กระบวนการยุติธรรมเชิงสมานฉันท์ในคดีอาญาชั้นพนักงานสอบสวน

Abstract

การวิจัยครั้งนี้มีวัตถุประสงค์เพื่อศึกษา 1) แนวคิดและทฤษฎีที่เกี่ยวกับกระบวนการยุติธรรมเชิงสมานฉันท์ 2) ศึกษากระบวนการยุติธรรมเชิงสมานฉันท์ในคดีอาญาชั้นพนักงานสอบสวนทั้งของไทยและต่างประเทศ 3) วิเคราะห์ปัญหาและเปรียบเทียบกระบวนการยุติธรรมเชิงสมานฉันท์ในคดีอาญาชั้นพนักงานสอบสวนทั้งของไทยและต่างประเทศ 4) เสนอแนะทั้งหลักเกณฑ์หรือแนวทางกระบวนการยุติธรรมเชิงสมานฉันท์ในคดีอาญาชั้นพนักงานสอบสวน การวิจัยเชิงคุณภาพ โดยการวิจัยเอกสารจากตัวบทกฏหมาย หนังสือทางวิชาการ วิทยานิพนธ์ งานวิจัย บทความทางกฏหมาย รวมทั้งข้อมูลทางสื่ออิเล็กทรอนิกส์ทั้งของไทยและต่างประเทศ และเอกสารอื่นที่เกี่ยวข้อง ผลการวิจัย 1) แนวคิดและทฤษฎีที่เกี่ยวกับกระบวนการยุติธรรมเชิงสมานฉันท์มีเจตนารมณ์ให้ผู้เสียหายกับผู้กระทำความผิดได้มีโอกาสไกลเกลี่ยทำความเข้าใจซึ่งกันและกัน 2) โดยมีกระบวนการที่ส่งผลให้ผู้เสียหายได้รับการเยี่ยวยาและชดใช้ค่าเสียหายได้รวดเร็วทันที ผู้กระทำความผิดจะสำนึกผิดและยอมปรับเปลี่ยนพฤติกรรม ทำให้ความสัมพันธ์ของทั้งสองฝ่ายเป็นไปในทางที่ดีขึ้น 3) การระงับข้อพิพาทในคดีอาญาชั้นพนักงานสอบสวนทั้งของไทยเป็นการนำลักษณะของกระบวนการมาใช้บางประเภทอย่างไม่เป็นทางการ มีวิธีการ รูปแบบ และผลการดำเนินการแตกต่างกันไป ยังมีประสิทธิภาพไม่เพียงพอ ไม่มีหลักเกณฑ์หรือแนวทางรองรับ 4) ข้อเสนอแนะให้มีหลักเกณฑ์หรือแนวทางสำหรับการดำเนินกระบวนการยุติธรรมเชิงสมานฉันท์ในคดีอาญาชั้นพนักงานสอบสวนของไทย เพื่อเป็นการแก้ไขปัญหาและเสริมให้กระบวนการยุติธรรมชองไทยมีประสิทธิภาพมากขึ้น

The objective of this independent study is ( 1) to study the theory of the restorative justice process; (2) to study restorative justice in criminal prosecution at the investigation level in Thailand and foreign countries; ( 3) to analyze and compare between the problems of restorative justice process in criminal prosecution at the investigation level in Thailand and those in the foreign countries; and (4) to propose a recommendation on restorative justice in criminal prosecution at the investigation level. This independent study is a qualitative research by the method of documentary research. There are numerous documents including positive laws, academic textbooks, theses, research, law journals, including information through electronic media both in Thailand and foreign countries, and other related documents. The study found that (1) the concept of restorative justice intends to provide an opportunity of reconcilement to the victim and the offender. ( 2) The process of restorative justice initiates that the victims are rapidly and promptly cured and compensated; the offenders also feel repent and change their behaviors. This helps improve their mutual relations. (3) Dispute resolution in some criminal prosecutions at the investigation level of Thailand has unofficially adopted the process of the restorative justice by different methods, styles, and results. However, there are still some problems and not efficiency due to no rule or model supported for this issue. The researcher has analysed and compared between the problems of restorative justice process in criminal prosecution at the investigation level both in Thailand and in foreign countries. and ( 4) Thus, the researcher suggests that there should be regulations or guidelines for the restorative justice in criminal prosecution at the investigation level.
