ปัญหาและอุปสรรคในการตราเทศบัญญัติของไทย

Abstract

การศึกษาค้นคว้าอิสระเรื่อง ปัญหาและอุปสรรคในการตราเทศบัญญัติของไทย มีวัตถุประสงค์เพื่อศึกษาถึง กระบวนการ ขั้นตอนของการตราเทศบัญญัติ องค์ความรู้ และระเบียบกฎหมายต่าง ๆ ที่เกี่ยวข้อง ที่ต้องมาใช้ประกอบในการตราเทศบัญญัติ วิเคราะห์ปัญหาและอุปสรรคในการตราเทศบัญญัติทั้งในส่วนของขั้นตอน การริเริ่มและการยกร่างเทศบัญญัติ การตราเทศบัญญัติ และการบังคับใช้เทศบัญญัติ เพื่อนำเสนอแนวทางในการพัฒนาการตราเทศบัญญัติในประเทศไทยให้มีคุณภาพและประสิทธิภาพ สามารถนําไปเป็นแนวทางในการปฏิบัติ และเป็นแหล่งอ้างอิงตามกฎหมายได้ การศึกษาค้นคว้าอิสระนี้ เป็นการวิจัยเชิงคุณภาพ (Qualitative Research) ด้วยการวิจัยทางเอกสาร (Documentary Research) โดยการค้นคว้าจากตำรากฎหมายที่เกี่ยวข้อง เทศบัญญัติ คำพิพากษา คําวินิจฉัย วิทยานิพนธ์ ดุษฎีนิพนธ์ บทความจากวารสาร และสื่ออิเลคทรอนิกส์ต่าง ๆ ผลการศึกษาพบว่า (1) ผู้มีอำนาจยกร่างเทศบัญญัติขาดองค์ความรู้ในการยกร่างเทศบัญญัติ (2) ก่อนการยกร่างเทศบัญญัติ เทศบาลขาดการสำรวจภารกิจทั้งหมดของเทศบาลที่มีอยู่ (3) ขาดหน่วยงาน องค์กรที่ช่วยเหลือในการยกร่างและตรวจสอบความเหมาะสมของเทศบัญญัติก่อนการประกาศใช้เป็นเทศบัญญัติ (4) การขาดการติดตามผลการบังคับใช้และความจําเป็นในการแก้ไขหรือเพิ่มเติมเทศบัญญัติเรื่องต่าง ๆ แนวทางแก้ไขปัญหา จากข้อค้นพบ สามารถแยกได้ดังนี้ (1) ใน ขั้นตอนของการริเริ่มจัดทําเทศบัญญัติ และการยกร่างเทศบัญญัติ ควรเน้นกระบวนการมีส่วนร่วมของประชาชน (2) แต่ละเทศบาลควรแต่งคณะกรรมการที่จะช่วยเหลือในการยกร่างเทศบัญญัติและกลับกรองเทศบัญญัติก่อนนําเข้าสู่การพิจารณาของสภาเทศบาล (3) แต่ละเทศบาลควรปรับปรุงเนื้อหาเทศบัญญัติให้มีความเหมาะสมและสอดคล้องกับภารกิจในการจัดทำบริการสาธารณะของเทศบาล (4) ควรสนับสนุนให้นายกเทศมนตรี สมาชิกสภาเทศบาล และนิติกรประจำเทศบาลเข้ารับการสัมมนาและฝึกอบรมในเรื่องเทศบัญญัติ

The objectives of this independent study entitle Problems in Enactment of Municipal Laws are a) to examine legislative processes for municipal law and other regulations, and laws required in such process, b) to analyze problems and challenges in all relevant steps including problem analysis, initiative, drafting. enacting and enforcing the laws and c) to develop and present the practical guidelines for improving the quality and effectiveness of the legislative process. The methodology of the study includes documentary research, reviewing relevant legal literatures, municipal ordinances, court judgement official decisions, theses, dissertations, journal articles, and other electronic media. The study finds that: (1) authorized personnel has insufficient knowledge to draft the municipal legislation: (2) municipalities fail to review existing missions prior to the drafting process (3) there is an absence of a mechanism to provide support in the drafting process and verify the appropriateness of legislation before enacting and (4) there is a lack of monitoring for implementation and reviewing for further amendment or enhancement. The findings reveal a number of solutions as follows. (1) Public participation process should be involved more fully in the procedure of the initiative and drafting the municipal law and regulations. (2) In each Municipality, the Municipal Committee should be appointed to assist in drafting the municipal laws and sifting the draft before passing to the consideration of the (3) Each Municipality should improve the content of the Municipal Council. municipal laws which will be fit and consistent with its own public services. (4) The Mayor, Members of the Municipal Council and Municipal lawyers should be encouraged to join the training courses and seminars regarding the municipal laws and regulations.
