Abstract
การศึกษาค้นคว้าอิสระเรื่อง “ปัญหาการตีความสัญญาจ้างที่ปรึกษาออกแบบและควบคุมงานในคดีปกครอง” มีวัตถุประสงค์ของการศึกษา ดังนี้ 1) เพื่อศึกษาแนวคิดและทฤษฎีเกี่ยวกับสัญญาทางปกครอง และหลักกฎหมายเกี่ยวกับสัญญาทางปกครอง และสัญญาจ้างที่ปรึกษาออกแบบและควบคุมงานของส่วนราชการตามระบบกฎหมายของประเทศฝรั่งเศสและประเทศเยอรมัน 2) เพื่อศึกษาแนวคิดและทฤษฎีเกี่ยวกับสัญญาทางปกครอง และสัญญาจ้างที่ปรึกษาออกแบบและควบคุมงานของส่วนราชการตามระบบกฎหมายไทย 3) เพื่อศึกษาวิเคราะห์ปัญหาการตีความลักษณะของสัญญาจ้างที่ปรึกษาออกแบบและควบคุมงานของส่วนราชการในประเทศไทย 4) เพื่อเสนอแนะแนวทางในการกำหนดหลักเกณฑ์เกี่ยวกับสัญญาทางปกครองเพิ่มเติมเพื่อปรับใช้กับสัญญาจ้างที่ปรึกษาออกแบบและควบคุมงานตามระเบียบสานักนายกรัฐมนตรี ว่าด้วยการพัสดุฯ การศึกษาค้นคว้าอิสระนี้ เป็นการค้นคว้าและวิจัยเชิงคุณภาพ โดยใช้รูปแบบการวิจัยทางเอกสาร โดยศึกษาจากตัวบทกฎหมาย คำพิพากษาศาลฎีกา คำวินิจฉัยศาลปกครองสูงสุด รวมถึงตำรา บทความ ความเห็นของนักกฎหมาย เพื่อประมวลแนวความคิดเกี่ยวกับสัญญาทางปกครอง และสัญญาจ้างที่ปรึกษาออกแบบและควบคุมงานในระบบกฎหมายของต่างประเทศ เพื่อนำมาเทียบเคียงกับแนวความคิดในระบบกฎหมายของไทย ผลการศึกษาพบว่า สัญญาจ้างที่ปรึกษาออกแบบและควบคุมงาน มีวัตถุประสงค์หลัก คือ เพื่อให้มีการตรวจและควบคุมงานก่อสร้างอาคารให้สามารถดำเนินการให้เป็นไปตามสัญญาและถูกต้องตามหลักวิชาโดยผู้ควบคุมงานที่มีความรู้ความชำนาญงานทางด้านสถาปัตยกรรมและวิศวกรรมแทนส่วนราชการผู้ว่าจ้าง เพื่อให้ได้งานก่อสร้างที่บรรลุตามวัตถุประสงค์ในการให้บริการสาธารณะ การวินิจฉัยข้อพิพาทเกี่ยวกับสัญญาจ้างที่ปรึกษาออกแบบและควบคุมงาน ต้องวินิจฉัยบนพื้นฐานของสัญญาหลัก คือ สัญญาจ้างก่อสร้างซึ่งเป็นสัญญาทางปกครองเป็นสำคัญ แต่แนวคำวินิจฉัยของศาลปกครองเกี่ยวกับสัญญาจ้างที่ปรึกษาออกแบบและควบคุมงานยังไม่ชัดเจน บางกรณีศาลปกครองก็รับคดีเกี่ยวกับสัญญาจ้างที่ปรึกษาออกแบบและควบคุมงานไว้พิจารณา บางกรณีศาลปกครองก็วินิจฉัยว่าสัญญาจ้างออกแบบและควบคุมงานเกิดจากการที่คู่สัญญาฝ่ายปกครองและเอกชนแสดงเจตนาด้วยใจสมัครในฐานะที่เท่าเทียมกันตามประมวลกฎหมายแพ่งและพาณิชย์ จึงไม่มีลักษณะเป็นสัญญาทางปกครอง ดังนั้นจึงควรแก้ไขปัญหาความไม่ชัดเจนเกี่ยวกับลักษณะของสัญญาจ้างที่ปรึกษาออกแบบและควบคุมงาน โดย 1) เพิ่มเติมแบบท้ายระเบียบสานักนายกรัฐมนตรี ว่าด้วยการพัสดุ พ.ศ. 2535 โดยแยกสัญญาจ้างก่อสร้างที่มีการจ้างที่ปรึกษาออกแบบและควบคุมงานให้ต่างกับสัญญาจ้างทั่วไป โดยให้มีเนื้อหาของสัญญาครอบคลุมถึงสัญญาจ้างที่ปรึกษาออกแบบและควบคุมงาน และ 2) แก้ไขพระราชบัญญัติวิธีพิจารณาคดีปกครอง พ.ศ. 2542 ให้ศาลปกครองเป็นศาลที่มีอำนาจวินิจฉัยข้อพิพาทเกี่ยวกับสัญญาจ้างก่อสร้างดังกล่าว
This independent study on “A Problem on Interpretation of Design and Construction Consultant Contracts in Administrative Law Cases” aims to: 1) study the conceptual theory on administrative contracts and jurisprudence on administrative contracts and design and construction consultant contracts in French and German legal system; 2) study the conceptual theory on administrative contracts and design and construction consultant contracts in Thai legal system; 3) analyze problems in the interpretation of the design and construction consultant contracts of Thai government sectors in Thai legal system; and 4) recommend the Guidelines for imposing the additional regulation on administrative contracts which will be applied to the design and construction consultant contracts under the Regulations of the Office of Prime Minister on Procurement, B.E.2535 (1992). This study was a qualitative research by using documentary research method and studied from laws, the Supreme Court and the Supreme Administrative Court precedent and also articles and opinions of legal scholars to crystallize the concept of administrative contracts and design and construction consultant contracts in Thailand and abroad. This study found that the design and construction consultant contracts has major objectives to provide the inspection and controlling for the building construction, in order to operate the project completely following to the construction contracts and construction principles, by professional consultants in the field of architecture and civil Engineering instead of the contractors and to reach the purpose of public services for the as such construction. Regarding the design and construction consultant contract cases, the Administrative Court must significantly consider on the ground of the main contract, “the construction contract” that is an administrative contract. However, judgments and orders rendered by the Administrative Courts are uncertainty. Some cases, the Administrative Courts accepted the design and construction consultant contract cases into their consideration. But, some cases they denied to accept this kind of cases into their consideration by the reason that the design and construction consultant contract is not an administrative contract since the parties i.e. “the governmental agency and the private party” voluntary to make a contract and have equal status under the Civil and Commercial Code. The solutions are 1) the Regulations of the Office of Prime Minister on Procurement B.E. 2535 (1992) should be amended by separating the construction contract with design and construction consultant contract as a specific construction contract from the general construction contract and adding the provisions of the design and construction consultant contract in the related contract form and 2) the Act on Establishment of Administrative Courts and Administrative Court Procedure B.E. 2542 (1999) should be amended by including the design and construction consultant contract cases within the Administrative Court Jurisdiction.
