ปัญหาการสอบสวนคดีอาญาของพนักงานสอบสวน

Abstract

การศึกษาค้นคว้าอิสระเรื่อง ปัญหาการสอบสวนคดีอาญาของพนักงานสอบสวน มีวัตถุประสงค์ในการศึกษาถึงปัญหาของการสอบสวนคดีอาญาของพนักงานสอบสวน กระบวนการ ยุติธรรมในชั้นตำรวจด้านการสอบสวน หลักกฎหมายว่าด้วยการสอบสวนคดีอาญาของพนักงานสอบสวนของประเทศไทย และศึกษา คำสั่งหัวหน้ารักษาความสงบแห่งชาติ ที่ 7/2559 ประกอบกับศึกษาสภาพปัญหาและอุปสรรคในการสอบสวนคดีอาญาของพนักงานสอบสวนไทย อันเนื่องมาจากสายการบังคับบัญชา เพื่อหาแนวทางแก้ไขปัญหาให้สอดคล้องกับสภาพสังคมในปัจจุบัน การศึกษาค้นคว้าอิสระนี้เป็นการศึกษาวิจัยเชิงคุณภาพด้วยวิธีการวิจัยทางเอกสาร ด้วยการค้นคว้าและรวบรวมข้อมูลและเอกสารที่เกี่ยวข้องในรูปแบบของ หนังสือกฎหมาย หนังสือวารสาร บทความ วิทยานิพนธ์ รายงานการวิจัยต่าง ๆ เอกสารประกอบการสัมมนา เอกสารเผยแพร่ของหน่วยราชการต่าง ๆ คำวินิจฉัยชี้ขาดคณะกรรมการกฤษฎีกา และยังสัมภาษณ์ ผู้ที่ปฏิบัติงานสอบสวน เพื่อประกอบการศึกษาค้นคว้าและวิเคราะห์ ผลการศึกษาพบว่า แนวความคิดทางกฎหมายว่าด้วยการสอบสวนคดีอาญาของพนักงานสอบสวนของประเทศไทย, ปัญหาในการออกคำสั่งของหัวหน้ารักษาความสงบแห่งชาติ ที่ 7/2559 และปัญหาที่แท้จริงของงานสอบสวนของสำนักงานตำรวจแห่งชาติ ที่มาจากสายการบังคับบัญชา เพื่อเสนอแนวทางในการแก้ไข กฎหมาย ระเบียบ และ คำสั่ง ที่เกี่ยวข้องกับงานสอบสวน อันจะเป็นแนวทางการแก้ไขปัญหาของพนักงานสอบสวน เพื่อจำทำให้การสอบสวนคดีอาญา เหมาะสมกับสภาพปัจจุบันของประเทศไทย พนักงานสอบสวนผู้ปฏิบัติงานที่แท้จริง สะดวกในการรวบรวมพยานหลักฐาน เพื่อให้ความเป็นธรรมต่อประชาชนต่อไป

The purpose of the research is to study the issue of criminal investigation officers by reviewing the process in the police investigation, the law governing the criminal investigation of the officers, and chief of maintaining national 7/2559 In addition, this research is also study the problems and obstacles in the criminal investigation of the officers by the chain of command. This is beneficial for finding the suitable solutions for current situation in Thailand. This independant study is a qualitative research based on documentary study on a data compilation and analysis of related provision of law, legislation, research reports, journal articles, seminar documentation from government agencies, ruling council of state and interview the investigation officers. The result found that the law officers of the criminal investigation by head of the National Council for Peace and Order, the head of maintaining national 7/2559 and the investigation by the chain of command still have drawback. Therefore, Thailand need to amend the legislations and the regulations relating to the investigation for facilitating for the investigation officers in gathering the evidence. This results in citizens to assess the fairness of legal procedure.
