Abstract
การศึกษาค้นคว้าอิสระเรื่องความไม่เป็นธรรมในการหักค่าลดหย่อนในการเสียภาษี มีวัตถุประสงค์เพื่อศึกษาเรื่อง (1) ความเหมาะสมของค่าลดหย่อนตามประมวลรัษฎากร เฉพาะเรื่องค่าลดหย่อนภาษีเงินได้บุคคลธรรมดาตามประมวลรัษฎากร (2) วิเคราะห์ปัญหาช่องว่างทางกฎหมายเกี่ยวกับค่าลดหย่อนภาษีเงินได้บุคคลธรรมดา และ (3) ศึกษาแนวทางในการปรับปรุงกฎหมายเกี่ยวกับค่าลดหย่อนภาษีเงินได้บุคคลธรรมดา การศึกษาค้นคว้าอิสระนี้เป็นการศึกษาวิจัยเชิงคุณภาพ ด้วยวิธีการวิจัยเอกสาร โดยศึกษาจากกฎหมายไทยและต่างประเทศที่เกี่ยวข้อง คือ ประมวลรัษฎากร คำสั่ง ระเบียบ แนวปฏิบัติ และหนังสือตอบข้อหารือของกรมสรรพากร คำพิพากษาของศาล ตำราทางกฎหมาย และบทความทางวิชาการต่าง ๆ ที่เกี่ยวข้อง จากการศึกษาพบว่า ความเหลื่อมล้ำในการจ่ายภาษีอันเนื่องมาจากสัดส่วนของเงินได้ที่ผู้ที่ร่ำรวยต้องจ่ายเป็นค่าภาษีต่ำกว่าสัดส่วนของเงินได้ที่ผู้มีรายได้น้อยต้องจ่ายเป็นค่าภาษี (หรือคนรวยจ่ายภาษีในอัตราที่ต่ำกว่าคนจน) ทำให้ความเหลื่อมล้ำหรือความแตกต่างด้านรายได้ระหว่างประชาชนเพิ่มมากยิ่งขึ้น การใช้ระบบภาษีเงินได้บุคคลธรรมดาในการจัดเก็บภาษีจากประชาชนสามารถที่จะช่วยลดความเหลื่อมล้ำด้านรายได้ระหว่างประชาชนและเป็นการกระตุ้นเศรษฐกิจได้โดยการปฏิรูปค่าลดหย่อนภาษีเงินได้ส่วนบุคคลโดย (1) การปรับเพิ่มค่าลดหย่อนภาษีเงินได้ส่วนบุคคลให้คลอบคลุมค่าใช้จ่ายในการบริโภคส่วนบุคคลต่อคนและให้สอดคล้องกับการเพิ่มขึ้นของระดับราคาสินค้า (2) การยกเลิกหรือทำให้หมดไปในค่าลดหย่อนภาษีเงินได้ส่วนบุคคลสำหรับคนร่ำรวย ดังนั้นผลที่คาดว่าจะได้รับ คือ การปรับเพิ่มค่าลดหย่อนภาษีแก่ผู้ที่มีรายได้น้อยและยกเลิกค่าลดหย่อนภาษีแก่ผู้มั่งมี ซึ่งจะมีส่วนช่วยให้บรรลุผลตามเป้าหมายในการลดความเหลื่อมล้ำด้านรายได้ระหว่างประชาชนในระดับที่ต้องการ นอกจากนี้ น่าที่จะมีส่วนช่วยในการกระตุ้นระบบเศรษฐกิจของประเทศที่อยู่ในภาวะเศรษฐกิจถดถอย การปฏิรูปค่าลดหย่อนทำให้ผู้ที่มีรายได้น้อยจะมีเงินเหลือเพื่อนำไปจับจ่ายใช้สอยการครองชีพที่มากขึ้น ในขณะที่รัฐบาลเองก็น่าจะยังคงจัดเก็บภาษีได้อย่างพอเพียง เพราะการปฏิรูปจะส่งเสริมหลักความมีประสิทธิภาพในการจัดเก็บภาษีอย่างประหยัดในเวลาเดียวกันอีกด้วยการปฏิรูปค่าลดหย่อนภาษีเงินได้ส่วนบุคคลเพื่อลดความเหลื่อมล้ำด้านรายได้
This independent study on the unfairness of tax deduction was to study (1) the appropriateness of the tax deduction, in particular of personal income tax, under the Revenue Code; (2) the gap of law on the personal income tax allowances; and (3) the proper amendment to the tax deduction under Revenue Code. This independent study was a qualitative research. The study conducted through a documentary research from the data collected from Revenue Code in Thailand and other countries where concerned including rules, instructions, ministerial rules, discuss letters from the Department of Revenue, court judgments, and related academic articles. The results of the study showed that disparity in taxes paid on the basis of the proportion of income that the rich people pay a lower proportion of income tax than a lower income person to pay the tax (The rich people pay taxes at lower rates than poor people) was affected to people more and more. The personal income tax system in taxation of the public could help to reduce the disparity in income between people and to stimulate the economy by reforming the income tax personal allowances by (1) increasing tax allowances to cover personal expenses, personal consumption per person and in accordance with the increase in the price level; and (2) cancelling or eliminating the personal income tax deductions for wealthy people. In this regard, the increasing of tax allowanced for people with low income and had tax deductions for the wealthy which would achieve the goal of reducing the income disparity to the desired levels. This also help to stimulate the national economy in recession since the reform of allowances to people with low incomes will cause them to have more money left to spend a lot of living up. While the government had enough of tax amount that would be continued to reform efficiency tax saving at the same time with the reform of personal income tax deductions to reduce income inequality.
