การพิจารณาคดีเลือกตั้งท้องถิ่นในระบบไต่สวนตามพระราชบัญญัติการเลือกตั้งสมาชิกสภาท้องถิ่นหรือผู้บริหารท้องถิ่น พ.ศ. 2545

Abstract

การศึกษาค้นคว้าอิสระเรื่อง การพิจารณาคดีเลือกตั้งท้องถิ่นในระบบไต่สวนตามพระราชบัญญัติการเลือกตั้งสมาชิกสภาท้องถิ่นหรือผู้บริหารท้องถิ่น พ.ศ. 2545 มีวัตถุประสงค์เพื่อ (1) ศึกษาแนวคิดทฤษฎีเกี่ยวกับระบบไต่สวนของกฎหมายต่างประเทศ และกฎหมายไทย (2) ศึกษากระบวนพิจารณาในระบบไต่สวนคดีเลือกตั้งสมาชิกสภาท้องถิ่นและผู้บริหารท้องถิ่นไทย (3) วิเคราะห์ถึงปัญหาและหาแนวทางที่เหมาะสมใช้ในระบบไต่สวนคดีเลือกตั้งท้องถิ่นของศาลอุทธรณ์ภาค 4 (4) เพื่อให้คู่ความและประชาชนได้รับความรู้เกี่ยวกับระบบไต่สวนคดีเลือกตั้งท้องถิ่นมากขึ้น การศึกษาค้นคว้าอิสระนี้เป็นการวิจัยเชิงคุณภาพ ด้วยวิธีการวิจัยทางเอกสาร โดยมีกลุ่มตัวอย่าง คือ คดีเลือกตั้งท้องถิ่น อันได้แก่ การเลือกตั้งสมาชิกสภาท้องถิ่นหรือผู้บริหาร ท้องถิ่นในเขตภาคตะวันออกเฉียงเหนือตอนบน รวม 12 จังหวัด อันอยู่ในเขตอำนาจของ ศาลอุทธรณ์ภาค 4 รวมทั้งกฎหมาย ระเบียบ ข้อบังคับที่เกี่ยวข้องด้วย ผลการศึกษา พบว่า (1) การสืบสวนสอบสวนของคณะกรรมการการเลือกตั้งเป็นไปด้วย ความล่าช้า (2) บันทึกคำให้การของคณะอนุกรรมการสืบสวนสอบสวนมิได้เป็นระบบและโปร่งใส (3) ระบบไต่สวนคดีเลือกตั้งท้องถิ่นมีลักษณะคล้ายระบบกล่าวหาและไม่รวดเร็วเท่าที่ควร (4) ศาลและคู่ความไม่เข้าใจในระบบไต่สวน (5) คำสั่งคดีเลือกตั้งท้องถิ่น ขัดแย่งแตกต่างกับคำพิพากษาคดีอาญาและคดีแพ่ง

The objectives of this study is to: (1) study the theories of inquisitorial system of international law and the Thai law (2) study inquisitorial procedure of councilor elections and local administrators of Thailand (3) analyze the problems and examine for an appropriate system of an inquisitorial procedure toward local elections of the appeal court region 4 (4) present the litigants and people to understand an inquisitorial procedure of local elections. This study uses a qualitative research approach analyzing research papers and the sample group is a local election as councilor elections and local administrators of the Upper Northeast Region for 12 provinces where are under the appeal court region 4, although the related laws and regulations are included. This research found that: (1) the investigation of an Election Commission Board is delay (2) the record of the testimony of an investigation under subcommittee are not systematic and transparency (3) the inquisitorial procedure of local elections are similar to alleged system and slowly (4) the court and the parties do not understand inquisitorial procedure (5) the order of an election cases are conflict with the judgements of the criminal case and civil cases.
