมายวิธีพิจารณาความอาญา มาตรา 119 (ฉบับที่ 33) พ.ศ.2558 (ปัจจุบัน) บทบาทและอำนาจหน้าที่ในการบังคับคดีของพนักงานอัยการตามพระราชบัญญัติพนักงานอัยการ พ.ศ. 2498 มาตรา 11 (8)และตามพระราชบัญญัติองค์กรอัยการและพนักงานอัยการ พ.ศ.2553 มาตรา14(8) เพื่อเป็นแนวทางในการปรับปรุงกฎหมายในเรื่องดังกล่าวต่อไป ผลการศึกษาพบว่า ยังคงมีปัญหาไม่ความชัดเจนในเรื่องบทบาทอำนาจหน้าที่ และภาระหน้าที่ของผู้ดำเนินการบังคับคดีทั้งในอดีตและปัจจุบัน ตลอดจนปัญหาในการตีความตัวบทกฎหมาย อันนำไปสู่การปฏิบัติที่ไม่ถูกต้อง ไม่เหมาะสมและขาดความชัดเจน จึงเห็นควรให้มีการแก้ไขกฎหมายที่กำหนดอำนาจหน้าที่และภาระหน้าที่ของผู้ดำเนินการบังคับคดีให้มีความเหมาะสมและมีความชัดเจนมากยี่งขึ้น
The objectives of this research were to study (1) the meaning, concepts, theories, international standards and powers involved with the temporary release of suspects and the enforcement of bail contracts in Thailand and other countries; (2) principles, methods, conditions and the use of discretion to waive or reduce the amount of bail or length of time of release, and the impact of enforcement of bail contracts; (3) differences between enforcement of bail contracts under the original law and the revised law; (4) problems that have occurred with the enforcement of bail contracts in criminal cases; and (5) recommendations to solve problems and improve the enforcement of bail contracts so that the law is clearer and more efficient in the future. This research was based on the study of data from law practice and law documents in Thailand and other countries, which was done in the form of qualitative research, to study the roles, powers and responsibilities of officials who enforce bail agreements, both in the past, before the amendment of section 119 of the Criminal Procedure Code (no. 22) B.E. 2547, and also after the amendment came into effect, including thetime period after there was further amendment to section 119 of the Criminal Procedure Code (no. 33) B.E. 2558 (the current version). In addition, the researcher considered the role and power to enforce judgments by prosecutors according to the Public Prosecutors Act B.E. 2498 section 11 (8) and the Public Prosecutors Organization and Public Prosecutors Act B.E. 2553 section 14 (8) with a view to suggesting improvements to the above-mentioned acts. The results showed that in the past and at present there has been and still is a lack of clarity in the laws concerning the role, power and responsibility of officials who enforce bail contracts. There still remain problems with interpretation of the laws which leads to malpractice, unsuitable results and lack of clarity in application of the laws. The author concluded that the laws regulating the powers, responsibilities and duties of the relevant officials should be amended for greater suitability and clarity.
