Abstract
การศึกษานี้มีวัตถุประสงค์เพื่อ (1) ศึกษาแนวคิดที่เกี่ยวข้องกับเงื่อนไขการจ้างหรือการทำงานและการคุ้มครองแรงงานผู้สูงอายุ (2) ศึกษากฎหมายที่เกี่ยวข้องกับเงื่อนไขการจ้างหรือการทำงานและการคุ้มครองแรงงานผู้สูงอายุของกฎหมายไทยและกฎหมายต่างประเทศ (3) เพื่อศึกษาเปรียบเทียบกฎหมายและวิเคราะห์ในกรณีเงื่อนไขการจ้างหรือการทำงานและการคุ้มครองแรงงานผู้สูงอายุและ (4) ศึกษาการปรับปรุงแก้ไขกฎหมายเกี่ยวกับเงื่อนไขการจ้างหรือการทำงานและการคุ้มครองแรงงานผู้สูงอายุของประเทศไทย การศึกษาครั้งนี้เป็นการศึกษาเชิงคุณภาพด้วยวิธีวิจัยเอกสาร ข้อมูลที่ใช้ในการศึกษา ได้แก่ กฎหมายของประเทศไทย สหรัฐอเมริกาและประเทศญี่ปุ่น กฎหมายแรงงานระหว่างประเทศ โดยการเก็บรวบรวมข้อมูลจากตัวบทกฎหมาย หนังสือ บทความ เอกสารทางวิชาการ งานวิจัย วิทยานิพนธ์ และข้อมูลจากสื่อเล็กทรอนิกส์อินเทอร์เน็ต ในส่วนของการวิเคราะห์ข้อมูลงานวิจัย ผู้ศึกษาทำการวิเคราะห์และสังเคราะห์ข้อมูลเชิงคุณภาพจากเนื้อหาที่ได้จากการทบทวนวรรณกรรมและการศึกษากฎหมายที่เกี่ยวข้อง เพื่อนำมาเป็นแนวทางในการแก้ไขปรับปรุงกฎหมายเกี่ยวกับเงื่อนไขการจ้างหรือการทำงานและการคุ้มครองแรงงานผู้สูงอายุ ผลการศึกษาพบว่า (1) แนวคิดพื้นฐานเกี่ยวกับแรงงานผู้สูงอายุ สถานการณ์และปัญหาการจ้างงาน แนวคิดในการคุ้มครองแรงงานผู้สูงอายุในที่ทำงานของกฎหมายไทยและกฎหมายต่างประเทศมีความแตกต่าง (2) กฎหมายของสหรัฐอเมริกา ประเทศญี่ปุ่น แม้จะไม่มีกฎหมายเฉพาะ แต่ประเทศดังกล่าวมีกฎหมายที่เกี่ยวข้องกับเงื่อนไขการจ้างหรือการทำงานและการคุ้มครองแรงงานผู้สูงอายุ (3) จากการวิเคราะห์กฎหมายไทยตามพระราชบัญญัติผู้สูงอายุ พ.ศ. 2546 มาตรา 3 , มาตรา 11 และพระราชบัญญัติคุ้มครองแรงงาน พ.ศ. 2541 มาตรา 23 และมาตรา 90 ยังไม่ครอบคลุมเพียงพอ เมื่อเทียบกับกฎหมายขององค์การแรงงานระหว่างประเทศ กฎหมายของสหรัฐอเมริกาและประเทศญี่ปุ่นที่มีการกล่าวถึงช่วงอายุ ประเภทงานที่จ้าง อัตราค่าจ้างและระยะเวลาทำงาน (4) ให้มีแนวทางการแก้ไขพระราชบัญญัติผู้สูงอายุ พ.ศ. 2546 มาตรา 3 , มาตรา 11 และพระราชบัญญัติคุ้มครองแรงงาน พ.ศ. 2541 มาตรา 23 และมาตรา 90 เพื่อให้ครอบคลุมถึงเงื่อนไขการจ้างหรือการทำงานและการคุ้มครองแรงงานผู้สูงอายุ ให้สอดคล้องกับองค์การแรงงานระหว่างประเทศ กฎหมายสหรัฐอเมริกาและประเทศญี่ปุ่นที่ลูกจ้างผู้สูงอายุมีสิทธิจะได้รับความคุ้มครอง โดยกำหนดช่วงอายุ ประเภทงานที่จ้าง อัตราค่าจ้างและระยะเวลาทำงานให้ชัดเจนและครอบคลุม
This independent study aims to, The purpose of this independent study is (1) to study the concepts related to the conditions of employment or work and the protection of elderly workers. (2) to study the laws related to the conditions of employment or work and the protection of elderly workers of Thai and foreign laws. (3) to study the comparative law and analyze the case of employment or working conditions and the protection of elderly workers, and (4) to study the amendments and amendments to the law on conditions of employment or work and the protection of elderly workers in Thailand. This independent study is qualitative research conducted by documentary method. The data is collected from the laws of Thailand, United States of America, Japan and International Labor. The data is collected from relevant laws, books, articles, academic documents, research reports, thesis and electronic information. In this independent study, the author uses the analytic and synthetic method for the qualitative data. The analysis was based on qualitative data from literature reviews and current laws in order to propose recommendation for the amendment of law relating to the conditions of employment or work and the protection of elderly workers According to the study, The research found that the, The result indicated that (1) the basic concepts of elderly labor Situations and employment problems, the concept of protecting elderly workers in the workplace under Thai and foreign laws are different. (2) United States of America, Japan and International Labor although there is no specific law But such countries have laws related to the conditions of employment or work and the protection of elderly workers. (3) from the analysis of Thai laws under the Elderly Act B.E. 2546, Section 3, Section 11 and the Labor Protection Act B.E. 2541, Section 23 and Section 90 are not sufficiently comprehensive. Compared to the law of the International Labor Organization US and Japanese laws regarding age ranges Type of work hired Wage rate and length of service. (4) provide guidelines for amending the Elderly Act B.E. 2546, Section 3, Section 11 and the Labor Protection Act B.E. 2541, Section 23 and Section 90 to cover the conditions of employment or work and the protection of elderly workers. in accordance with the International Labor Organization US and Japanese laws in which elderly employees are entitled to protection by the age range Type of work hired the wage rate and length of work must be clear and comprehensive.
