การยกเลิกโทษประหารชีวิตในคดียาเสพติด

Abstract

การค้นคว้าอิสระนี้มีวัตถุประสงค์เพื่อศึกษาหลักการ แนวคิด ทฤษฎีและกฎหมาย ที่เกี่ยวกับการลงโทษประหารชีวิตในคดียาเสพติด เพื่อศึกษามาตรการการลงโทษที่ใช้แทนโทษประหารชีวิตในคดียาเสพติดของประเทศสหรัฐอเมริกา และเพื่อปรับปรุงแก้ไขกฎหมายเกี่ยวกับยาเสพติดให้สอดคล้องกับกติการะหว่างประเทศว่าด้วยสิทธิพลเมืองและสิทธิทางการเมือง การค้นคว้าอิสระนี้เป็นการวิจัยเชิงคุณภาพด้วยวิธีการวิจัยทางเอกสารจากตํารา หนังสือ สารนิพนธ์ วิทยานิพนธ์ เอกสารทางวิชาการ บทความ วารสาร ตัวบทกฎหมาย คําพิพากษา ของศาล ข้อมูลจากสื่ออิเล็กทรอนิกส์ และเอกสารอื่นที่เกี่ยวข้อง ผลการศึกษาพบว่า โทษประหารชีวิตสําหรับความผิดเกี่ยวกับยาเสพติดเป็นการละเมิดกฎหมายสิทธิมนุษยชนระหว่างประเทศ ตามกติการะหว่างประเทศว่าด้วยสิทธิพลเมืองและสิทธิทางการเมืองข้อ 6 ที่กำหนดให้ใช้โทษประหารเฉพาะความผิดร้ายแรงสุดเท่านั้น เช่น ความผิด เกี่ยวกับการฆ่าคนตายโดยเจตนา ซึ่งความผิดเกี่ยวกับยาเสพติดไม่เข้าหลักเกณฑ์ของความผิดร้ายแรงที่สุด ที่จะกำหนดให้ผู้กระทําผิดเกี่ยวกับยาเสพติดต้องรับโทษประหารชีวิต ดังนั้น ผู้วิจัยจึง เสนอให้นําหลักการลงโทษให้เหมาะสมกับตัวบุคคลมาใช้ในคดีเกี่ยวกับยาเสพติดและเสนอให้ยกเลิกโทษประหารชีวิตในคดียาเสพติดตามที่บัญญัติไว้ในกฎหมายไทย ทั้งนี้ เพื่อสอดคล้องกับกติการะหว่างประเทศว่าด้วยสิทธิพลเมืองและสิทธิทางการเมือง ข้อ 6

The purpose of this independent study is to study about the principles, concepts and the laws relating to the death penalty in the narcotic cases in order to research about the punishment measure for the capital punishment in the drug cases in the United States and to amend the law relevant to narcotics in consistency with the International Covenant on Civil and Political Rights. This independent study is the qualitative research by means of the documentary research from textbooks, books, independent researches, theses, academic papers, articles, journals, and the provision of laws, judgments, electronic data and the relating papers. Result of the research: the death penalty for the narcotics offense violates the international laws regarding human rights which is article 6 of the International Covenant on Civil and Political Rights (ICCPR), which provides that the capital punishment could be applied only in severe case such as willful murder. The narcotics offense does not interpret as severe offense so the capital punishment cannot apply for the narcotics offense. Therefore, the researcher suggests applying the appropriate punishment in the narcotics cases and abolishing the death penalty in the narcotics cases. This will result in harmonization Thai laws with article 6 of the International Covenant on Civil and Political Rights.
