Abstract
การศึกษาค้นคว้าอิสระนี้มีวัตถุประสงค์เพื่อศึกษาแนวทางการแบ่งส่วนความรับผิดทางละเมิดของเจ้าหน้าที่องค์กรปกครองส่วนท้องถิ่น เพื่อเสนอแนวทางพัฒนากฎหมายระเบียบ วิธีปฏิบัติที่ถูกต้อง และเสนอแนวทางแก้ไขปัญหาที่เหมาะสมในการกำหนดสัดส่วนความรับผิดทางละเมิดเจ้าหน้าที่ของรัฐให้ถูกต้องเหมาะสมและเป็นธรรม การศึกษาค้นคว้าอิสระนี้เป็นการวิจัยเชิงคุณภาพ ด้วยวิธีวิจัยเอกสารโดยศึกษาจากคำสั่งศาลปกครองสูงสุด แนวคำวินิจฉัยคณะกรรมการต่าง ๆ และเอกสารในประเทศไทย และต่างประเทศที่เกี่ยวข้องกับพระราชบัญญัติความรับผิดทางละเมิดของเจ้าหน้าที่ พ.ศ. 2539 ตลอดจนระเบียบ แนวทาง หนังสือสั่งการของทางราชการที่เกี่ยวข้องกับการแบ่งส่วนความรับผิดทางละเมิดของเจ้าหน้าที่ของรัฐ ผลการศึกษาพบว่า ปัจจัยและตัวแปรที่ศาลนามากำหนดสัดส่วนความรับผิดทางละเมิดของเจ้าหน้าที่องค์กรปกครองส่วนท้องถิ่น ได้แก่ พฤติการณ์และวิสัยของเจ้าหน้าที่ผู้กระทำละเมิด ระดับความร้ายแรงแห่งการ กระทำ โดยหน่วยงานของรัฐไม่จำต้องได้รับชดใช้ค่าสินไหมทดแทนเต็มจำนวนความเสียหาย และการมีส่วนก่อให้เกิดความเสียหายของหน่วยงานรัฐ ตลอดจนความแน่นอนของความเสียหายและมูลค่าทรัพย์ที่แท้จริงในขณะกระทำละเมิด จากการศึกษายังพบว่า การแบ่งส่วนความรับผิดทางละเมิดของเจ้าหน้าที่เพื่อกำหนดจำนวนค่าสินไหมทดแทนที่เจ้าหน้าที่แต่ละคนต้องชดใช้ เป็นเรื่องของดุลพินิจ ซึ่งยังมีความแตกต่างกันในการใช้ดุลพินิจของแต่ละหน่วยงานมิได้เป็นไปในทิศทางเดียวกัน และพบว่าคำสั่งให้ชดใช้ค่าสินไหมทดแทนที่ยังไม่ผ่านการพิจารณาของกระทรวงการคลังเป็นคำสั่งที่ยังไม่มีความชัดเจนแน่นอน ไม่ถูกต้องตามเงื่อนไขเกี่ยวกับเนื้อความของคำสั่งทางปกครอง ทำให้การพิจารณาอุทธรณ์ตามกฎหมายวิธีปฏิบัติราชการทางปกครองเป็นการสร้างขั้นตอนที่ไม่มีความจำเป็น จึงควรกำหนดระยะเวลาในการพิจารณาให้มีความชัดเจน และกำหนดขั้นตอนการอุทธรณ์การแบ่งส่วนความรับผิดไว้โดยเฉพาะ เพื่อลดความล่าช้าในการดำเนินการและให้ความยุติธรรมแก่เจ้าหน้าที่ให้มากที่สุด
The objective of this independent study is to study the guideline of tort liability proportion of local administrative organization officials to present the guideline of development of proper laws, regulations and procedures, and propose the guideline of appropriate solution in determining the appropriate and fair tort liability ratio of the government officials. This independent study is the qualitative research using document research method. The orders of the Supreme Administrative Court, decision guideline of the committees and documents in Thailand and foreign countries related to Liability for Wrongful Act of Officials Act B.E. 2539 (1996) as well as regulations, guidelines, and letters of the official command related to tort liability proportion of local administrative organization officials. The findings indicated that factors and variables used by the Court to determine tort liability ratio of the government officials were circumstance and capacity of the officials who are the tort-feasors, and level of gravity of act. It was unnecessary for the government agencies to reimburse the whole amount of compensation for damage, participation of the government agencies in damnification, and certainty of damage and actual property value at the time of tort. The findings also indicated that tort liability proportion of the officials for determining the compensation amount required for reimbursement by each officer was the matter of discretion. The exercise of discretion by each agency was different and not in the same direction. The order for reimbursement of compensation which has not yet been passed for consideration of the Ministry of Finance was ambiguous and improper in accordance with the condition related to the content of the administrative order, resulting in establishment of unnecessary procedures in appeal consideration pursuant to administrative procedure. Therefore, the consideration duration should be clearly specified and the appeal procedure of liability proportion should be particularly determined to reduce operating delay and administer justice to the officials as much as possible.
