Abstract
การศึกษาค้นคว้าอิสระเรื่อง ปัญหาการรับฟังพยานหลักฐานทางอิเล็กทรอนิกส์ในคดีอาญา ปัจจุบันสภาพสังคมและรูปแบบของการประกอบอาชญากรรมมีความสลับซับซ้อนมากยิ่งขึ้นยากแก่การที่จะสืบสวนสอบสวนข้อเท็จจริง และนำตัวผู้กระทำความผิดมาดำเนินคดีได้ เนื่องมาจากความก้าวหน้าทางเทคโนโลยีในการก่ออาชญากรรมใน คดีอาญาบางประเภทอันมีลักษณะของการกระทำอันร้ายแรงหรือเป็นภัยต่อความมั่นคงของอำนาจอธิปไตย ความมั่นคงทางเศรษฐกิจและความสงบเรียบร้อยของประเทศและความสงบสุขของประชาชน มักมีรูปแบบในการกระทำความผิดที่สลับซับซ้อนมากและล้วนแล้วแต่มีผลประโยชน์มหาศาลมาเกี่ยวข้องทำให้การวางแผนการในการกระทำความผิดมีความซับซ้อนมีกิจกรรมในองค์กรหลายลักษณะ ฉะนั้นองค์กรในกระบวนการยุติธรรมทางอาญาจึงจำเป็นต้องพัฒนารูปแบบใน การแสวงหาข้อเท็จจริงตลอดจนพยานหลักฐานในการที่จะนำตัวผู้กระทำความผิดมาลงโทษได้มิเช่นนั้นสังคมก็จะดำรงอยู่ไม่ได้ เพราะเหตุนี้เองในพฤติการณ์พิเศษในบางกรณีเจ้าพนักงานของรัฐจำเป็นต้องนำมาตรการสืบสวนวิธีพิเศษสมัยใหม่ให้มีความทันสมัยต่อเทคโนโลยีและการพัฒนารูปแบบของการกระทำความผิด เช่น การดักฟังทางโทรศัพท์และการได้มาซึ่งข้อมูลทางอิเล็กทรอนิกส์เนื่องจากเป็นวิธีที่มีประสิทธิภาพและยังเป็นวิธีการหยั่งรู้ว่าอาชญากรมีวิธีการลงมือและวางแผนอย่างไร การศึกษาค้นคว้าอิสระนี้เป็นการวิจัยเชิงคุณภาพ ด้วยวิธีการวิจัยทางเอกสารจากการศึกษาค้นคว้า ประมวลกฎหมายวิธีพิจารณาความอาญาให้ตำรวจมีอำนาจสอบสวนซึ่งต้องกระทำการโดยชอบด้วยกฎหมาย โดยมีอำนาจเพียงการออกหมายเรียกส่วนการออกหมายจับต้องขออนุมัติต่อศาล ซึ่งต้องรวบรวมพยานหลักฐานให้ครบถ้วนและชัดเจน ให้ศาลพิจารณาศาลจึงจะอนุมัติหมายจับให้ จึงมีความจำเป็นที่จะต้องมีเครื่องมือในการบังคับใช้กฎหมายเป็นไปอย่างมีประสิทธิภาพและเกิดผลสูงสุดเพื่อประโยชน์ในการรวบรวมพยานหลักฐานในการพิสูจน์ข้อเท็จจริงตามกฎหมาย โดยเฉพาะคดีที่ยุ่งยากสลับซับซ้อนซึ่งไม่อาจดำเนินการได้ ด้วยการออกหมายเรียกหรือการสืบสวนด้วยวิธีการปกติเทียบเคียงกับกฎหมายของประเทศเยอรมันซึ่งใช้กฎหมายระบบซีวิลลอว์เช่นเดียวกับประเทศไทยอนุญาตให้ใช้การดักฟังการสนทนาทางโทรศัพท์เพื่อการสืบสวนการกระทำผิดในคดีอาชญากรรม สำคัญโดยศาลเป็นผู้สั่งอนุญาต ซึ่งข้อมูลดังกล่าวจะนำมาใช้เพื่อวัตถุประสงค์ในการเป็นพยานหลักฐานเพื่อพิสูจน์ความผิดของจำเลยในชั้นศาลเท่านั้นกฎหมายฉบับนี้มีลักษณะที่มีการพัฒนาให้มีความก้าวหน้าทันกับเทคโนโลยีที่ไม่หยุดยั้ง เพื่อให้สามารถยับยั้งอาชญากรที่มี ลักษณะเครือข่ายองค์กรอาชญากรรม โดยอาศัยเทคโนโลยีที่ล้าสมัย ในการรวบรวมพยานหลักฐานและข้อมูลข่าวสารเกี่ยวกับพฤติการณ์แห่งคดีสิทธิและเสรีภาพตามรัฐธรรมนูญล้วนแล้วแต่เป็นเสรีภาพในการกระทำทั้งสิ้น (Freedom of action) ดังนั้น รัฐควรจะต้องพิจารณาถึงความสามารถของหน่วยงานบังคับใช้กฎหมายและจะต้องพยายามเพิ่มขีดความสามารถให้ได้ มาตรฐานที่เหมาะสมโดยมีการบัญญัติบทบัญญัติของกฎหมายที่มีส่วนส่งเสริมการบังคับใช้กฎหมายที่มีประสิทธิภาพเป็นไปตามวัตถุประสงค์ของกฎหมายให้มากที่สุดโดยลดความยุ่งยากในการพิสูจน์ความผิดให้ปราศจากข้อสงสัยและคุ้มครองสิทธิส่วนบุคคลตามรัฐธรรมนูญกฎหมายที่จะตราขึ้นให้อำนาจรัฐดักฟังการติดต่อสื่อสารถึงกันทางโทรคมนาคม
