Abstract
การศึกษาค้นคว้านี้มีวัตถุประสงค์เพื่อศึกษาแนวคิด ทฤษฎี และหลักเกณฑ์ทางกฎหมายที่เกี่ยวกับการค้าประเวณี และปัญหาในการบังคับใช้พระราชบัญญัติป้องกันและปราบปรามการค้าประเวณี พ.ศ. 2539 โดยศึกษาเปรียบเทียบแนวคิด ทฤษฎีและหลักเกณฑ์ทางกฎหมายของต่างประเทศอันได้แก่ ประเทศสวีเดน ประเทศอังกฤษ และประเทศฟินแลนด์ เพื่อนำผลที่ได้จากการศึกษาเปรียบเทียบมาเสนอแนะแนวทางในการแก้ไขปรับปรุงกฎหมายไทยให้มีประสิทธิภาพและตรงตามเจตนารมณ์ของกฎหมายที่มุ่งในการปราบปรามการค้าประเวณี การศึกษาค้นคว้าอิสระนี้เป็นการศึกษาเชิงคุณภาพ ด้วยวิธีการวิจัยทางเอกสาร โดยค้นคว้ารวบรวมจากหนังสือ งานวิจัย บทความทางวิชาการ วิทยานิพนธ์ที่เกี่ยวข้อง รวมทั้งสื่ออิเล็กทรอนิกส์ ทั้งของประเทศไทยและต่างประเทศ ผลการศึกษาพบว่าปัญหาการค้าประเวณีประเวณีในประเทศไทยยังคงเป็นปัญหาทางสังคมที่ไม่สามารถควบคุมได้ ดังนั้นพระราชบัญญัติป้องกันและปราบปรามการค้าประเวณี พ.ศ. 2539 ควรมีการแก้ไขเพิ่มเติมบทลงโทษแก่ผู้ซื้อประเวณี เพื่อให้กฎหมายดังกล่าวมีประสิทธิภาพตามเจตนารมณ์มากยิ่งขึ้น
The purpose of this independent study is to study about the concepts, theories, and the legal principles relating to the prostitution which has the problems in the enforcement to the Prevention and Suppression of Prostitute Act., B.E. 2539 by comparing with the concepts, theories, and the legal principles of the foreign countries which are Sweden, England and Finland. These countries have the effective legal measures concerning the prostitution. Then the researcher takes the output from the research into the suggestions of the guideline to revise Thai laws for the effectiveness and consistency with the spirit of the law which is to suppress the prostitution. This independent study is the qualitative research by means of the documentary research and collection from books, researches, academic articles, relevant theses, including electronic data both in Thai and foreign language. Result of the research: the problem of the prostitution in Thailand is still the social problem that can’t be controlled. Therefore, there shall be the revision of the Prevention and Suppression of Prostitute Act., B.E. 2539 by adding the punishment to the sex buyer for the purpose of the legal effectiveness and the consistency to the spirit of the law.
