Abstract
การศึกษาค้นคว้าอิสระนี้มีวัตถุประสงค์เพื่อ 1) ศึกษาแนวคิดทฤษฎีและหลักกฎหมายเกี่ยวกับคำสั่งทางปกครอง คดีปกครองและคดีแรงงาน (2) ศึกษาหลักกฎหมายเกี่ยวกับคำสั่งทางปกครอง คดีปกครองและคดีแรงงานในประเทศไทย (3) ศึกษาวิเคราะห์อำนาจในการพิจารณาพิพากษาคดีเกี่ยวกับคำสั่งของฝ่ายปกครองตามกฎหมายว่าด้วยคุ้มครองแรงงาน (4) เสนอแนะแนวทางแก้ไขปรับปรุงหลักเกณฑ์การพิจารณาคําสั่งของฝ่ายปกครองตามกฎหมายว่าด้วยคุ้มครองแรงงาน การศึกษาค้นคว้าอิสระนี้เป็นการวิจัยเชิงคุณภาพ โดยการวิจัยทางเอกสาร จากตัวบทกฎหมาย หนังสือ ตำราทางกฎหมาย รายงานการวิจัย วิทยานิพนธ์ บทความและเอกสารทางวิชาการ คําพิพากษาของศาล สื่ออิเล็กทรอนิกส์ และเอกสารอื่นที่เกี่ยวข้อง ผลการศึกษาพบว่า (1) คำสั่งทางปกครองเป็นคำสั่งซึ่งออกโดยเจ้าหน้าที่ของรัฐด้วยการใช้อำนาจทางปกครองและมีผลกระทบต่อสิทธิหน้าที่ของบุคคล โดยหลักแล้วจะมีการตรวจสอบความชอบด้วยกฎหมายโดยศาลปกครองเว้นแต่บางกรณีที่มีกฎหมายกำหนดอำนาจศาลเป็นอย่างอื่น เช่น คดีแรงงาน (2) คำสั่งทางปกครองตามกฎหมายไทยเป็นไปตามนิยามที่บัญญัติไว้ในพระราชบัญญัติวิธีปฏิบัติราชการทางปกครอง พ.ศ. 2539 ซึ่งโดยหลักมีการตรวจสอบความชอบด้วยกฎหมายโดยศาลปกครอง เว้นแต่เป็นคดีที่อยู่ในอำนาจของศาลชำนาญพิเศษ เช่น คดีแรงงาน (3) คำสั่งของฝ่ายปกครองตามพระราชบัญญัติคุ้มครองแรงงาน พ.ศ. 2541 มีกฎหมายกำหนดให้อยู่ในอำนาจพิจารณาของศาลแรงงาน อย่างไรก็ดียังมีบางกรณี เช่น กรณีเจ้าหน้าที่ของรัฐละเลยต่อหน้าที่ตามที่กฎที่กฎหมายกําหนดให้ต้องปฏิบัติหรือปฏิบัติหน้าที่ดังกล่าวล่าช้าเกินสมควร ซึ่งตามหลักทั่วไปพระราชบัญญัติจัดตั้งศาลปกครองและวิธีพิจารณาคดีปกครอง พ.ศ. 2542 มาตรา 9 วรรคหนึ่ง (3) กำหนดให้ศาลปกครองเป็นผู้พิจารณา แต่เนื่องจากคำสั่งตามกฎหมายว่าด้วยคุ้มครองแรงงานดังกล่าวมีลักษณะเกี่ยวข้องกับคดีแรงงานจึงมีข้อพิจารณาว่าควรให้ศาลแรงงานเป็นผู้พิจารณา (4) ผู้ศึกษาจึงขอเสนอให้แก้ไขพระราชบัญญัติจัดตั้งศาลปกครองและวิธีพิจารณาคดีปกครอง พ.ศ. 2542 ในกรณีเจ้าหน้าที่ของรัฐละเลยต่อหน้าที่ ตามที่กฎหมายกำหนดให้ต้องปฏิบัติหรือปฏิบัติหน้าที่ดังกล่าวล่าช้าเกินสมควร ตามพระราชบัญญัติคุ้มครองแรงงาน พ.ศ. 2541 ควรให้ศาลแรงงานเป็นผู้พิจารณาเพื่อความสะดวกและสอดคล้องกับเจตนารมณ์ของกฎหมายด้านคดีแรงงาน
This independent study aims to (1) study the concepts, theories and the principles of law relating to administrative orders. Administrative cases and labor cases (2) study the law principles on administrative orders Administrative and labor cases in Thailand (3) study and analyze the power of judicial proceedings on administrative orders under the labor protection law with labor protection. This independent study is a qualitative research. By documentary research From the text of the law, the book of legal texts Research reports, thesis articles and academic papers Court judgment Electronic media And other related documents. This study found that (1) an administrative order is an order issued by a government official using administrative power and has an impact on the rights and duties of a person. Essentially, there will be a legality review by the administrative court. Except in some cases where there is a law that sets the jurisdiction otherwise, such as labor cases (2) administrative orders under Thai law are in accordance with the definition provided in the Administrative Procedure Act B.E. Legality exam by the Administrative Court Unless it is a case within the jurisdiction of a specialized court, such as a labor case. (3) An order of the administrative department under the Labor Protection Act, B.E. However, there are cases where government officials neglect their duties. As required by law to perform or perform such duties undue delay In accordance with the general principles of the Act Establishment of the Administrative Court and Administrative Court Procedure, BE 2542, Section 9, paragraph one (3), requires the Administrative Court to consider. However, since the order under the law on labor protection is related to the labor case, it is considered that the labor court should consider it. (4) The educator therefore proposes to amend the Act on Establishment of the Administrative Court and Administrative Court Procedure B.E.
