Abstract
การศึกษาค้นคว้าอิสระมีวัตถุประสงค์ เพื่อศึกษาประวํติความเป็นมา แนวคิด ทฤษฎี และหลักเกณฑ์ ของการดำเนินการไกล่เกลี่ยและประนอมข้อพิพาทศึกษาถึงเจตนารมณ์ของการดำเนินการไกล่เกลี่ยและประนอม ข้อพิพาทของฝ่ายปกครอง และวิเคราะห์ปัญหาข้อกฎหมายของกฎกระทรวงว่าด้วยการไกล่เกลี่ยความผิดที่มีโทษ ทางอาญา พ.ศ.2553 ศึกษาวิเคราะห์มาตรการไกล่เกลี่ยของฝ่ายปกครองเพื่อให้การบังคับใช้กฎกระทรวงว่าด้วย การไกล่เกลี่ยความผิดที่มีโทษทางอาญา พ.ศ.2553 มีประสิทธิภาพมากยี่งขึ้น ศึกษาแนวทางในการแก้ไข ปรับปรุงหลักเกณฑ์และวิธีการในการดำเนินการไกล่เกลี่ย ตามกฎกระทรวงว่าด้วยการไกล่เกลี่ยความผิดที่มีโทษทางอาญา พ.ศ.2553 การศึกษาค้นคว้าอิสระนี้เป็นการวิจัยเชิงคุณภาพโดยใช้วิธีการวิจัยเอกสาร โดยทำการค้นคว้าใน รูปแบบของหนังสือ ตำรา วิทยานิพนธ์ สารนิพนธ์ ตัวบทกฎหมาย คำพิพากษาศาลฎีกา คำสั่ง ข้อกำหนด ระเบียบ ต่างๆ ที่เกี่ยวข้อง และข้อมูลจากสื่ออิเล็กทรอนิกส์ซึ่งศึกษาในเรื่องแนวคิด ทฤษฎี และหลักเกณฑ์ ของการดำเนินการไกล่เกลี่ยและประนอมข้อพิพาท รวมถึงเจตนารมณ์ของการดำเนินการไกล่เกลี่ยและประนอมข้อพิพาทของฝ่ายปกครอง ตลอดจนศึกษาเปรียบเทียบเกี่ยวกับการดำเนินไกล่เกลี่ยและประนอมข้อพิพาททางอาญาของประเทศสหรัฐอเมริกา และประเทศฟิลิปปินส์ เพื่อเป็นแนวทางในการปรับปรุงกฎหมายไทยในเรื่องดังกล่าวต่อไป ผลการศึกษาพบว่าการตราพระราชบัญญัติระเบียบบริหารราชการแผ่นดิน พ.ศ.2534 และที่แก้ไขเพี่มเดิม ฉบับที่ 7 พ.ศ.2550 มาใช้บังคับ โดยให้อำนาจนายอำเภอในการจัดการยุติข้อพิพาทด้วยวิธีการไกล่เกลี่ย ทั้งในคดีแพ่งและคดีอาญาที่เกิดขึ้นในระดับชุมชน เป็นการแก้ไขป้ญหาที่ทำให้ประชาชนได้เข้าถึงกระบวนการ ยุติธรรมและเป็นการช่วยเสริมสร้างความสงบเรียบร้อยและความปรองดองในสังคมได้เป็นอย่างดี แต่อย่างไรก็ตาม ภายหลังจากการออกกฎกระทรวงว่าด้วยการไกล่เกลี่ยความผิดที่มีโทษทางอาญา พ.ศ.2553 ที่ออกตามความในกฎหมายระเบียบบริหารราชการแผ่นดิน พ.ศ.2550 ขึ้นใช้บังคับ พบว่า ยังมีป้ญหาในเรื่องการบัญญัติกฎหมายบางข้อ มีรายละเอียดที่ไม่ชัดเจน ครอบคลุม ทำให้การบังคับใช้กฎหมาย ไม่สัมฤทธึ๋ผลเท่าที่ควรจึงเห็นควรให้มีการมีการปรับปรุงแก้ไขเพิ่มเติม กฎกระทรวงว่าด้วยการไกล่เกลี่ยความผิดที่มีโทษทางอาญา พ.ศ.2553 เพื่อให้กระบวนการ ไกล่เกลี่ยและประนอมข้อพาทของอำเภอมีความเหมาะสม และมีประสิทธิภาพเกิดประโยชน์สูงสุดต่อประชาชน ผู้รับบริการอย่างแท้จริง
This independent study has its objective to study the history, concept, theory and principle of mediation and dispute resolution. It is to study the aim of mediation and dispute resolution in administrative entity and to analyse legal issue of the ministerial regulation of mediation of wrongdoing with criminal punishment B.E. 2553 to have it become more efficiency. The researcher aims to study guidance to improve principle and method to mediation according to the ministerial regulation of mediation of wrongdoing with criminal punishment B.E. 2553 This independent study is qualitative research studying through documents and by researching through books, textbooks, theses, master project, laws, Supreme Court cases, and relevant orders and regulations. It also include electronics media which study concept, theory and principle of mediation and dispute resolution including the purpose of mediation and dispute resolution of administrative entity and to have a comparative study of mediation and dispute resolution in criminal case in the United States and the Republic of the Philippines. This is to have guidance for further improvement of Thai laws in such issue. From the study, it is found that the enforcement of the National Government Organization Act B.E. 2534 and the amendment (no. 7) B.E. 2550 by empowering Sheriff to resolve dispute in the community through mediation both in civil and criminal case is the efficient way to resolve issue whereby people can access to justice and encourage more peace and harmony in the society. However, after the issuance of the ministerial regulation of mediation of wrongdoing with criminal punishment B.E. 2553 which issued according to the law of the National Government Organization Act B.E. 2550, it is found that there remain problems of certain principle of laws with lack of clarification and thus render the enforcement of law being less efficient. It is therefore consider that there shall be improvement of the ministerial regulation of mediation of wrongdoing with criminal punishment B.E. 2553 in order to have a suitable mediation and dispute resolution in the community and to bring highest and true benefit toward people who use mediation service
