บทบาทของสมาชิกสภาเทศบาลตำบลในการประนีประนอมข้อพิพาท : ศึกษากรณีของสมาชิกสภาเทศบาลตำบลทุ่งช้าง จังหวัดน่าน

Abstract

การศึกษาค้นคว้าอิสระนี้ มีวัตถุประสงค์เพื่อ (1) ศึกษาบทบาทในการประนีประนอมข้อพิพาทของสมาชิกสภาเทศบาลตำบลทุ่งช้าง จังหวัดน่าน (2) ศึกษาปัญหาอุปสรรคและแนวทางแก้ไขในการประนีประนอมข้อพิพาทของสมาชิกสภาเทศบาลตำบลทุ่งช้าง จังหวัดน่าน การศึกษาค้นคว้าอิสระนี้เป็นการวิจัยเชิงคุณภาพ ประชากรและกลุ่มตัวอย่างซึ่งเลือก แบบเจาะจง คือ สมาชิกสภาเทศบาลตำบลทุ่งช้างจำนวน 12 คน เครื่องมือวิจัยใช้แบบสัมภาษณ์ และ วิเคราะห์ข้อมูลเชิงพรรณนา ผลการศึกษาพบว่า (1) บทบาทสมาชิกสภาเทศบาลตำบลทุ่งช้างในการประนีประนอมข้อพิพาทได้แก่ การรับเรื่องร้องเรียน-ร้องทุกข์ การรับฟังปัญหาของที่เกิดกรณีข้อพิพาท การสร้างปฏิสัมพันธ์ระหว่างผู้ร้องเรียน-ร้องทุกข์ การประนีประนอมข้อพิพาทให้กับประชาชนในเขตพื้นที่ ของเทศบาลตำบลทุ่งช้าง เมื่อเกิดกรณีข้อพิพาทระหว่างกัน (2) ปัญหาอุปสรรคได้แก่ 1) สมาชิกสภาเทศบาลตำบลทุ่งช้างขาดความเชื่อมั่นเพราะไม่มีกฎหมายบัญญัติชัดเจน 2) สมาชิกสภาเทศบาลตำบลบางคนยังขาดความรู้ความเข้าใจการประนีประนอมข้อพิพาทที่ถูกต้อง 3) ประชาชนบางคนยังไม่ให้การยอมรับการทำหน้าทีประนีประนอมข้อพิพาทของสมาชิกสภาเทศบาลตำบลแนวทางแก้ไขได้แก่ 1) ต้องบัญญัติเป็นกฎหมายที่ชัดเจนให้อำนาจหน้าที่ประนีประนอมข้อพิพาทแก่สมาชิกสภาเทศบาลตำบล 2) จัดอบรมให้ความรู้ความเข้าใจในการประนีประนอมข้อพิพาทที่ถูกต้องแก่สมาชิกสภาเทศบาลตำบล 3) สนับสนุนงบประมาณการประนีประนอมข้อพิพาทเป็นการเฉพาะ

The objective of this research is twofold: (1) to study the role of the members of Thung Chang Municipal Sub-District Council in conciliatory resolution; and (2) to identify challenges in local conciliatory processes and recommend the solutions. This is a qualitative research. The key informants, selected through purposive samplings, include 12 members of Thung Chang Municipal Sub-District Council. This thesis employs interview questionnaires as the principal research tool. Data are analyzed by descriptive analysis. The research shows that, firstly, the members of Thung Chang Municipal Sub-District Council have played a lead role in conciliation when conflicts arose among local citizens. The roles include receiving complaints over grievances, hearing causes of conflictual issues, facilitating interactions, building confidence between parties to conflict, settle the disputes through conciliation. Secondly, the challenges in conciliatory process are identified as (1) the lack of public confidence because no legal framework is provided for municipal sub-district council members to act as conciliators; (2) the inadequacy of knowledge and understanding of proper conciliatory methods; (3) the incomplete acceptance on the part of the citizens involved. Approaches to solving these problems are: (1) enactment of laws to provide authorities for municipal sub-district council members to act as local conciliators; b) providing training for municipal sub-district council members on proper conflict conciliation methods; and c) setting aside a special budget line for local conflict resolution.
