Abstract
งานวิจัยเรื่องการคุ้มครองภูมิปัญญาการนวดไทย มีวัตถุประสงค์ในการศึกษา (1) ลักษณะหลักการแห่งสิทธิและแนวทางในการคุ้มครองภูมิปัญญาการนวดไทย (2) เพื่อวิเคราะห์ความตกลงระหว่างประเทศ กฎหมายของประเทศไทย ประเทศจีน อินเดีย และฟิลิปปินส์ในการคุ้มครององค์ความรู้ดั้งเดิม และภูมิปัญญาการนวด (3) เพื่อนำผลการวิเคราะห์มากำหนดเป็นองค์ความรู้ใหม่ และเป็นแนวทางในการพัฒนาระบบการบริหารจัดการเกี่ยวกับภูมิปัญญาดั้งเดิมของไทย และการพัฒนากฎหมายเพื่อคุ้มครองภูมิปัญญาการนวดไทย งานวิจัยเรื่องนี้เป็นการวิจัยทางกฎหมาย โดยการวิจัยเชิงคุณภาพ ด้วยการวิจัยทางเอกสารเกี่ยวกับการคุ้มครองภูมิปัญญาดั้งเดิม และภูมิปัญญาการนวดของไทย และของต่างประเทศโดยศึกษาค้นคว้ารวบรวม ข้อมูลจากหนังสือ ตำรา บทความ วิทยานิพนธ์เอกสารที่เกี่ยวข้องและข้อมูลทางอินเทอร์เน็ต ผลการศึกษาพบว่า ในปัจจุบันมีการเจรจาในเวทีระดับนานาชาติ รวมถึงองค์การทรัพย์สินทางปัญญาโลก (WIPO) และองค์การค้าโลก (WTO) เพื่อหารือในประเด็นของการให้คุ้มครององค์ความรู้ดั้งเดิม ซึ่งประเทศกำลังพัฒนา จำเป็นต้องหากลไกลทางกฎหมายที่เหมาะสมในการคุ้มครององค์ความรู้ดั้งเดิมของตนเอง ระบอบสิทธิในทรัพย์สินทางปัญญาปัจจุบันหรือระบบกฎหมายเฉพาะ สำหรับความเหมาะสมในการคุ้มครององค์ความรู้ดั้งเดิม ยังคงเป็นประเด็นถกเถียงและยังไม่ยุติ แต่เป็นที่การยอมรับกันโดยทั่วไปว่าระบอบสิทธิในทรัพย์สินทางปัญญา ไม่เพียงพอต่อการคุ้มครองสิทธิในองค์ความรู้ดั้งเดิมได้อย่างครอบคลุม ประเทศไทย ประเทศสาธารณรัฐประชาชนจีน ประเทศอินเดีย และประเทศฟิลิปปินส์ ไม่มีกฎหมายเฉพาะ (sui generis) หรือความตกลงระหว่างประเทศในการคุ้มครององค์ความรู้ดั้งเดิม ปัจจุบันประเทศไทยไม่มีกฎหมายคุ้มครอง ภูมิปัญญาการนวดไทยเป็นการเฉพาะ ดังนั้นผู้วิจัยจึงเสนอให้มีกฎหมายคุ้มครองภูมิปัญญาการนวดไทย โดย การเสนอให้ (1) ขยายการคุ้มครองพระราชบัญญัติคุ้มครองสิ่งบ่งชี้ทางภูมิศาสตร์ พ.ศ. 2546 ให้คุ้มครองการ นวดไทย (2) เแก้ไขเพิ่มเติมพระราชบัญญัติคุ้มครอง และส่งเสริมภูมิปัญญาการแพทย์แผนไทย พ.ศ. 2542 (3) จัดทำร่างพระราชบัญญัติการนวดไทย
The purposes of this thesis are to 1) acknowledge characteristic principle of rights and the pathway relating to protection of “Thai Massage Wisdom” 2) analyze international agreement and Thai , Chinese, Indian, and Philippine laws relating to protection of TK and massage wisdom, and 3) use analytical result as guideline in developing administration system relating to TK and development of laws for protection of Thai traditional massage wisdom.The research is a qualitative research. Conducted based on documentary research. The researcher has analyzed the documents , textbooks , reference books, articles, thesis, that are related to the protection of TK and traditional massage in Thailand and foreign countries as well as searching for the information from the internet. The research found that the protection of TK was under discussion in several international forums, including WIPO and WTO. In this regard, developing countries had to find the appropriate legal mechanisms for the protection of their own TK. There appeared to be some disagreement on how best to protect TK, using the existing intellectual property right system or a sui generis system but it was widely recognized that the prevailing intellectual property right regime was not sufficient in order to protect TK. Thailand, Republic of China, India and the Philippines had no specific laws (sui generis) or binding international legal instruments for the protection of their TK. At present, Thailand has no specific law for protecting TK. This thesis therefore, has certain suggestion as the followings: 1) to extend the Geographical Indications Protection Act B.E. 2546 to protect “Thai Massage Wisdom”; 2) to propose amendments to the Protection and Promotion of Traditional Thai Medicinal Intelligence Act, B.E. 2542; 3) and to propose drafting specific law for the protection of Thai massage wisdom.