The purpose of Independent study is nowadays, the social condition and the forms of committing criminal acts have been more complicated due to advancement in technology, this makes the investigation and apprehending the suspect has more difficulty. Some certain types of crimes tend to be strongly violent or become a threat to the sovereignty, economy and peacefulness of the country and its population. These types of crime are complicated and involve a huge benefit, they often have complicated planning in committing crime therefore, it is necessary for the criminal justice system to develop the appropriate way of fact finding and evident collecting so that the criminals can be brought to justice otherwise the society cannot survive. For this reason, in some special circumstances, the government officials need to use special means of investigation which are more up to date and compatible with advanced technology and highly developed crimes. These means include phone tapping and obtaining information electronically since they are more effective and let the investigators know the criminal planning. This research is qualitative research by using documentary resources. The Criminal Procedure Code gives power to police officers to conduct legal investigation and issue summon to the suspect for inquiring. To get the arrest warrant however, the investigating officer must collect and prepare completed and reliable evidences and submit to the criminal court for reviewing and issuing the arrest warrant. It is therefore, necessary for the investigator to have highly effective tool to be able to collect evidence so that the legal fact can be proved and the law can be effectively enforcing. This is especially true for complicated cases where the normal approach of issuing warrant for inquiring is almost useless. In comparison, in Germany, whose laws are Civil Laws system same as in Thailand, allow phone tapping for investigative purposes of major crimes with court's approval and it can only be used in court as evidence against the suspect. The contents of these laws have been developed with emphasis on continuing advance in technology so that they can stop organized crime network by utilizing highly advanced technology in collecting evidences and related information resulting in effective suppression of illegal drugs trafficking. Freedom and right according to the constitution are all freedom of action. Therefore, the government must consider the ability of the agency assigned to enforce this law and must try to increase its ability to suitable standard by legislate the law to promote law enforcement effectively and eliminate any obstacle on proof of guilt procedure. Also, the individual right protection and the objective must be clearly prescribed in the law and authorized the telephone tapping as the legal evidences acquiring.
