Abstract
กการวิจัยครั้งนี้มีวัตถุประสงค์เพื่อ (1) ศึกษาแนวคิด ทฤษฎี และกฎหมายเกี่ยวกับวิธีพิจารณาคดีในระบบกล่าวหาและระบบไต่สวน (2) เปรียบเทียบกฎหมายที่เกี่ยวกับการพิจารณาคดีอาญาที่กล่าวหาว่าเด็กหรือเยาวชนกระทำความผิดตามกฎหมายของต่างประเทศ ได้แก่ ประเทศอังกฤษ สาธารณรัฐฝรั่งเศส ประเทศญี่ปุ่น สหพันธรัฐเยอรมนีและกฎหมายของไทย (3) วิเคราะห์เกี่ยวกับการนำระบบไต่สวนมาใช้ในการพิจารณาคดีอาญาที่กล่าวหาว่าเด็กหรือเยาวชนกระทำความผิดในศาลเยาวชนและครอบครัว (4) เสนอแนะแนวทางถึงความเหมาะสมเกี่ยวกับการนำระบบไต่สวนมาใช้ในการพิจารณาคดีอาญาที่กล่าวหาว่าเด็กหรือเยาวชนกระทำความผิด ตามพระราชบัญญัติศาลเยาวชนและครอบครัวและวิธีพิจารณาคตีเยาวชนและครอบครัว พ.ศ.2553 ผลการศึกษาพบว่า (1) วิธีพิจารณาคดีในระบบกล่าวหามีแนวคิดที่ถือว่าคู่ความมีฐานะในศาลที่เท่าเทียมกัน ศาลมีบทบาทในการค้นหาความจริงในคดีค่อนข้างน้อย โดยทำหน้าที่เป็นเพียงคนกลางเพื่อควบคุมให้การดำเนินคดีเป็นไปตามกฎหมาย ส่วนระบบไต่สวน ศาลมีบทบาทสำคัญในการค้นหาความจริงเพื่อให้ทราบข้อเท็จจริงที่เกิดขึ้นมากที่สุด และทฤษฎีเกี่ยวกับระบบการพิจารณาที่ศาลต้องใช้วิธีการพิจารณาคดีให้เหมาะสมกับประเภทคดีและสถานะของคู่ความเพื่อความเป็นธรรมตามหลักสิทธิมนุษยชน ซึ่งกฎหมายไทยมีบทบัญญัติให้ศาลมีอำนาจในการค้นหาความจริงแห่งคดีไว้อย่างกว้างขวางในประมวลกฎหมายวิธีพิจารณาความอาญา (2) การพิจารณาคดีอาญาที่กล่าวหาว่าเด็กหรือเยาวชนกระทำความผิดตามกฎหมายของสาธารณรัฐฝรั่งเศสและสหพันธรัฐเยอรมนีมีผู้พิพากษาไต่สวนทำหน้าที่ค้นหาความจริงในคดีได้ในทุกรูปแบบโดยอยู่ภายใต้หลักความเป็นอิสระของศาล กฎหมายของประเทศญี่ปุ่น ผู้พิพากษาทำหน้าที่สืบสวนและสืบเสาะก่อนที่จะมีคำพิพากษา ส่วนกฎหมายของประเทศอังกฤษและกฎหมายไทยผู้พิพากษาไม่มีบทบาทในการค้นหาความจริงแห่งคดีในชั้นก่อนพิจารณา (3) เมื่อวิเคราะห์ถึงกระบวนการพิจารณาคดี โดยส่วนใหญ่เด็กหรือเยาวชนที่ถูกดำเนินคดีจะขาดความรอบคอบหรือขาดประสบการณ์ในการพิจารณาหรือดำเนินการต่าง ๆ ทำให้ไม่รู้จักสิทธิของตนและไม่สามารถรักษาสิทธิของตนได้อย่างเต็มที่ และผู้พิพากษาซึ่งอาจไม่ได้ใช้อำนาจในการแสวงหาพยานหลักฐานได้อย่างที่กฎหมายให้อำนาจไว้เพราะติดขัดเรื่องประมวลจริยธรรมและความคุ้นชิน (4) การพิจารณาคดีโดยใช้ระบบไต่สวนให้ศาลได้มีบทบาทเชิงรุกในการแสวงหาพยานหลักฐานเพื่อให้ทราบสาเหตุแห่งการกระทำความผิดจึงเหมาะสมกับการนำมาใช้ในการพิจารณาคดีอาญาที่กล่าวหาว่าเด็กหรือเยาวชนกระทำความผิด ให้เด็กหรือเยาวชนที่เข้าสู่กระบวนการยุติธรรมได้รับการพิจารณาพิพากษาคดีหรือมีคำสั่งให้ตรงกับสภาพปัญหาและประเภทความผิดมากกว่ามุ่งให้ได้รับโทษทางอาญา
The objectives of this thesis are (1) to study ideas, theories and legislations that underlie both accusation and investigation systems; (2) to compare international, namely England, France, Japan and Germany, and Thailand laws and legislations applied to trial of criminal cases where the accused are youth or juveniles; (3) to analyse implementation of investigation systems in criminal cases where the accused are youth or juveniles in the Juvenile and Family Court and (4) to suggest appropriate ways to implement investigation systems for criminal cases where the accused are youth or juveniles according to the Juvenile and Family Court Act and Adjudication B.E 2553. This is qualitative research. Document analysis is the major research approach. Information was collected from laws and legislations, the Supreme Court’s rulings, articles, journals, publications, relevant research as well as textbooks and legal principles of foreign countries. Regarding research data analysis, the researcher synthesize and analyze qualitative data from the content of research, documentation and literature reviews., which will be used as a guideline for making recommendations on the appropriateness of the investigation system in the criminal case alleging children or youth committing crimes. Research outcomes show that (1) concept of the accusation system that considers that litigants are equal in status provides the court limited opportunities to find out the truth by itself. The Court can only act as a neutral party to make sure that all the adjudication process is legal. On the contrary, the investigation system, in which the court plays an important role in finding the most incurred fact and truth. Therefore, appropriate trial methods that meet requirements of case type and status of the litigants are important in order to procure fairness according to human rights principles. In Thailand, the court has the power to search extensively for the truth according to the Criminal Procedure Code. (2) In France, Germany and Japan, the adjudication process of criminal cases where the accused are youth or juveniles is led by a judge who can use his power independently in all forms to find the truth. In England and Thailand, however, the judge does not have the legislative power to do so. (3) Procecuted youth generally do not have experience to consider or act along the adjudication process appropriately. As a result, their legal rights would be in jeopardy. Moreover, the judge may not be able to fully use the power to seek evidence due to ethical and familiary issues. (4) The investigation system gives the court an opportunity to actively investigate and find causes of the offense. It is, therefore, suitable for the trial of criminal cases where the accused are youth or juveniles that aims to provide the appropriate solutions beyond just penalties.
