Abstract
การค้นคว้าอิสระ เรื่องการดำเนินงานตามพระราชบัญญัติการอำนวยความสะดวกในการพิจารณาอนุญาตของทางราชการ พ.ศ. 2558 ศึกษาเฉพาะกรณีกระบวนการดำเนินงานระดับจังหวัด มีวัตถุประสงค์เพื่อศึกษาความเป็นมา วิวัฒนาการของแนวคิด นโยบาย วิธีการ การให้บริการประชาชนของภาครัฐ วิเคราะห์พระราชบัญญัติฉบับนี้ในฐานะที่เป็นกฎหมายมหาชน ที่มุ่งด้านการจัดระบบบริหารราชการในด้านการบริการประชาชน โดยพัฒนาระบบการบริการของรัฐ พิจารณาการปฏิบัติของส่วนราชการที่รับผิดชอบการปฏิบัติงานตามพระราชบัญญัติฉบับนี้ รวมทั้งเปรียบเทียบกับกฎหมายในลักษณะเดียวกันของประเทศสิงคโปร์และเขตบริหารพิเศษฮ่องกง ตลอดจนหาแนวทางปรับปรุง เสนอแนะการดำเนินงานตามพระราชบัญญัติการอำนวยความสะดวกในการพิจารณาอนุญาตของทางราชการ พ.ศ. 2558 และพัฒนากฎหมายเพื่อการบริการประชาชนของรัฐต่อไป การค้นคว้าอิสระนี้เป็นการวิจัยเชิงคุณภาพด้วยวิธีการวิจัยทางเอกสาร โดยศึกษาค้นคว้า รวบรวมข้อมูลจากตัวบทกฎหมาย ตำราวิชาการ วิทยานิพนธ์ บทความทางวิชาการจากเอกสาร นิตยสารทางกฎหมาย ตลอดจนข้อมูลจากเว็บไซต์ ทางเครือข่ายอินเตอร์เน็ต ซึ่งผู้ศึกษามั่นใจว่าข้อมูลที่ได้จากการค้นคว้าเป็นข้อมูลที่แท้จริงและถูกต้องน่าเชื่อถือได้ ผลการศึกษาพบว่าปัญหาการบริการของรัฐแต่เดิมนั้นมีความล่าช้า เนื่องจาก องค์กรภาคราชการเป็นองค์กรขนาดใหญ่ มีขั้นตอน กฎ ระเบียบ มีความสลับซับซ้อน มีกฎหมายที่จะต้องอนุญาตจากทางราชการเป็นจำนวนมาก และเมื่อพระราชบัญญัตินี้ได้มีการบังคับใช้ ทำให้การบริการของรัฐมีความรวดเร็วและมีประสิทธิภาพมากยิ่งขึ้น โดยมีการจัดทำคู่มือการปฏิบัติราชการ ขั้นตอนกระบวนการดำเนินงานต่าง ๆ ที่มีความชัดเจน และมีความโปร่งใสมากยิ่งขึ้น ผู้ศึกษาเสนอแนะแนวทางการพัฒนาการบริการและการลดการทุจริตคอร์รัปชั่นไว้ ดังนี้ พัฒนาระบบรัฐ อิเล็กทรอนิกส์(E-Goverment) ให้มีประสิทธิภาพอย่างแท้จริง ให้มีการสนับสนุนในการนำสื่ออิเล็กทรอนิกส์ใช้ในราชการอย่างกว้างขวางเช่น การยื่นแบบออนไลน์ การจัดซื้อจัดจ้างทำให้ลดความล่าช้า และการเรียกรับสินบน ปรับปรุงกฎหมายที่เป็นปัญหา อุปสรรคต่อการพัฒนาประเทศ โดยจัดตั้งคณะกรรมการขึ้นมา จำนวน ๑ ชุด เพื่อพิจารณาทบทวนกฎหมาย ตลอดจนเพิ่มอำนาจหน้าที่ขององค์กรตรวจสอบเกี่ยวกับการทุจริตประพฤติมิชอบในวงราชการให้มีอำนาจหน้าที่กว้างขวางขึ้น
The objectives of the independent study were to examine the evolution of background, concept,policy and practicing of public service by Thai bureaucracy and analysis of this Act as a public law as a field of public service. Considering the performance of a government responsible for the implementation of the Act. The comparison to a law of the same nature as of Singapore and Hong Kong SAR. Systematizing the processing improvement and suggestions for development of law for public services. The independent study is a qualitative research method conducted based on documentary research. The study Gather information from law textbooks academic thesis papers. Legal Magazine law journal As well as information from the website on the Internet, which ensures that the data from the research is true and accurate and reliable. The results of the study were as follows : bureaucratic red tape. Public sector organizations are large organizations with complex regulatory procedures, there are too much laws that must be authorized by the government. When this Act was enforced. There will improve efficiency in the delivery of government to the public by reducing bureaucratic red tape, preventing graft and corruption, and providing penalities. The government has prepared a practical guide. Step process that is clear and more transparent. The study has recommended the guidelines for Improving Service and Reducing Corruption corrupt as follow, development of Electronic Government (E-Government), reform and reduce outdated laws and red tape procedure. Increase the authority of the corporat audit.
