Abstract
การศึกษาค้นคว้าอิสระ เรื่อง ข้อจำกัดสิทธิการฟ้องคดีต่อศาลปกครองของคำสั่งลงทัณฑ์ทางวินัยทหารมีวัตถประสงค์เพื่อศึกษาเหตุผลที่พระราชบัญญัติจัดตั้งศาลปกครอง พ.ศ. 2552 ได้บัญญัติมีให้การดำเนินการเกี่ยวกับวินัยทหารเป็นคดีที่อยู่ในอำนาจพิจารณาพิพากษาของศาลปกครอง และศึกษาถึงข้อจำกัดสิทธิการดำเนินการเกี่ยวกับวินัยทหารเป็นคดีที่อยู่ในอำนาจพิจารณาพิพากษาของศาลปกครองว่ามีผลกระทบต่อข้าราชการทหารอย่างไร เพี่อนำไปเป็นข้อมูลและนำผลจากการศึกษาค้นคว้าเสนอต่อหน่วยงานที่เกี่ยวข้อง สำหรับนำไปประกอบการพิจารณา เป็นแนวทางในการแก้ไขพระราชบัญญัติจัดตั้งศาลปกครองและวิธิพิจารณาคดีปกครอง พ.ศ. 2552 การศึกษาค้นคว้าอิสระครั้งนี้ เป็นการวิจัยทางนิติศาสตร์ โดยการวิจัยเชิงคุณภาพ โดยการศึกษาค้นคว้าและวิเคราะห์เอกสารต่าง ๆ ที่เกี่ยวข้อง เช่น ตำรา บทความทางวิชาการ วิทยานิพนธ์ และบทบัญญัติทางกฎหมาย ผลจากการศึกษาพบว่า ศาลปกครองประเทศเยอรมนี และศาลปกครองประเทศฝรั่งเศสมีได้บทบัญญัติจำกัดสิทธิดังกล่าว เนื่องจากเห็นว่า คำสั่งลงทัณฑ์ทางวินัยของทหาร เป็นการทำลายความสัมพันธ์ระหว่างรัฐ
กับข้าราชการทหารผู้นั้นย่อมอยู่ในอำนาจของศาลปกครองที่เป็นศาลเฉพาะด้านเข้าไปมีอำนาจตรวจสอบการใช้อำนาจเหล่านั้นของผู้บังคับบัญชาทหารได้ในประเทศไทยการที่ศาลปกครองมีบทบัญญัติจำกัดสิทธิดังกล่าว เนื่องจากคณะกรรมการร่างกฎหมายมีความเห็นว่าอำนาจบังคับบัญชาของทหารมีความแตกต่างจากข้าราชการอื่น เนื่องจากทหารเป็นผู้ถืออาวุธที่รุนแรงอยู่ในมือ ซึ่งไม่พบในข้าราชการประเภทอื่น หากทหารถืออาวุธนั้นในทางมิชอบสภาพกองทัพก็ไม่ต่างจากโจรที่ยากจะควบคุม ประกอบกับทหารมีภารกิจหลักในการรักษาความมั่นคงของประเทศ ทหารจึงจำต้องเชื่อฟังและปฏิบัติตนตามคำสั่งของผู้บังคับบัญชาอย่างเคร่งครัดโดยเฉพาะในยามสงครามสถานการณ์ฉุกเฉิน หรือในเขตที่ประกาศใช้กฎอัยการศึกส่งผลให้คดีที่เกี่ยวกับการดำเนินการทางวินัยทหารอยู่ในศาลยุติธรรมทั่วไปซึ่งไม่มีความเชี่ยวชาญเฉพาะด้านในคดีปกครองอีกทั้งรูปแบบการพิจารณาคดีที่เป็นระบบกล่าวหาไม่เหมาะกับการพิจารณาคดีทางปกครอง แม้เป็นศาลทหารก็ไม่มีอำนาจวินิจฉัยเรื่องดังกล่าวเนื่องจากศาลทหารมีอำนาจพิจารณาพิพากษาคดีอาญาเท่านั้น อีกทั้งรูปแบบและองค์คณะก็ไม่เหมาะสมที่จะพิจารณาคดีอันเกี่ยวกับการดำเนินการทางวินัยทหารเฉกเช่นศาลยุตธรรมทั่วไป การที่ให้คดีเกี่ยวกับการดำเนินการทางวินัยทหารอยู่ในอำนาจศาลยุติธรรมทั่วไปย่อมเป็นการจำกัดสิทธิของทหารทำให้ทหารไม่ได้รับการคุ้มครองสิทธิอย่างเพียงพอและเหมาะสมเมี่อเทียบกับต่างประเทศผู้วิจัยจึงขอเสนอให้ยกเลิก มาตรา 9 วรรคสอง (1) แห่งพระราชบัญญัติจัดตั้งศาลปกครองและวิธีพิจารณาคดีปกครอง พ.ศ. 2542 ที่มิให้การดำเนินการเกี่ยวกับวินัยทหาร เป็นคดีที่ไม่อยู่ในอำนาจของศาลปกครอง เป็นให้ศาลปกครองมีอำนาจพิจารณาพิพากษาคดีที่เกี่ยวกับการดำเนินการทางวินัยทหาร เพี่อให้สอดคล้องกับประเทศเยอรมันและฝรั่งเศสและทำให้ทหารได้รับการการคุ้มครองสิทธิอย่างเพียงพอเหมาะสม
