Abstract
การศึกษาค้นคว้าอิสระนี้มีวัตถุประสงค์เพื่อ (1) ศึกษาวิวัฒนาการ แนวคิด ทฤษฎีเกี่ยวกับการทำการุณยฆาต (2) ศึกษาหลักกฎหมายต่างๆ ที่เกี่ยวข้องกับการทำการุณฆาตของประเทศไทยและราชอาณาจักรเนเธอร์แลนด์ (3) วิเคราะห์ปัญหาเกี่ยวกับการทำการุณยฆาต (4) เสนอแนะแนวทางการกำหนดกฎหมายเกี่ยวกับการุณยฆาตของไทยต่อไปการศึกษาค้นคว้าอิสระนี้เป็นการวิจัยเชิงคุณภาพ ด้วยวิธีการวิจัยทางเอกสารโดยการรวบรวมข้อมูล จากตัวบทกฎหมาย หนังสือ บทความทางวิชาการ ผลงานการวิจัย วิทยานิพนธ์ คำพิพากษาศาลฎีกา ข้อมูลสารสนเทศที่เกี่ยวข้อง รวมทั้งทำการสัมภาษณ์นายแพทย์ผู้ทรงคุณวุฒิ เพื่อประกอบการวิเคราะห์ปัญหาเกี่ยวกับการทำการุณยฆาต ผลการศึกษาพบว่า (1) วิวัฒนาการของการทำการุณยฆาตมีมาตั้งแต่สมัยโบราณ ในสมัยกรีกโบราณมีการปฏิบัติเกี่ยวกับการุณยฆาต สําหรับชาวโรมันการอัตวินิบาตกรรมเป็นสิ่งที่กฎหมายอนุญาตโดยส่วนใหญ่ จนกระทั่งในปัจจุบันมีหลายประเทศทั่วโลกออกกฎหมายให้การทำการุณยฆาตสามารถทำได้ภายใต้การกำกับดูแลโดยแพทย์ผู้เชี่ยวชาญ และผ่านกระบวนการทางกฎหมายอย่างรัดกุม แนวคิดเกี่ยวกับความตายตามสํานักประโยชน์นิยมมีทัศนะว่าควรเลือกกระทำการที่มีประโยชน์มากกว่าโทษ ทฤษฎีความรับผิดทางอาญาที่ต้องพิจารณาการกระทำประกอบกับเจตนาภายในจิตใจของผู้กระทำด้วย (2) กฎหมายเกี่ยวกับการทำการุณฆาตของประเทศไทยนั้น มีเฉพาะการทำการุณยฆาตเชิงรับเท่านั้น แตกต่างกับกฎหมายของราชอาณาจักรเนเธอร์แลนด์ที่มีทั้งการทำการุณยฆาตเชิงรุก เชิงรับ และเชิงสงบ (3) ปัญหาทางกฎหมายเกี่ยวกับการทำการุณยฆาต คือกฎหมายไทยยังไม่รองรับให้มีการทำการุณยฆาตเชิงรุกและเชิงสงบได้ (4) ควรแก้ไขเพิ่มเติมพระราชบัญญัติสุขภาพแห่งชาติ พ.ศ. 2550 มาตรา 12 วรรคหนึ่งตอนท้าย ให้เปิดช่องทางการทำการุณยฆาตได้ทั้งเชิงรุก เชิงรับ และเชิงสงบ โดยสามารถลงมือกระทำได้ทั้งผู้ป่วยเอง หรือ แพทย์ที่เกี่ยวข้อง เพิ่มเติมมาตรา 12/1 - 12/2 เรื่องขอบเขตการบังคับใช้กฎหมายการุณยฆาต โดยระบุโรคและอายุของผู้ที่มีสิทธิทำการรุณยฆาตไว้อย่างละเอียด แก้ไขเพิ่มเติมมาตรา 12/3 - 12/5 เรื่องความรับผิดของแพทย์และผู้ที่เกี่ยวข้อง และเพิ่มเติมมาตรา 12/6 ให้การุณยฆาตไม่ถือว่าเป็นการอัตวินิบาตกรรม เพื่อให้บริษัทประกันไม่อาจปัดความรับผิดในประกันชีวิตที่คุ้มครองโรคเรื้อรังเฉพาะได้
The objectives of this independent study are to: 1) study the evolution, concepts, and theories regarding euthanasia; 2) study various legal principles related to euthanasia in Thailand and the Netherlands; 3) analyze problems related to euthanasia; and 4) suggest guidelines for further formulating the euthanasia law in Thailand.This independent study is qualitative research and documentary research. Data were collected from legal texts, books, academic articles, research work, theses, Supreme Court judgments, related information, and interviews qualified doctors to analyze problems related to euthanasia.The results of the study are as follows. (1) The evolution of euthanasia has been going on since ancient times. In ancient Greece, euthanasia was practiced. For Romans, suicide was in most cases permissible by law. Until now, many countries around the world have enacted laws that allow euthanasia to be performed under the supervision of a medical professional and through a strict legal process. The concept of death according to the utilitarian school is that one should choose actions that are more beneficial than harmful. The theory of criminal responsibility must consider the act together with the intent within the mind of the perpetrator. (2) The euthanasia law in Thailand includes only passive euthanasia, which is different from those in the Netherlands that include active, passive and peaceful euthanasia. (3) A legal problem regarding euthanasia in Thailand is that Thai laws still do not support proactive and peaceful euthanasia. (4) The National Health Act of 2007, Section 12, paragraph one at the end, should be amended. Channels for proactive, reactive, and peaceful euthanasia should be opened. Both the patient and the doctor involved should be able to commit euthanasia. Sections 12/1 - 12/2 regarding the scope of enforcement of the euthanasia law should be added so the disease and age of those eligible for euthanasia are specified in detail. Sections 12/3 - 12/5 regarding the liability of doctors and related persons should be added. Section 12/6 providing that euthanasia is not considered suicide should be added so that insurance companies cannot waive liability for life insurance that covers specific chronic diseases.
