ปัญหากฎหมายเกี่ยวกับการฆ่าสัตว์เพื่อจำหน่ายเนื้อสัตว์

Abstract

การศึกษาวิจัยเรื่องปัญหากฎหมายเกี่ยวกับการฆ่าสัตว์เพื่อจำหน่ายเนื้อสัตว์มีวัตถุประสงค์ เพื่อ (1) ศึกษานิยาม ความหมายและการจัดการควบคุมการฆ่าสัตว์เพื่อการจำหน่ายเนื้อสัตว์ ศึกษาและวิเคราะห์พระราชบัญญัติควบคุมการฆ่าสัตว์เพื่อจำหน่ายเนื้อสัตว์ พ.ศ. 2559 และ (2) เปรียบเทียบกับกฎหมายขององค์การระหว่างประเทศและกฎหมายต่างประเทศ เพื่อเสนอแนะแนวแก้ไขปรับปรุงกฎหมายที่เกี่ยวข้อง การวิจัยนี้ใช้ระเบียบวิธีวิจัยเชิงคุณภาพ โดยศึกษาและวิเคราะห์รวบรวมข้อมูล จากเอกสารที่เกี่ยวข้อง โดยนำมาวิเคราะห์กับกฎหมาย หลักเกณฑ์ เพื่อให้ได้มาซึ่งข้อสรุปทางกฎหมาย และแนวทางแก้ไข ผลการวิจัยพบว่า พระราชบัญญัติควบคุมการฆ่าสัตว์เพื่อจำหน่ายเนื้อสัตว์ พ.ศ. 2559 มีปัญหากฎหมายหลายประการ อาทิ (1) ประเด็นเรื่องการออกกฎหมายลำดับรอง ได้แก่ การกำหนดให้มาตรฐานโรงฆ่าสัตว์เป็นมาตรฐานบังคับและการกำหนดคุณสมบัติผู้ทรงคุณวุฒิ ในคณะกรรมการกำกับดูแลการประกอบกิจการฆ่าสัตว์ (2) ประเด็นการป้องกันการทารุณกรรมสัตว์และการจัดการสัตว์ตามหลักสวัสดิภาพสัตว์ในโรงฆ่าสัตว์ (3) ประเด็นบทบัญญัติเกี่ยวกบระบบโลจิสติกส์และ (4) ประเด็นคุณสมบัติของพนักงานตรวจโรคสัตว์และกระบวนการตรวจสัตว์ ก่อนและหลังการฆ่าสัตว์ จึงมีข้อเสนอแนะให้แก้ไขเพิ่มเติมพระราชบัญญัติควบคุมการฆ่าสัตว์ เพื่อจำหน่ายเนื้อสัตว์ พ.ศ. 2559 เพื่อสร้างหลักประกันในความปลอดภัยให้กับผู้บริโภคเนื้อสัตว์ ที่สะอาดถูกหลักอนามัย และนำไปสู่แนวทางการควบคุมมาตรฐานโรงฆ่าสัตว์ที่เหมาะสม กับสภาพการณ์ของประเทศไทยเพื่อให้เกิดการพัฒนาที่เหมาะสมและยั่งยืน

The study of legal problems relating to animal slaughtering for meat selling had the objectives (1) to examine the definition, manage animal slaughtering for meat selling, and (2) to study, analyze the Control of Animal Slaughtering for Selling Meat Act B.E. 2559 (2016) and compare with the regulations of international standard and foreign laws in order to provide the recommendation for amendment the laws. This qualitative research consists of literature research and analysis based on various criteria and appropriate guidelines in order to obtain a legal conclusion. The results showed that the existing laws should be amended in many issues which are (1) the proceeding of the issuance of subordinate laws include enforcement abattoir standards as compulsory and requirements, specification the qualified persons in the animal oversight committee in the slaughter operation, (2) the humane handling of animals and management of animal welfare principles in the slaughterhouse, (3)the appropriate logistics systems for the transportation of meat for distribution and traceability systems and (4) the qualifications of animal disease inspectors and animal inspection processes before and after animal slaughtering. Therefore, they had provided amendments to the Control of Animal Slaughtering for Selling Meat Act B.E. 2559 (2016) must ensure safety and hygiene for meat consumers, and to lead the guidelines of slaughterhouse standard control that was suitable for the situation of Thailand in order to achieve appropriate and sustainable development
