Abstract
การศึกษาค้นคว้าอิสระนี้มีวัตถุประสงค์เพื่อ (1) ศึกษาความเป็นมา ความหมาย แนวคิดและทฤษฎีที่เกี่ยวข้องกับการใช้สิ่งเทียมอาวุธปืน (2) ศึกษากฎหมายที่เกี่ยวกับการใช้สิ่งเทียมอาวุธปืนของประเทศไทย สหรัฐอเมริกา ประเทศอังกฤษ และสาธารณรัฐสิงคโปร์ (3) วิเคราะห์และเปรียบเทียบมาตรการทางกฎหมายของประเทศไทยกับสหรัฐอเมริกา ประเทศอังกฤษ และสาธารณรัฐสิงคโปร์ และ(4) เสนอแนะแนวทางในการพัฒนาและปรับปรุงกฎหมายเกี่ยวกับการใช้สิ่งเทียมอาวุธปืนในประเทศไทยการศึกษาค้นคว้าอิสระนี้เป็นการวิจัยเชิงคุณภาพด้วยวิธีวิจัยจากเอกสาร ผู้ศึกษาได้ทำการรวบรวมข้อมูลทั้งหมดที่เกี่ยวข้อง รวมถึงหนังสือ บทความ วารสาร เอกสารทางวิชาการ งานวิจัย วิทยานิพนธ์ และข้อมูลจากเครือข่ายอินเทอร์เน็ตทั้งในภาษาไทยและภาษาอังกฤษ ในส่วนของการวิเคราะห์ข้อมูล ผู้วิจัยได้วิเคราะห์ข้อมูลเชิงคุณภาพ โดยวิเคราะห์จากข้อมูลที่ได้จากการวิจัยเอกสารข้างต้น เพื่อจัดทำข้อเสนอแนะต่อไป ผลการศึกษาพบว่า (1) บทบัญญัติของกฎหมายตามพระราชบัญญัติอาวุธปืนเครื่องกระสุนปืน วัตถุระเบิด ดอกไม้เพลิง และสิ่งเทียมอาวุธปืน พ.ศ.2490 มิได้มีบทบัญญัติห้ามมิให้นำสิ่งเทียมอาวุธปืนมาใช้โดยมีเจตนาในการกระทำความผิดอาญาอื่น (2) บทบัญญัติของกฎหมายดังกล่าวมิได้บัญญัติให้คำจำกัดความของคำว่า สิ่งเทียมอาวุธปืน ไว้อย่างชัดเจน (3) บทบัญญัติตามประมวลกฎหมายอาญาของประเทศไทยไม่ถือว่าสิ่งเทียมอาวุธปืนเป็นอาวุธโดยสภาพตามความหมายของบทนิยามในมาตรา 1 (5) (4) ผู้ศึกษามีข้อเสนอแนะ โดยแก้ไขเพิ่มเติมพระราชบัญญัติอาวุธปืน เครื่องกระสุนปีน วัตถุระเบิด ดอกไม้เพลิง และสิ่งเทียมอาวุธปืน พ.ศ.2490 ให้บัญญัติห้ามมิให้นำสิ่งเทียมอาวุธปืนไปใช้กับการกระทำความผิดทางอาญาอื่น และมีการกำหนดคำนิยามเกี่ยวกับสิ่งเทียมอาวุธปืนที่เป็นรูปธรรมและแก้ไขเพิ่มเติมประมวลกฎหมายอาญาในมาตรา 1 (5) ให้หมายความรวมถึงสิ่งซึ่งมีรูปและลักษณะอันน่าจะทำให้บุคคลอื่นเข้าใจว่าเป็นอาวุธปืน
The objectives of this independent study were (1) to investigate the background, meaning, concepts and theories related to the use of imitation firearms, (2) to study the laws relating to the use of imitation firearms in Thailand, the United States of America, the United Kingdom and the Republic of Singapore, (3) to analyze and compare the legal measures of Thailand with United States of America, the England and the Republic of Singapore and, (4) to propose the recommended guidelines for the development and improvement of the law on the use of imitation firearms in Thailand. This independent study was a qualitative research using a document-based research method. The researcher compiled all relevant information as well as books, articles, journals, academic papers, research papers, theses and information from the Internet in both Thai and English languages. In the data analysis the researcher analyzed the qualitative data from the data obtained from the research document above to make further recommendations. The major findings indicated that (1) the provisions of the Firearms, Ammunition, Explosives, Fireworks and Imitation Firearms Act, B.E.2490 (1947) did not contain provisions prohibiting the use of imitation firearm with the intention of other criminal acts (2) The provisions of the said law do not provide a clear definition of the imitation firearms. (3) The provisions of the Penal Code of Thailand do not regard an imitation firearm as a weapon in the sense of the definition under section 1 (5). (4)The researcher has suggestions to amend the provisions of the Firearms, Ammunition, Explosives, Fireworks and Imitation Firearms Act, B.E.2490 (1947) to prohibit the use of imitation firearms for other criminal offenses and give a concrete definition of imitation firearms as well as amend section one (5) of the penal code to include things which have a picture and appearance that are likely to make other people to understand that it is a firearm.
