Abstract
การศึกษาค้นคว้าอิสระนี้มีวัตถุประสงค์เพื่อ 1) ศึกษาความหมายของคำจำกัดความหรือนิยามเกี่ยวกับการพนันและการพนันออนไลน์ (2) ศึกษาแนวคิดทฤษฎีการลงโทษทางอาญาและแนวคิดทฤษฎีเกี่ยวกับกฎหมายการพนันและการพนันออนไลน์ของประเทศไทย (3) ศึกษามาตรการทางกฎหมายเกี่ยวกับการปราบปรามการพนันของประเทศไทย ลักษณะของการพนันและการพนันออนไลน์ การจ่ายสินบนนำจับและมาตรการคุ้มครองเด็กและเยาวชนจากการถูกชักจูงหรือเชิญชวนให้เล่นการพนัน (4) ศึกษาและวิเคราะห์ปัญหาเกี่ยวกับการบังคับใช้กฎหมายการพนันและการพนันออนไลน์ของประเทศไทยและต่างประเทศ (5) ศึกษาแนวทางในการปรับปรุงแก้ไขปัญหาเกี่ยวกับการบังคับใช้กฎหมายการพนันและการพนันออนไลน์ของประเทศไทย การศึกษาค้นคว้าอิสระนี้ เป็นการวิจัยเชิงคุณภาพด้วยวิธีการวิจัยจากเอกสาร ซึ่งผู้ศึกษาได้ทำการรวบรวมข้อมูลจากเอกสารทั้งหมดที่เกี่ยวข้อง กฎหมาย ประกาศและเอกสารราชการอื่นๆ ที่เกี่ยวข้องกับการบังคับใช้กฎหมายเกี่ยวกับการพนันและการพนันออนไลน์ของประเทศไทย จากผลการศีกษาพบว่า (1) พระราชบัญญัติการพนัน พ.ศ. 2478 ยังไม่มีการบัญญัติคำจำกัดความหรือนิยามความหมายของคำว่า “การพนัน” และ “ผู้จัดให้มีการเล่นการพนัน เอาไว้อย่างชัดเจน จึงทำให้เกิดปัญหาในการตีความและการบังคับใช้กฎหมาย (2) การกำหนดบทลงโทษของผู้จัดให้มีการเล่นการพนัน หรือผู้เข้าเล่นการพนันในปัจจุบันค่อนข้างต่ำเกินไป จึงยังไม่มีความเหมาะสมและสอดคล้องกับสภาพเศรษฐกิจ และสถานการณ์ในปัจจุบัน (3) บทบัญญัติในเรื่องสินบนนำจับ ตามมาตรา 15 แห่งพระราชบัญญัติการพนัน พ.ศ.2478 ไม่สามารถใช้บังคับได้อย่างมีประสิทธิภาพ เนื่องจากในบางกรณีไม่สามารถจ่ายเงินสินบนนำจับให้แก่ผู้นำจับได้จริง อีกทั้งยังขาดมาตรการที่คุ้มครองเด็กและเยาวชนจากการถูกชักจูงหรือเชิญชวนให้เล่นการพนัน (4) พระราชบัญญัติการพนัน พ.ศ.2478 ไม่มีบทบัญญัติและมาตรการทางกฎหมายในการควบคุมและลงโทษเกี่ยวกับการเล่นการพนันออนไลน์ในประเทศไทย ซึ่งแตกต่างกับประเทศสหรัฐอเมริกา ประเทศสหราชอาณาจักร เขตบริหารพิเศษฮ่องกงแห่งสาธารณรัฐประชาชนจีนและประเทศสิงคโปร์ที่มีบทบัญญัติและมาตรการทางกฎหมายในเรื่องดังกล่าวเอาไว้ชัดเจนโดยในบางประเทศมีการบัญญัติแยกหมวดเฉพาะเอาไว้ด้วย (5) ข้อเสนอแนะ คือ การแก้ไขปรับปรุงพระราชบัญญัติการพนัน พ.ศ. 2478 ในส่วนของบทบัญญัติเกี่ยวกับคำจํากัดความหรือนิยามที่เกี่ยวข้องกับการพนัน บทกําหนดโทษของผู้จัดให้มีการเล่นการพนันหรือผู้เข้าเล่น การพนัน การจ่ายสินบนนำจับ และเพิ่มหมวดของบทบัญญัติที่เกี่ยวกับการพนันออนไลน์และการคุ้มครองเด็กและเยาวชนจากการถูกชักจูงหรือเชิญชวนให้เล่นการพนันไว้ในพระราชบัญญัติดังกล่าวด้วย
The purposes of this study were: 1) to study meanings of Gambling and Online gambling. 2) to study concept and theory of criminal punishment and theory of Gambling and Online gambling. 3.) to study legal measures regarding suppression of Thai gambling, type of Gambling and Online gambling , rewards and measures of child and youth protection invited to gambling. 4) to study and analyze issues legal Issues related to the law enforcement of Thai Gambling and Online gambling and international.5) to study a resolution regarding legal Issues related to the law enforcement of Thai Gambling and Online gambling.This study was a qualitative research by using documentary approach. Data was collected via related documents, regulations, rules, notifications and other governmental documents regarding legal issues related to the law enforcement of Thai Gambling and Online gambling. The study revealed that 1) The Gambling Act. B.E.2478 (1935) there is still no obviously meanings of “Gambling” and “Gambling Manager” causing problems with interpretation and law enforcement. 2) Now, penalty of “Gambling Manager” or Gambling Player” is low and inappropriate to economy and current situation.3) About Rewarsds in section 15 of The Gambling Act. B.E.2478 (1935) is cannot be efficiently enforcement because in the other case cannot pay rewards to guide and then is still no measures of child and youth protection invited to gambling. 4) The Gambling Act. B.E.2478 (1935) there is still no legal and measures to control and punish regarding to Online gambling. 5) A suggession is adjustment The Gambling Act. B.E.2478 (1935) in part of meanings of Gambling,rewards and add category of Online Gambling and measures of child and youth protection invited to gambling in The Gambling Act. B.E.2478 (1935)
