Abstract
การศึกษาค้นคว้านี้มีวัตถุประสงค์ในการศึกษาถึงปัญหาในทางกฎหมายของการประกอบธุรกิจท่องเที่ยวยังไม่เพียงพอต่อการสร้างมาตรฐานผู้ประกอบธุรกิจท่องเที่ยวและการคุ้มครองนักท่องเที่ยว รวมทั้งเสนอแนะมาตรการทางกฎหมายที่จะสร้างมาตรฐานให้กับผู้ประกอบธุรกิจท่องเที่ยว รวมทั้งมาตรการในการคุ้มครองนักท่องเที่ยวให้ได้รับความเป็นธรรมและบริการที่มีคุณภาพจากผู้ประกอบการ การศึกษาค้นคว้าอิสระในครั้งนี้ เป็นการวิจัยเชิงคุณภาพด้วยวิธีการวิจัยทางเอกสาร (Documentary Research) โดยการวิจัยทางกฎหมาย จะศึกษากฎหมายเกี่ยวกับการประกอบธุรกิจท่องเที่ยว กฎหมายการคุ้มครองผู้บริโภค กฎหมายรัฐธรรมนูญ โดยเฉพาะประเด็นปัญหาเกี่ยวกับการบังคับใช้กฎหมายของหน่วยงานที่เกี่ยวข้องกับการควบคุมการประกอบธุรกิจท่องเที่ยว อำนาจของเจ้าหน้าที่ในการดูแลมาตรฐานการประกอบธุรกิจท่องเที่ยว การเยียวยาความเสียหายให้กับนักท่องเที่ยว และบทลงโทษเกี่ยวกับการประกอบธุรกิจท่องเที่ยวที่ไม่เหมาะสม โดยศึกษาเปรียบเทียบกฎหมายควบคุมการประกอบธุรกิจของต่างประเทศ คือ ญี่ปุ่นและซึ่งถือเป็นประเทศที่มีชื่อเสียงในเรื่องการท่องเที่ยว
จากการศึกษาพบว่าการบังคับใช้กฎหมายเกี่ยวกับการประกอบธุรกิจท่องเที่ยวในประเทศไทยมีปัญหาข้อบกพร่องบางประการ จึงต้องมีการปรับปรุงแก้ไขกฎหมายใน 4 ประเด็นดังนี้ ประการแรกคือ การกำหนดให้มีการประสานงานการบังคับใช้กฎหมายของหน่วยงานที่เกี่ยวข้องกับการควบคุม การประกอบธุรกิจท่องเที่ยว ประการที่สองคือ กำหนดให้เจ้าหน้าที่มีอำนาจในการเข้าไปตรวจสอบมาตรฐานสถานประกอบการธุรกิจท่องเที่ยวและมีอำนาจกำหนดสัญญามาตรฐานธุรกิจการท่องเที่ยว ประการที่สามคือ กำหนดให้มีผู้แทนดำเนินคดีแทนนักท่องเที่ยวเพื่อเยียวยาความเสียหาย ประการที่สี่คือ เพิ่มประสิทธิภาพบทลงโทษในการเพิกถอนหรือพักการใช้ใบอนุญาตการประกอบธุรกิจท่องเที่ยวให้ดีขึ้น เพื่อทำให้นักท่องเที่ยวได้รับบริการที่มีมาตรฐานและเป็นธรรม โดยนำแนวทางการการปรับปรุงแก้ไขจากกฎหมายเกี่ยวกับการควบคุมการประกอบธุรกิจของต่างประเทศ คือญี่ปุ่นและฝรั่งเศส เป็นกรณีศึกษา
The purposes of this independent study are to study the legal problems of tourism business that is not sufficient to create a tourism business’s standard, protect the tourists, and gives suggestions to make amendment to the laws with aims to create a standard model for tourism entrepreneur and measures to assure that the tourists will have good services from entrepreneurs. This independent study is approached by the qualitative research conducted based on documentary research through tourism business, the constitution of Kingdom of Thailand, B.E. 2550 especially on the problems of law enforcement from related organization who has a duty on controlling tourism business, influence the tourism business’s standard, ameliorate the damage of tourists and give punishment to improperly tourism business. This study compares the laws related to legal of tourism business in some foreign country such as Japan and France. By the way Japan is the most famous destination for travelling. The study laws related to the results shows that the law enforcement of tourist business in Thailand has some problems. The law must be improved in these 4 respects. The first is specifying and operating with the related organization to control the tourism business. The second is specifying the officer to monitor the tourism entrepreneur business and prescribe the standard agreement. The third is providing legal representative to the tourists in ameliorating the damages. The last is to enhance the penalty to revocation or to suspend a tourism business license that would be beneficial to the tourist who will receive good services with standard and fair. The case study and law guidelines are from the laws related to controlling of tourism business in Japan and France.
