ระบบการเลือกตั้งสมาชิกสภาผู้แทนราษฎรแบบแบ่งเขตเลือกตั้งตามรัฐธรรมนูญแห่งราชอาณาจักรไทย พุทธศักราช 2560

Abstract

การศึกษาค้นคว้าอิสระนี้ มีวัตถุประสงค์เพื่อศึกษาความเป็นมา แนวคิด ทฤษฎี ที่เกี่ยวข้องกับการเลือกตั้ง และระบบการเลือกตั้ง เพื่อศึกษาระบบการเลือกตั้งสมาชิกสภาผู้แทนราษฎรของประเทศไทยและต่างประเทศ เพื่อเปรียบเทียบระบบการเลือกตั้งสมาชิกสภาผู้แทนราษฎรประเทศไทยเปรียบเทียบกับต่างประเทศ เพื่อเสนอแนะแนวทางและระบบการเลือกตั้งที่เหมาะสมสอดคล้องกับประเทศไทยในสถานการณ์ปัจจุบัน การศึกษาค้นคว้าอิสระนี้เป็นการวิจัยเชิงคุณภาพด้วยวิธีการวิจัยทางเอกสาร โดยศึกษาค้นคว้าจากตำราหนังสือทั้งของประเทศไทยและต่างประเทศ ตลอดจนศึกษาข้อมูลจากสื่อสารสนเทศ บทบัญญัติของกฎหมาย คำพิพากษาฎีกา วิทยานิพนธ์ งานวิจัย เอกสารและข้อมูลที่เกี่ยวข้อง รวมทั้งกฎหมายต่างประเทศที่เกี่ยวข้อง ผลการศึกษาพบว่า ประเทศเยอรมันนีและประเทศญี่ปุ่น การเลือกตั้งสมาชิกสภาผู้แทนราษฎรแบบแบ่งเขตเลือกตั้งและแบบบัญชีรายชื่อมีการใช้บัตรเลือกตั้งสองใบ ประเทศญี่ปุ่นผู้สมัครรับเลือกตั้งสามารถสมัครได้ทั้งแบบแบ่งเขตการเลือกตั้งและแบบบัญชีรายชื่อ ประเทศเยอรมันนีมีจำนวนสัดส่วนสมาชิกสภาผู้แทนราษฎรจำนวนเท่ากัน ดังนั้น ผู้วิจัยจึงได้มีการเสนอให้มีการกำหนดให้มีการใช้บัตรเลือกตั้งสองใบเพื่อใช้ในการเลือกตั้งสมาชิกสภาผู้แทนราษฎรแต่ละประเภท เสนอให้ผู้ที่ได้รับการเลือกตั้งแบบแบ่งเขตเลือกตั้ง คือผู้ที่ได้รับคะแนนสูงสุดในเขตเลือกตั้งนั้น

The results showed that in Germany and Japan, the House of Representative members were elected on a constituency basis and with a list of candidates using two ballots. In Japan, candidates can apply for both on a constituency basis and with a list of candidates. In Germany, the proportion of the House of Representatives members elected by both methods was equal. Therefore, the researcher proposes that Two ballots should be used in the election of the House of Representatives members of each method. The candidate elected on a constituency basis should be the one with the highest score in that particular electorate.
