Abstract
การศึกษาค้นคว้าอิสระนี้มีวัตถุประสงค์เพื่อ (1) ศึกษาแนวคิด ทฤษฎีและหลักการเกี่ยวกับการสั่งไม่ฟ้องคดีอาญาของพนักงานอัยการที่ไม่เป็นประโยชน์ต่อสาธารณชน (2) วิเคราะห์ เพื่อหาแนวทางที่เหมาะสมในการสั่งไม่ฟ้องเพื่อลดปริมาณคดีขึ้นสู่ศาลอย่างมีประโยชน์สูงสุด การศึกษาค้นคว้าอิสระนี้เป็นการวิจัยเชิงคุณภาพ โดยวิธีการวิจัยเอกสารจากตำรา กฎหมาย ระเบียบ คำสั่งที่เกี่ยวข้อง วิทยานิพนธ์ สารนิพนธ์ บทความ เอกสารทางวิชาการ และข้อมูลจากเครือข่ายทางอินเตอร์เน็ตทั้งภาษาไทยและภาษาอังกฤษ โดยนำมาจัดรวบรวมและทำการวิเคราะห์จากข้อมูลที่ได้จากเอกสารเหล่านั้น
ผลจากการศึกษาค้นคว้าอิสระ พบว่า (1) บทบัญญัติแห่งกฎหมายว่าด้วยสั่งไม่ฟ้อง คดีอาญาของพนักงานอัยการที่ไม่เป็นประโยชน์ต่อสาธารณชนไม่ครอบคลุมหลักเกณฑ์ในการสั่งคดีโดยทั่วไป การสั่งคดีกรณีการไกล่เกลี่ยข้อพิพาททางอาญาในชั้นสอบสวนไม่เป็นผลยุติคดี และการกำหนดประเภทคดีและลักษณะของคดีการไกล่เกลี่ยข้อพิพาททางอาญาในชั้นสอบสวนไม่เป็นผลยุติคดี ก่อให้เกิดปัญหาช่องว่างแห่งกฎหมายตามพระราชบัญญัติองค์กรอัยการและพนักงาน อัยการและระเบียบสำนักงานอัยการสูงสุดในการใช้ดุลยพินิจสั่งฟ้องคดีของพนักงานอัยการมีทิศทาง แตกต่างกันและไม่มีมาตรฐานตามหลักสากล (2) ข้อเสนอแนวทางในการปรับปรุงแก้ไข คือ เสนอให้มีการแก้ไขเพิ่มเติมด้วยการกำหนดหลักเกณฑ์ในการสั่งคดีไม่ฟ้องคดีคดีอาญาที่ไม่เป็นประโยชน์แก่สาธารณชนโดยทั่วไป หลักเกณฑ์ในการสั่งคดีไม่ฟ้องคดีคดีอาญาที่ไม่เป็นประโยชน์ต่อสาธารณชนกรณีการไกล่เกลี่ยข้อพิพาททางอาญาในชั้นสอบสวนไม่เป็นผลยุติคดี และหลักเกณฑ์การกำหนดประเภทคดีแเละลักษณะของคดีในการสั่งไม่ฟ้องคดีอาญาที่ไม่เป็นประโยชน์ต่อสาธารณชนกรณีการไกล่เกลี่ยข้อพิพาททางอาญาในชั้นสอบสวนไม่เป็นผลยุติคดี
The objective of this independent study is to (1) study concepts, theories and principles relating to non-criminal prosecution order of the public prosecutor without public benefit, and (2) anlyze to find the appropriate guideline for noncriminal prosecution order to reduce the quantity of lawsuits to the court at maximum benefit. This independent study is a qualitative research using documentary research mthod from textbooks, laws, rules, relevant orders, dissertations, thesis, articles, academic papers, and data from internet network both in Thai language and English language. The data from those documents were collected and analyzed. The finding of the studying results (1) indicated that the positive law on noncriminal prosecution order of the public prosecutor without public benefit has covered none of the rule for general lawsuit order, lawsuit order in case of criminal conciliation in the inquiry stage not resulting in lawsuit discontinuance, and determination of lawsuit type and nature of lawsuit in criminal conciliation in inquiry stage not resulting in lawsuit discontinuance. The foregoing has caused the problem of legal loophole in accordance with Public Prosecution Organization and Public Prosecutors Act B.E. 2553 (2010), and Rule for the Office of the Attorney-General in exercise of the discretion in prosecution order of the public prosecutor in indifferent and no standard direction in accordance with international principle. (2) Therefore, the researcher has suggested the improvement and corrective guideline for amendment by determining the rule in general lawsuit order for non-criminal prosecution without public benefit, the rule in lawsuit order for noncriminal prosecution without public benefit in case of criminal conciliation in the inquiry stage not resulting in lawsuit discontinuance, and the rule in determination of lawsuit type and nature of lawsuit in non-criminal prosecution order without public benefit in case of criminal conciliation in inquiry stage not resulting in lawsuit discontinuance.
