การวินิจฉัยให้มีการเลือกตั้งใหม่หรือเพิกถอนสิทธิเลือกตั้งของสมาชิกสภาผู้แทนราษฎรและสมาชิกวุฒิสภาโดยศาลยุติธรรม

Abstract

การค้นคว้าอิสระเรื่อง การวินิจฉัยให้มีการเลือกตั้งใหม่หรือเพิกถอนสิทธิเลือกตั้งโดยศาลยุติธรรม มีวัตถุประสงค์ ดังนี้ 1) เพื่อศึกษาแนวคิดเกี่ยวกับการตรวจสอบและควบคุมการใช้อานาจรัฐในส่วนที่เกี่ยวกับการเลือกตั้ง 2) เพื่อศึกษาอำนาจการพิจารณาและวินิจฉัยคดีเลือกตั้งขององค์กรตุลาการตามกฎหมายไทย 3) เพื่อศึกษาอำนาจขององค์กรที่เกี่ยวข้องในการวินิจฉัยชี้ขาดคดีเลือกตั้งในต่างประเทศเปรียบเทียบกับอำนาจการวินิจฉัยชี้ขาดคดีเลือกตั้งขององค์กรในประเทศไทย และ 4) เพื่อหาแนวทางในการแก้ไขปรับปรุงวิธีพิจารณาที่เหมาะสมในการวินิจฉัยชี้ขาดคดีเพิกถอนสิทธิเลือกตั้งหรือสั่งให้มีการเลือกตั้งใหม่ในประเทศไทย การศึกษาค้นคว้าอิสระนี้เป็นการวิจัยเชิงคุณภาพ ด้วยวิธีการวิจัยทางเอกสาร จากการค้นคว้าและรวบรวมเอกสารภาษาไทยและภาษาต่างประเทศ จากตำรา หนังสือ ข้อมูล วิทยานิพนธ์ที่เกี่ยวข้อง บทความต่าง ๆ รวมทั้งงานวิจัยที่เกี่ยวข้อง ความเห็นของนักนิติศาสตร์ กฎหมาย กฎเกณฑ์ ระเบียบ ข้อบังคับ ประกาศที่เกี่ยวข้อง และจากสารสนเทศทางอินเตอร์เน็ต ผลการศึกษาพบว่า การใช้อำนาจของคณะกรรมการการเลือกตั้งถือเป็นการใช้อำนาจขององค์กรอิสระตามรัฐธรรมนูญและวิธีการแก้ปัญหาข้อพิพาทอันเกิดจากการดำเนินการจัดการเลือกตั้งของคณะกรรมการการเลือกตั้งต้องดำเนินการตามหลักนิติวิธีทางกฎหมายรัฐธรรมนูญมิใช่นิติวิธีทางกฎหมายเอกชน ซึ่งจะต้องปรับปรุงวิธีพิจารณาคดีเลือกตั้งของศาลฏีกาในการเพิกถอนการเลือกตั้งให้มีความเหมาะสมยิ่งขึ้นในกรณีที่คณะกรรมการการเลือกตั้งมีความเห็นควรสั่งให้มีการเลือกตั้งใหม่หรือการเพิกถอนสิทธิเลือกตั้งตามมาตรา 239 วรรคสองและวรรคสี่ เพื่อให้สอดคล้องกับลักษณะของคดีและเป็นหลักประกันความเป็นธรรมของผู้ที่เข้ามาอยู่ในกระบวนการพิจารณา

The objectives of the independent study are 1) to investigate the concept of inspection and controls of exercising the state authority on election, 2) to investigate the authority to try and to adjudicate the election cases of the judicial bodies by the Thai law, 3) to investigate the power of the judicial bodies involved in their decisions of election in aboard in order to compare the decisions of election by the judicial bodies in Thailand, and 4) to find solutions in order to improve the procedure of an appropriate decision on rights revocation or order to organize reelection in Thailand. This independent study is a qualitative approach through documentary research by exploring and collecting the Thai and foreign textbooks, books, information, related theses, articles and related researches, lawyers’ comments, laws, criteria, regulations, obligations, announcement related and the internet information. The findings are the exercising authority of the Election Commission is under the non-government origination promulgated by the Kingdom Constitution and the solutions of matter of disputes risen from organizing an election of the commission. The election should follow the rule of the constitutional law rather than the rule of private law. It needs to improve the election trial of the Supreme Court in the election revocation for better appropriation in the case of the Election Commission having opinions on deserving reelection or rights revocation by Article 239, paragraphs 2 and 4 to meet the nature of the case and as the warranty of fairness for those entering the judicial procedures.
