Abstract
การศึกษาครั้งนี้มีวัตถุประสงค์เพื่อ (1) ศึกษาถึงสภาพปัญหา อุปสรรค และมาตรการการบังคับใช้ กฎหมายสิ่งแวดล้อมทางน้ำ (2) ศึกษาถึงแนวคิดทฤษฎีเกี่ยวกับการคุ้มครองสิ่งแวดล้อมและสาระสำคัญของกฎหมายสิ่งแวดล้อมทางน้ำที่บังคับใช้ในประเทศไทยและต่างประเทศ (3) วิเคราะห์มาตรการบังคับใช้กฎหมายสิ่งแวดล้อมทางนํ้าในประเทศไทย (4) เสนอแนะแนวทางของปัญหาอุปสรรคและมาตรการ การบังคับใช้กฎหมายสิ่งแวดล้อมทางนํ้าให้มีประสิทธิภาพและสามารถบังคับใช้ได้จริง การศึกษาครั้งนี้เป็นการวิจัยเชิงคุณภาพ (Qualitative Research) โดยวิจัยจากเอกสาร (Decumentary Research) โดยการศึกษาค้นคว้าจากตํารา หนังสือ บทความ วิทยานิพนธ์วารสาร ทฤษฎีหลักกฎหมาย แนวคําพิพากษาของศาลปกครองกฎหมายสิ่งแวดล้อมของไทยและต่างประเทศ และรวมถึงกรณีศึกษาที่เกิดขึ้นจริง ตลอดถึงข้อมูลทางอินเตอร์เน็ต เป็นต้น โดยการนำข้อมูลมาวิเคราะห์รวมกัน ซึ่งเป็นส่วนสําคัญในการวิจัยครั้งนี้เพื่อหา ข้อสรุปและแนวทางแก้ไขปัญหามาตรการทางกฎหมายการบังคับใช้กฎหมายสิ่งแวดล้อมทางน้ำเพื่อให้มีผลบังคับ ใช้ได้อย่างแท้จริง ผลการศึกษาพบว่า (1) การเพิ่มจำนวนประชากร การเปลี่ยนแปลงของภูมิอากาศและการเกิดมลพิษจากแหล่งต่าง ๆ เป็นปัญหาในการเกิดมลพิษ และความซ้ำซ้อนของหน่วยงานที่บังคับใช้กฎหมายมีมากเกินไปรวมทั้ง บทบัญญัติที่ล้าสมัยอัตราโทษที่ไม่เหมาะสมตลอดถึงการให้อํานาจหน้าที่ และการใช้ดุลยพินิจของพนักงานเจ้าหน้าที่ในการตีความ ซึ่งเป็นอุปสรรคในการบังคับใช้กฎหมายสิ่งแวดล้อมทางน้ำ (2) แนวคิดทฤษฎีเกี่ยวกับการคุ้มครอง สิ่งแวดลอมและสาระสำคัญของกฎหมายสิ่งแวดล้อมทางนำของประเทศไทยซึ่ง เน้นมาตรการการบังคับ คือมีทั้งมาตรการบังคับทางอาญาซึ่งมีบทลงโทษที่ เน้นการป้องกันและปราบปรามส่วนมาตรการทางแพ่งเน้นหลักผู้ก่อให้เกิดมลพิษจะต้องรับผิดชอบในค่าใช้จ่าย ส่วนในต่างประเทศจะเน้นการขอความร่วมมือมากกว่าการใช้มาตรการบังคับแต่หากฝ่าฝืนก็มีมาตรการลงโทษทั้งมาตรการทางอาญาจะเป็นบทลงโทษทั้งปรับและจำคุกส่วนมาตรการทางแพ่งจะชดใช้ค่าเสียหาย (3) มาตรการการบังคับใช้ กฎหมายสิ่งแวดล้อมทางน้ำในประเทศไทยนั้น ขาดความเป็นเอกภาพของ กฎหมายกล่าวคือความซ้ำซ้อนของกฎหมายที่บังคับใช้ของหน่วยงานแต่ละหน่วยงาน รวมถึงบทบัญญัติของกฎหมาย มีความล้าสมัยและเป็นการให้อํานาจเจ้าหน้าที่่ใช้ดุลยพินิจบังคับใช้กฎหมายสิ่งแวดล้อมทางน้ำ (4) ข้อเสนอแนะคือ แก้ไขปรับปรุงพระราชบัญญัติส่งเสริมและรักษาคุณภาพสิ่งแวดล้อม พ.ศ.2535 ให้เป็นกฎหมายหลักในการควบคุ้ม มลพิษทางน้ำ และกำหนดให้กระทรวงทรัพยากรธรรมชาติและสิ่งแวดล้อมเป็นหน่วยงานหลักในการทำหน้าที่บังคับ ใช้กฎหมายที่เกี่ยวข้องกับมลพิษทางน้ำ ตลอดถึงจัดสร้างระบบบำบัดน้ำเสียในสถานที่ต่าง ๆ
The objectives of the present study are as follows: (1)to examine problems of, obstacles to, and measures for water environment law enforcement; ( 2) to study theoretical concepts relating to environmental protections in the substantial m atter of water environm ent law enforcem ent in Thailand and other countries; ( 3) to analyse water environm ent law enforcem ent in Tha iland; and ( 4) t o suggest effective and enforceable methods for problem resolution , to enhance existing water environmental law enforcement. rcement. This research is a qualitative study with data gathered from documentary research, and it includes support from secondary sources, the current norm ative judgments of the administrative courts,the environment laws of Thailand and other countries, case studies, as well as inform ation form the Internet. The data were analyzed to find effective and efficient methods for enhanced water environment law enforcement . The research concluded as follows: (1) Increasing populations, clim ate change, and pollution are the main causes of water pollution, but these problem s cannot be addressed by redundant and out dated provisions. ( 2) The theoretical concepts behind environmental protection laws in Thailand focus on protection and prevention, which provide crim inal enfor cement m easures by m eans of punishm ent and civil enforcem ent measures by means of indemnity. In com parison, the laws in other countries focus m ore on cooperation than com pulsory m easures. ( 3) Water environment laws in Thailand lack unity and present problem atic overlaps between law enforcement agencies, such that the provisions of the law are outdated and Thai authorities disem powered. Finally,this research suggests that; ( 4) the government should am end, enhance, and maintain the Environmental Quality Act, B.E. 2535 as the main law to control water pollution and should also appoint the Ministry of natural Resources and the Environment to act as the primary water pollution law enforcement agency.
