Abstract
การศึกษาค้นคว้าอิสระเรื่อง ปัญหาการกำกับดูแลองค์กรปกครองส่วนท้องถิ่นในประเทศไทย มีวัตถุประสงค์เพื่อ (1) ศึกษาแนวคิดเกี่ยวกับการกระจายอำนาจทางปกครองให้แก่องค์กรปกครองส่วนท้องถิ่น ความหมาย ลักษณะและองค์ประกอบขององค์กรปกครองส่วนท้องถิ่นในฐานะองค์กรกระจายอำนาจทางพื้นที่ (2) ศึกษาแนวคิด ทฤษฎีและหลักการของการใช้อำนาจกำกับดูแลองค์กรปกครองส่วนท้องถิ่นและพัฒนาการของกฎหมายในประเทศไทย (3) ศึกษาและวิเคราะห์หลักความชอบด้วยกฎหมายและหลักความชอบด้วยรัฐธรรมนูญของการใช้อำนาจกำกับดูแลทางปกครอง และ (4) เสนอแนะแนวทางในการใช้อำนาจกำกับดูแลทางปกครองที่เห็นว่าจะมีความเหมาะสม สอดคล้องกับหลักการปกครองตนเอง การศึกษาค้นคว้าอิสระนี้ เป็นการวิจัยเชิงคุณภาพ โดยวิจัยจากเอกสารและศึกษาเปรียบเทียบการปกครองท้องถิ่นของประเทศที่มีรูปแบบของรัฐเป็นรัฐเดี่ยวและประสบผลสำเร็จอย่างสูงในการจัดการปกครองท้องถิ่น การจัดความสัมพันธ์เชิงอำนาจระหว่างองค์กรปกครองส่วนท้องถิ่นกับรัฐส่วนกลาง การใช้อำนาจกำกับดูแลที่ชอบด้วยกฎหมายเพื่อหาแนวทางในการประยุกต์ใช้ในการกำกับดูแลองค์กรปกครองส่วนท้องถิ่นในประเทศไทยให้เหมาะสมต่อไป ผลการศึกษาพบว่า ปัญหาของการกำกับดูแลเป็นปัญหาข้อกฎหมายที่มีสาเหตุจากการที่ไม่ได้มีการปรับปรุง เปลี่ยนแปลง หรือแก้ไขบทกฎหมายที่มีมาแต่เดิมก่อนที่จะมีการบัญญัติหลักการกำกับดูแลองค์กรปกครองส่วนท้องถิ่นไว้ในรัฐธรรมนูญให้สอดคล้องกับเจตนารมณ์ของรัฐธรรมนูญและหลักการกฎหมายปกครองหรือกฎมายมหาชนที่ก้าวหน้ามากขึ้น ปัญหาดังกล่าวเป็นอุปสรรคขัดขวางความริเริ่มในการจัดทำบริการสาธารณะในอำนาจหน้าที่ขององค์กรปกครองส่วนท้องถิ่นเป็นอย่างมาก จึงเสนอแนะแนวทางแก้ไขกฎหมายเกี่ยวกับการกำหนดหน้าที่ของรัฐส่วนกลางกับองค์กรปกครองส่วนท้องถิ่น การกำหนดมาตรฐานการกำกับดูแลที่มีความชัดเจน ขจัดความซํ้าซ้อนและกำหนดให้ศาลปกครองเป็นศาลที่มีเขตอำนาจในการพิจารณาวินิจฉัยความชอบด้วยกฎหมายของการกำกับดูแล
The objectives of this independent study on problems on supervising local administrative organizations in Thailand are (1) to study the concepts of decentralization for local administrative organizations, and meaning and characteristics of local administrative organizations as local decentralized agencies (2) to study the concepts, theories and principles of the supervision of local administrative organizations and development of the Thai laws (3) to study and analyze the principles of legality and constitutionality used on local government supervision, and (4) to give appropriate suggestions for supervision consistent with self-governance. This independent research is a qualitative study conducted based on documentary research and compare local administration of single countries with high success in local administration, relative management between local administration organizations and the central administration organization, use of legitimate supervising power to find proper ways to apply supervision of local administration organizations in Thailand. It was found that problems of supervising local administrative organizations are due to a lack of improvement, changes or corrections existing laws before enacting principles of supervising local administrative organizations in the Constitution, so they are consistent with the principles of the Constitution, administrative laws or advanced public laws. These problems are obstacles to initiating public services of local administrative organizations. It is suggested that ways to correct laws on duties of the central government and local administrative organizations and governance standards are clear and not redundant. In addition, the administrative court should have jurisdictions to consider legality of the supervision.
