การรับฟังความคิดเห็นประกอบการวิเคราะห์ผลกระทบในการตรากฎหมาย

Abstract

การศึกษาค้นคว้าอิสระนี้มีวัตถุประสงค์เพื่อ (1) ศึกษาแนวคิดพื้นฐาน ความเป็นมา หลักเกณฑ์ เงื่อนไขการรับฟังความคิดเห็นในการตรากฎหมาย (2) ศึกษาแนวคิดพื้นฐาน ความเป็นมา หลักเกณฑ์ เงื่อนไขการเข้าชื่อเสนอกฎหมาย (3) เสนอแนะแนวทางเกี่ยวกับการรับฟังความคิดเห็นและการเสนอกฎหมายสำหรับประเทศไทย การศึกษาค้นคว้าอิสระเรื่องนี้เป็นการวิจัยเชิงคุณภาพ โดยการวิจัยเอกสาร จากตัวบทกฎหมาย ตำรา งานวิจัย บทความและเอกสารอื่นที่เกี่ยวข้อง ผลการศึกษา พบว่า (1) หน่วยงานของรัฐระดับกระทรวงหรือกรมควรมีหน้าที่โดยตรงในการจัดให้มีการรับฟังความคิดเห็นของประชาชนประกอบการจัดทำร่างกฎหมาย องค์กรในชั้นฝ่ายนิติบัญญัติ ควรแก้ไขเพิ่มเติมข้อบังคับการประชุมสภาผู้แทนราษฎรเพื่อให้มีการแต่งตั้งคณะกรรมการที่มีอำนาจพิจารณาร่างกฎหมายที่ต้องรับฟังความคิดเห็นในชั้นสภาผู้แทนราษฎร (2) สำนักงานคณะกรรมการกฤษฎีกาในฐานะเป็นหน่วยงานผู้ร่างกฎหมายหลัก ควรเป็นหน่วยงานหลักที่จัดทำกฎเกณฑ์หรือคู่มือการวิเคราะห์ผู้มีส่วนได้เสียในแต่ละร่างกฎหมาย ร่วมกับหน่วยงานรัฐเจ้าของร่างกฎหมายและสถาบันพระปกเกล้า และสำนักงานเลขาธิการสภาผู้แทนราษฎรควรเพิ่มช่องทางการประชาสัมพันธ์มากขึ้นเพื่อแก้ปัญหาการเข้าชื่อเสนอกฎหมายของประชาชนและการเชิญชวนผู้มีสิทธิเลือกตั้ง (3) สำนักงานเลขาธิการสภาผู้แทนราษฎรควรที่จะมีการอนุมัติอัตรากำลังของบุคลากรในกลุ่มงานนี้เพิ่มขึ้นและมีการพัฒนาระบบการจัดเก็บข้อมูลเชิญชวนให้มีการเข้าชื่อเสนอกฎหมายและการร่วมเข้าชื่อเสนอกฎหมายในกลุ่มคนพิการและผู้ด้อยโอกาส

This independent study aimed to (1) study concepts, history rules, and conditions of public consultation as part of regulatory impact analysis in drafting legislation. (2) study concepts history, rules, conditions of initiative proposal. (3) recommend solutions to improve the laws related to public participation in politics public consultation as part of regulatory impact analysis in drafting legislation and initiative proposal for Thailand. The independent study on this title is a qualitative research, whereas the documentary research was conducted from the articles of law, textbooks, researches, articles, and other related documents. The finding revealed that (1) Ministry or department should have a direct duty to manage the public consultation in the process of issuing a law. Legislative bodies should amend council meeting regulations in order to nominate board have the power to consider the drafted law that needed public consultation in the House of Representative level. (2) Office of the Council of State as main government sector should be main agency to issue the rule or create the manual analyzing the stakeholders in each law with the drafting government sector’s and the King Prajadhipok’ s Institute. And the House of Representative should increase channels of public relations to solve problem of initiative proposal for people and convince voters. (3) The House of Representative should increase advertise officers in Legislation Petition Division and develop a data storage system support disabilities and disadvantaged’s voters.