This study aims to examine the reason why the Act of the establishment of the Administration Court B.E 2552 (1999) enacted that the proceeding of military discipline not to be a case in a jurisdiction of the Administrative Court, and to examine how the rights restrictions about the proceeding in military discipline, which is a case in a jurisdiction of the Administrative Court, influences the soldiers. The result of the study will be presented to the coordinated departments in order to be a document for consideration and an outline in amending the Act of the establishment of the Administrative Court and the Administrative procedure 1999. I studied the proceeding of military discipline and the authority of the Administrative Court about the penalty of the military discipline of Germany and France, which is the model of the establishment of the Administrative Court in Thailand, to find out if the rights restrictions in prosecution about the penalty of the military discipline are available as in Thailand. The findings shows that the Administrative Court of Germany and France do not enacted the rights restrictions, because the penalty of the military discipline leads to the destruction of the relation between the state and the soldier. The penalty of the military discipline is under the authority of the Administrative Court, which is the specialized court, and has the authority to investigate the commander’s power. In Thailand, the Administrative Court enacted the rights restrictions, because the Law Drafting Committee found that the authority of the soldiers is different from the other government officers. The soldiers own the violent weapons, which cannot be found in any other officers. If the soldiers misuse the weapons, the army would be like an uncontrollable guerrilla band. The main task of the soldiers is to maintain the stability of the country, thus the soldiers must obey and follow an order of the commander strictly, especially in wartime, emergency situations, or martial law areas, so the proceeding of military discipline are judged in Court of Justice, which is not the specialized in Administrative cases. In addition, its trial forms in Adversary system is also inappropriately in Administrative proceeding. Even the Military Court has also no authority to adjudicate in the military discipline cases, but only in the criminal cases. Furthermore, its forms and the quorum are not suitable in the proceeding of the military discipline cases as in Court of Justice.To provide the authority in the military discipline cases to Court of Justice is limitation of rights of the soldiers, and they do not obtain the right protection sufficiently and appropriately. Conclusively, it is proposed that the article 9 clause (1) in the Act of the establishment of the Administrative Court and the Administrative procedure B.E 2552 (1999) should be abrogated. The proceeding of military discipline should not be authorized and judged by the Administrative Court in order to comply with Germany and France and to provide the rights protection to the soldiers sufficiently and appropriately.
