ขอบเขตอำนาจหน้าที่ของคณะกรรมการกิจการไปรษณีย์ ตามพระราชกฤษฎีกากำหนดอำนาจ สิทธิและประโยชน์ของบริษัท ไปรษณีย์ไทย จำกัด พ.ศ. 2546

Abstract

การวิจัยเรื่องขอบเขตอํานาจหน้าที่ของคณะกรรมการกิจการไปรษณีย์ ตามพระราชกฤษฎีกา กําหนดอํานาจ สิทธิและประโยชน์ของบริษัท ไปรษณีย์ไทย จํากัด พ.ศ. 2546 มีวัตถุประสงค์เพื่อ (1) ศึกษาที่มา และพัฒนาการของกิจการไปรษณีย์ และการแปรรูปเป็นบริษัท ไปรษณีย์ไทย จํากัด (ปณท) (2) ศึกษาขอบเขตการ ใช้อํานาจหน้าที่ของคณะกรรมการกิจการไปรษณีย์ที่เกี่ยวข้องกับการดําเนินกิจการไปรษณีย์ไทย (3) ศึกษา แนวความคิดและหลักเกณฑ์การปฏิบัติหน้าที่ที่เกี่ยวข้องกับคําสั่งทางปกครองของคณะกรรมการกิจการไปรษณีย์ (4) เสนอแนวทางที่เหมาะสมในการปฏิบัติหน้าที่ ที่เกี่ยวข้องกับคําสั่งทางปกครองของคณะกรรมการกิจการ ไปรษณีย์ และการดําเนินธุรกิจของ ปณท การวิจัยเรื่องนี่เป็นการวิจัยทางกฎหมายโดยการวิจัยเชิงคุณภาพด้วยวิธีการวิจัยทางเอกสาร จากการเก็บรวบรวมข้อมูลจากตัวบทกฎหมาย หนังสือ บทความ เอกสารทางวิชาการ งานวิจัย วิทยานิพนธ์และ ข้อมูลจากเครือข่ายอินเทอร์เน็ตทั้งภาษาไทยและภาษาอังกฤษ ผลการวิจัยพบว่า แม้ว่ากิจการไปรษณีย์ของไทยจะได้มีการปรับปรุงเปลี่ยนแปลงการกํากับดูแล และการให้บริการมาโดยตลอด แต่ยังคงมีวัตถุประสงค์เช่นเดิม คือ เพื่อสร้างความมั่นคงของประเทศ และเพื่อให้บริการสาธารณะต่อประชาชน ปัจจุบันมีการกําหนดอํานาจหน้าที่ ที่มีอยู่เดิมของบริษัทฯ มาเป็นอํานาจของ คณะกรรมการกิจการไปรษณีย์ โดยอาจแบ่งออกเป็น 3 กลุ่ม ประกอบด้วย (1) อํานาจในการทําคําสั่งทางปกครอง ตามพระราชบัญญัติ ไปรษณีย์ พุทธศักราช 2477 ได้แก่ การอนุญาต และการวินิจฉัย (2) อํานาจในการบังคับใช้ กฎระเบียบ ข้อบังคับและข้อกําหนดในกิจการไปรษณีย์ ได้แก่ ข้อบังคับต่าง ๆ ของคณะกรรมการ กสท. การ จัดทําไปรษณีย์นิเทศ และการออกคําสั่งใด ๆ ของผู้ว่าการ กสท. ที่มีลักษณะเป็นคําสั่งทางปกครองตาม พระราชบัญญัติ ไปรษณีย์ พุทธศักราช 2477 และ (3) การทําความตกลงกับต่างประเทศ ซึ่งในส่วนที่เกี่ยวกับการ ออกคําสั่งทางปกครองควรต้องมีการกําหนดแนวทางการใช้อํานาจให้ชัดเจน อย่างไรก็ตาม แม้ว่าบทบัญญัติของ กฎหมายจะได้กําหนดให้มีการใช้อํานาจตามพระราชบัญญัติ ไปรษณีย์ พุทธศักราช 2477 เป็นของคณะกรรมการ กิจการไปรษณีย์ก็ตาม แต่การใช้อํานาจดังกล่าวก็เป็นเพียงเพื่อให้บริษัท ไปรษณีย์ไทย จํากัด ซึ่งเป็นผู้ให้บริการ ไปรษณีย์ของไทยแต่เพียงผู้เดียว จัดให้มีบริการไปรษณีย์แก่ประชาชนผู้ใช้บริการได้อย่างเท่าเทียมกับนานา ประเทศ และเป็นไปตามข้อกําหนดของสหภาพสากลไปรษณีย์ รวมทั้งข้อตกลงกับประเทศสมาชิกในแต่ละประเทศด้วย

The objectives of this study are (1) to study the origin and development of postal service and the corporatization into Thailand Post Co. Ltd. (THP), (2) to study the authority of the Postal Commission in connection with the operation of postal service, (3) to study the concept and principles of performance-related administrative order by the Postal Commission, and (4) to find out the appropriate in the performance-related to the administrative order of Postal Commission and business operations (THP). The legal qualitative approach is analyzed for this study with the methodology of documentary research by provisions of law, text books, articles, academic papers, thesis, and other sources from the internet in both the Thai and English language. The results have been revealed as follows: Although the postal service of Thailand has improved the governance and service throughout. But the postal service is still the same objective; that is to stabilize the country and provide public services to the people. At present the existing power of THP’s has been changed into the authority of the Postal Commission. Such power can be divided into 3 groups include (1) authority to make administrative order under the Postal Act B.E. 2477 such as the authorization and making decisions, (2) authority to enforce rules, regulations and requirements in the postal services such as the Regulations of the Communications Authority of Thailand’s Board of Directors, a Postal Directive and issuing an administrative order of the Governor of the Communications Authority of Thailand under the Postal Act B.E. 2477, and (3) the agreements with foreign countries. The performance-related to the administrative order thereof should be clarified and follow certain proposed guidelines. The Post Commission, however, is scheduled to exercise power under the Postal Act B.E. 2477 of Thailand Post Co. Ltd, which is the sole provider of postal services, and to provide such services to users equally according to the requirements of the Universal Postal Union (UPU) and agreement with the each member states.
