Abstract
การศึกษาค้นคว้าอิสระนี้ มีวัตถุประสงค์เพื่อ 1) ศึกษาแนวคิดเกี่ยวกับการควบคุมกำกับสถานประกอบการที่เปิดให้บริการในลักษณะที่คล้ายกับสถานบริการ (2) ศึกษามาตรการทางกฎหมายในการควบคุมกํากับสถานประกอบการที่จัดตั้งคล้ายสถานบริการของประเทศไทย สหรัฐอเมริกา และเกาหลี (3) ศึกษาปัญหามาตรการทางกฎหมายเกี่ยวกับการควบคุมสถานประกอบการที่จัดตั้งคล้ายสถานบริการ (4) เสนอแนวทางในการปัญหามาตรการทางกฎหมายเกี่ยวกับการควบคุมสถานประกอบการที่จัดตั้งคล้ายสถานบริการ ศึกษานี้เป็นการวิจัยเชิงคุณภาพ ด้วยวิธีวิจัยเอกสารจากตำรา หนังสือ และตัวบทกฎหมายของไทย และต่างประเทศ บทความ วิทยานิพนธ์ สารนิพนธ์ รายงานการวิจัย วารสารเอกสารต่าง ๆ บทบัญญัติของประมวลกฎหมาย ตลอดจนคำพิพากษาของศาลและความเห็นของนักนิติศาสตร์ทั้งในประเทศไทย และต่างประเทศ เพื่อรวบรวมข้อมูลให้เป็นระบบ นํามาวิเคราะห์เปรียบเทียบและหาข้อสรุปเพื่อเสนอแนวทางการแก้ไขปัญหาต่อไป ผลการศีกษา พบว่า (1) การดำเนินกิจการในลักษณะที่คล้ายกับสถานบริการต้องจดทะเบียนพาณิชย์ เพื่อขอใบอนุญาตในการประกอบกิจการตามที่กระทรวงพาณิชย์กำหนด (2) มาตรการทางกฎหมายที่เกี่ยวข้องในประเทศไทย พบว่า เพื่อยับยั้งพฤติกรรมที่ไม่เหมาะสมของผู้มีอายุต่ำกว่า 20 ปี บริบูรณ์ และการเปิดให้บริการในลักษณะที่คล้ายสถานบริการ เป็นการปฏิรูป และจัดระเบียบสังคม เพื่อระงับและป้องกันการกระทำอันเป็นผลต่อความสงบเรียบร้อยของสังคม ตลอดจนการนำผู้ประกอบการที่ฝ่าฝืนกฎหมายมาลงโทษ สำหรับกฎหมายของประเทศสหรัฐอเมริกาที่เกี่ยวข้อง พบว่า เพื่อบรรเทาปัญหาทางสังคมที่เกิดขึ้นกับธุรกิจบันเทิงสำหรับผู้ใหญ่ และการออกกฎระเบียบในการจัดการกับผลกระทบของธุรกิจบันเทิงสำหรับผู้ใหญ่ ตลอดจนปัญหาสุขภาพที่เกี่ยวข้องกับธุรกิจ ส่วนกฎหมายของประเทศเกาหลีที่เกี่ยวข้อง พบว่า เพื่อรักษาศีลธรรม และขนบธรรมเนียมทางสังคม และเป็นการปกป้องเด็ก และเยาวชนจากสภาพแวดล้อมที่เป็นอันตราย (3) ปัญหามาตรการทางกฎหมายของประเทศไทยที่พบ ได้แก่ 1) การกำหนดคำนิยามและการบังคับใช้พระราชบัญญัติสถานบริการ พ.ศ. 2509 มีเนื้อหาที่ล้าสมัย ไม่สอดคล้องกับรูปแบบหรือลักษณะของสถานประกอบการในปัจจุบัน 2) การกำหนดเขตพื้นที่ตั้งและระยะเวลาเปิด-ปิดของสถานประกอบการที่เปิดให้บริการในลักษณะคล้ายกับสถานบริการ ไม่สามารถบังคับใช้ได้ตรงตามวัตถุประสงค์ และเจตนารมณ์ของกฎหมาย 3) พระราชบัญญัติสถานบริการ พ.ศ. 2500 มิได้มีการบัญญัติหลักเกณฑ์ขั้นตอนและวิธีการเกี่ยวกับกระบวนการตรวจตราสถานบริการไว้โดยเฉพาะ และไม่มีสถานะทางกฎหมาย 4) พระราชบัญญัติสถานบริการ พ.ศ. 2509 ไม่ได้กําหนดมาตรการ หรือบทลงโทษทางอาญาและโทษทางปกครองแก่ผู้ที่ให้การสนับสนุนหรือช่วยเหลือผู้กระทําความผิดภายใต้การดำเนินกิจการของสถานบริการได้ (4) ข้อเสนอแนวทางที่สำคัญ ได้แก่ 1) ควรนิยามความหมายของคำว่าสถานบริการให้ครอบคลุมรูปแบบและลักษณะความบันเทิงที่จัดขึ้นของสถานประกอบการให้สอดคล้องกับสถานการณ์ในปัจจุบัน 2) ควรมีการกำหนดใบขออนุญาต และการฝึกเพิกถอนใบอนุญาตเพื่อเป็นการควบคุม และกำหนดพื้นที่ตั้งวันเวลาเปิด-ปิด สถานประกอบการที่เปิดให้บริการในลักษณะที่คล้ายกับสถานบริการ 3) ควรมีการตรากฎหมายและกำหนดกระบวนการตรวจสอบ เพื่อเป็นการควบคุมสถานประกอบการที่เปิดให้บริการในลักษณะที่คล้ายกับสถานบริการให้มีอยู่ในฉบับเดียวกัน 4) ควรกำหนดโทษทางอาญา และโทษทางปกครองแก่ผู้ที่ให้การสนับสนุน หรือช่วยเหลือผู้กระทำความผิดตามพระราชบัญญัติสถานบริการ พ.ศ. 2509
