Abstract
การศึกษาค้นคว้าอิสระนี้มีวัตถุประสงค์เพื่อศึกษาถึงแนวความคิด ทฤษฎีความสำคัญของการ ให้ข้อมูลคดียาเสพติดที่เป็นข้อมูลสำคัญและเป็นประโยชน์ในส่วนที่เกี่ยวข้องกับการลงโทษจำเลยน้อยกว่า ที่กฏหมายกำหนดไว้ เพื่อศึกษาปัญหาและเสนอแนะแนวทางการพิจารณาและการแก้ไขเพิ่มเติม ปรับปรุงเกี่ยวกับการให้ข้อมูลและเป็นประโยชน์อย่างยิ่งในการปราบปรามผู้กระทำความผิดในคดียาเสพติด เป็นการคุ้มครองสิทธิของผู้ต้องหาและจำเลยตามเจตนารมณ์ของกฎหมาย ซึ่งมีความสำคัญในการปราบปราม และความมั่นคงของประเทศ การศึกษาค้นคว้าอิสระนี้เป็นการวิจัยเชิงคุณภาพ ด้วยวิธีการวิจัยเอกสาร โดยใช้วิธีการศึกษาจากเอกสารประกอบด้วยเอกสารที่เกี่ยวข้องของวิชาการตำราหนังสือบทความ รายงานการวิจัย รายงานวิชาการต่างๆสื่ออิเล็กทรอนิกส์ วิทยานิพนธ์ สารนิพนธ์ บทบัญญัติกฎหมายที่เกี่ยวข้อง ไม่ว่าจะเป็นตัวบทกฎหมายของประเทศไทยและต่างประเทศ เพื่อนำมาวิเคราะห์สังเคราะห์ ข้อมูลเพื่อนำสู่ผลการวิจัย ผลการศึกษาพบว่า การบังคับใช้บทบัญญัติกฎหมายมาตรา 100/2 แห่งพระราชบัญญัติ ยาเสพติดให้โทษ ยังมิได้มีแนวทางหรือกรอบกำหนดที่ชัดเจนเพื่อเป็นมาตราฐานเดียวกันในการพิจารณาเพื่อรับเอาข้อเท็จจริงที่จำเลยอ้างอิงขึ้น ให้จำเลยได้รับประโยชน์ในการพิจารณาโทษที่ลงน้อยกว่า ที่กฎหมายกำหนดไว้ คงมีแนววินิจฉัยของศาลฏีกาที่วางหลักเกณฑ์เบื้องต้นในการพิจารณาโทษที่จะวางแก่จำเลย โดยยังไม่เป็นไปตามเจตนารมณ์ตามบทบัญญัติของกฎหมายดังกล่าวนี้ ดังนั้น จึงสมควรปรับปรุงแก้ไขการดำเนินตามบทบัญญัติมาตรา 100/2 แห่งพระราชบัญญัติยาเสพติดให้โทษ พ.ศ. 2522 ให้มีการเพิ่มเติมข้อความกฎหมายให้ชัดเจนเรื่องระยะเวลาการให้ข้อมูลสำคัญและเป็นประโยชน์ และผลการขยายผลการจับกุม ซึ่งไม่ได้ให้ประโยชน์เฉพาะแก่จำเลยซึ่งเป็นผู้กระทำผิดเท่านั้น แต่ทว่า ให้ประโยชน์แก่เจ้าหน้าที่ของรัฐในการควบคุม และปราบปรามการกระทำความผิดเกี่ยวกับยาเสพติดไม่ให้แพร่กระจายเข้าสู่สังคม หรือเป็นการตัดวงจรของกลุ่มที่มุ่งจะกระทำความผิดเกี่ยวกับยาเสพติด ให้ลดน้อยลงไปหรือหมดไป อันส่งผลให้เกิดความปลอดภัยและความมั่งคงแก่ประเทศสืบไป
The purpose of this independent study is to study about the concepts, theories relating to the importance of significant and useful narcotics case information providing in the part of the accused’s punishment less than the law prescribed in order to study the problems and suggest the guideline relating to the examination and the amendment of the useful information providing in the narcotic offenders suppression as well as to protect the alleged offender and the accused according to the spirit of the law which is essential in the suppression and the national security. This independent study is the qualitative research by means of the documentary research consisting of the relating academic papers, textbooks, articles, researches, academic reports, electronic media, theses, the independent researches, the relevant laws both in Thai and foreign languages in order to analyze and synthesize the information into the result of the research. Result of the research: about the law enforcement of section 100/2 of the Narcotics Act, there is no guideline or the clear scope in the same standard in considering adopting the facts the accused claimed in order to gain the benefit in punishment less than the law prescribed. There are only the precedents of the Supreme Court prescribing preliminarily of the accused’s punishment which are not in line with the spirit of this provision of laws. Therefore, the researcher suggests amending the section 100/2 of the Narcotics Act B.E. 2522 by adding the law about the significant and useful information providing period and the arresting results extended which are not advantageous only to the accused but also to the authorities in the regulation and the suppression of the narcotics offense, for the purpose of the dissemination of drugs’ obstruction or to cut the cycles of the prone to be the narcotic offender into the small amounts or wholly get rid, then result in the safety and the security of the nation.
