ปัญหากฎหมายเกี่ยวกับการเคลื่อนย้ายสัตว์และซากสัตว์ในประเทศไทยตามพระราชบัญญัติโรคระบาดสัตว์ พ.ศ. 2558

Abstract

การศึกษาค้นคว้าอิสระนี้มีวัตถุประสงค์เพื่อ 1) ศึกษาแนวคิด ทฤษฎี ที่เกี่ยวข้องกับมาตรการในการบังคับใช้พระราชบัญญัติโรคระบาดสัตว์ พ.ศ. 2558 ในประเทศไทย (2) ศึกษา และวิเคราะห์มาตรการทางกฎหมายเกี่ยวกับโรคระบาดสัตว์ตามกฎหมายต่างประเทศกับประเทศไทย (3) เสนอแนวทางการแก้ไขปัญหาเกี่ยวกับโรคระบาดสัตว์ที่เหมาะสมกับประเทศไทย การศึกษาค้นคว้าอิสระนี้เป็นการศึกษาวิจัยเชิงคุณภาพ ด้วยการวิจัยเอกสารโดยศึกษาพระราชบัญญัติโรคระบาดสัตว์ พ.ศ. 2558 จากตำรากฎหมาย บทความทางวิชาการ งานวิจัยและผลงานทางวิชาการอื่น ๆ ทั้งภาษาไทยและภาษาต่างประเทศ โดยนำมาวิเคราะห์หาข้อสรุป เพื่อให้ได้ทราบถึงแนวคิด ทฤษฎี และบทบัญญัติของมาตรการทางกฎหมายเกี่ยวกับโรคระบาดสัตว์ ผลของการศึกษา พบว่า (1) มีการนำแนวคิดและทฤษฎีทางกฎหมายที่เกี่ยวกับพระราชบัญญัติโรคระบาดสัตว์ พ.ศ. 2558 มาใช้เพื่อควบคุมการเคลื่อนย้ายสัตว์และซากสัตว์ในประเทศไทย (2) มาตรการควบคุมการเคลื่อนย้ายสัตว์และซากสัตว์ รวมทั้งการกำหนดโทษปรับของต่างประเทศมีความรุนแรงและเข้มงวดมากกว่ากฎหมายไทย (3) การแก้ไขเพิ่มเติมพระราชบัญญัติโรคระบาดสัตว์ พ.ศ. 2558 โดยเพิ่มเติมนิยามคำว่า “สุก” ให้มีความหมายชัดเจนการกำหนดจํานวนปริมาณซากสัตว์ที่เคลื่อนย้ายข้ามเขตจังหวัด และการกำหนดชนิดสัตว์ในการเคลื่อนย้าย ทําการค้า และการทำเครื่องหมายประจำตัวสัตว์ของประเทศไทย อันส่งผลกระทบต่อสุขภาพและชีวิตของประชาชน รวมทั้งเศรษฐกิจโดยรวมของประเทศไทย

This independent study aims to: (1) Study the theoretical concepts related to the measure of enforcement Animal Epidemics Act, B.E. (2015) in Thailand (2) Studying and analyzing legal measures related to anthrax according to foreign laws with Thailand (3) Propose appropriate solutions for anthrax problem in Thailand. This study was a qualitative Research by the method of documentary research, using data collection from the related documents and information such as the Animal Epidemics Act, B.E. (2015), Academic articles, researching reports, Thesis and website data, which has been analyzed to find out the solutions for the laws relating to anthrax The results of the study were (1) Legal concepts and theories related to the Animal Epidemics Act, B.E. (2015) are applied to control the movement of animals and carcasses in Thailand. (2) Control measures for the movement of animals and carcasses and Fine rate in Foreign laws are more severe and stricter than Thai law. (3) Amendment of the Animal Epidemics Act, B.E. (2015) should have been done by adding the definition of "Cooked" to have a clear meaning, and also determination of the quantity of animal carcasses that are moved across the province, and the identification of animal species in the commercial movement, and the identification of animals in Thailand, all of which affect the health and life of the people including the overall economy of Thailand.