The objectives of this independent study are: (1) to study the concept regarding the control and supervision of establishments operating in manners similar to entertainment places; (2) to study the legal measures for controlling and supervising the establishments operating in manners similar to entertainment places in Thailand, United States, and Korea; (3) to study the problems with legal measures relating to the control and supervision of the establishments operating in manners similar to entertainment places; (4) to recommend approaches to solving the the problems with legal measures relating to the control and supervision of the establishments This study is the qualitative research, by a method of literature review on the textbooks, books and laws of Thailand and foreign countries, articles, thesis, independent studies, research reports, journals, provisions of Codes, as well as court judgments and opinions of jurists in Thailand and foreign countries, in order to systematically collect information and data for analysis and comparison, and then seeking drawing conclusions to further propose the problem solutions. The results revealed that: (1) business operations in manners similar to entertainment places are required by the Ministry of Commerce to apply for business license registration, in order to operate the business; (2) the relevant legal measures in Thailand are found that, in order to deter the inappropriate behaviors of individuals under fully 20 years of age and operate the services similar to those of entertainment places as reformation and organization of the society, for stopping and preventing actions affecting the public order, as well as punishing the entrepreneurs, who violate the law; the relevant laws of the United States are found to alleviate the social problems arising in the adult entertainment business and provide with rules for dealing with the impact from the adult entertainment business as well as the health problems related to such business; and the relevant laws of Korea are found to maintain morality and social customs and protect children and youth from harmful environments; (3) the problems found in Thailand's legal measures include: 1) definitions and enforcement of the Entertainment Place Act, B.E. 2509 (1966) are obsolete, as the provisions are inconsistent with the style or nature of the current establishment place; 2) the zoning and business hours of the establishment providing services in manners similar to entertainment places cannot be enforced according to the intended purpose and the intent of the law; 3) the Entertainment Place Act, B.E. 2509 (1966) does not specifically prescribe the rules, procedures and methods with respect to the inspection process of entertainment place and is not in the legal status; 4) the Entertainment Place Act, B.E. 2509 (1966) does not stipulate any measure or criminal penalty and administrative penalty for those who support or assist offenders under the operation of entertainment place; (4) the recommendations on key approaches comprise of: 1) the definition of entertainment place should cover the style and nature of entertainment services provided by establishments in compliance with the current situations; 2) the licensing and suspension and revocation of the licenses should be prescribed for, in order to control and determine the zoning, business hours and days for establishments providing services in manners similar to entertainment places; 3) a law and inspection processes should be stipulated to control the establishment providing services in manners similar to entertainment places, as a single legislation; 4) the criminal punishments and administrative penalties should be prescribed against those who support or assist the offenders under the Entertainment Place Act, B.E. 2509 (1966).
