Abstract
การศึกษาค้นคว้าอิสระนี้มีวัตถุประสงค์ (1) ศึกษาหลักการและแนวคิดที่เกี่ยวกับบทบาท ของพนักงานอัยการในการสอบสวนคดีอาญา (2) ศึกษากฎหมายไทยและกฎหมายต่างประเทศ ได้แก่ สาธารณรัฐฝรั่งเศส ประเทศญี่ปุ่น ประเทศอังกฤษ และสหรัฐอเมริกา ที่เกี่ยวกับบทบาทของพนักงานอัยการ ในการสอบสวนคดีอาญา (3) ศึกษา วิเคราะห์ปัญหาและความเหมาะสมของบทบาทของพนักงานอัยการ ในการสอบสวนคดีอาญาตามร่างพระราชบัญญัติการสอบสวนคดีอาญา พ.ศ. .... (4) เสนอแนะแนวทางใน การแก้ไขเพิ่มเติมกฎหมายที่เกี่ยวกับบทบาทของพนักงานอัยการในการสอบสวนคดีอาญา การศึกษาค้นคว้าอิสระนี้เป็นการวิจัยเชิงคุณภาพ ใช้วิธีการวิจัยเอกสาร เป็นการศึกษาค้นคว้า ตัวบทกฎหมายที่เกี่ยวข้องของไทย ร่างพระราชบัญญัติการสอบสวนคดีอาญา พ.ศ. .... และกฎหมายต่างประเทศ ตำราและหนังสือ รายงานการวิจัยต่าง ๆ วิทยานิพนธ์ บทความทางวิชาการ คำพิพากษาศาลฎีกาและสืบค้นทางระบบอินเทอร์เน็ตในเรื่องที่เกี่ยวข้อง รวมถึงวิเคราะห์ข้อมูลที่ได้จากการศึกษาค้นคว้าทั้งกฎหมายไทยและต่างประเทศ ผลการศึกษาพบว่า (1) ตามหลักการแล้วในกระบวนการยุติธรรมทางอาญาของประเทศไทย พนักงานอัยการไม่มีบทบาทในการสอบสวนคดีอาญาโดยทั่วไป เว้นแต่บางประเภทคดีที่กฎหมายกำหนดไว้ เช่น คดีอาญาที่มีโทษตามกฎหมายไทยที่ได้กระทำลงนอกราชอาณาจักร (2) บทบาทของพนักงานอัยการในการสอบสวนคดีอาญาในสาธารณรัฐฝรั่งเศส ประเทศญี่ปุ่น และสหรัฐอเมริกา พนักงานอัยการเป็นผู้รับผิดชอบและมีบทบาทสำคัญในการสอบสวนคดีอาญา โดยมีอำนาจสอบสวนคดีอาญาได้ด้วยตนเอง ส่วนประเทศอังกฤษ แม้พนักงานอัยการไม่มีบทบาทในการสอบสวน แต่ในคดีที่มีความสำคัญ พนักงานอัยการจะให้คำแนะนำแก่เจ้าหน้าที่ตำรวจตั้งแต่เริ่มทำการสอบสวน ประเทศไทยได้จัดทำร่างพระราชบัญญัติการสอบสวนคดีอาญา พ.ศ. .... โดยเพิ่มบทบาทของพนักงานอัยการให้มีอำนาจเข้าร่วมสอบสวนคดีอาญา (3) ผู้ศึกษา วิเคราะห์และพบปัญหาว่าร่างพระราชบัญญัติการสอบสวนคดีอาญา พ.ศ. .... แม้กำหนดให้พนักงานอัยการมีส่วนร่วมในการสอบสวนคดีอาญา แต่มีบทบัญญัติที่เป็นการจำกัดอำนาจสอบสวนของพนักงานอัยการและไม่สอดคล้องกับบทบาทของพนักงานอัยการในการสอบสวนคดีอาญาในต่างประเทศอยู่บางประเด็น ได้แก่ การจำกัดให้พนักงานอัยการเข้าร่วมสอบสวนในคดีที่พนักงานสอบสวน เป็นข้าราชการตำรวจเท่านั้น การจำกัดไม่ให้พนักงานอัยการเข้าร่วมสอบสวนตั้งแต่เริ่มต้น การจำกัดประเภทคดี ที่พนักงานอัยการเข้าร่วมสอบสวนได้ การจำกัดสถานที่ที่พนักงานอัยการเข้าร่วมสอบสวนได้ การจำกัดบทบาท ของพนักงานอัยการในการสอบสวนเพิ่มเติม (4) ผู้ศึกษาจึงเสนอแนะแนวทางในการแก้ไขเพิ่มเติมร่างพระราชบัญญัติการสอบสวนคดีอาญา พ.ศ. .... โดยให้พนักงานอัยการเข้าร่วมสอบสวนในคดีที่พนักงานสอบสวนตามประมวลกฎหมายวิธีพิจารณาความอาญาเป็นพนักงานสอบสวน ซึ่งรวมถึงพนักงานสอบสวนฝ่ายปกครอง ให้พนักงานอัยการเข้าร่วม การสอบสวนได้ตั้งแต่เริ่มต้นทำการสอบสวน ให้พนักงานอัยการเข้าร่วมสอบสวนในคดีที่อัยการสูงสุดเห็นหรือได้รับการร้องขอว่าเป็นคดีที่มีความยุ่งยากซับซ้อนในการสอบสวนหรือในการแสวงหาพยานหลักฐาน หรือคดีที่ส่งผลกระทบต่อประโยชน์สาธารณะ หรือคดีที่ประชาชนให้ความสนใจ ให้พนักงานอัยการมีอำนาจไปเข้าร่วมสอบสวนกับพนักงานสอบสวนได้ในทุกสถานที่ ให้พนักงานอัยการร่วมสอบสวนเพิ่มเติมกับพนักงานสอบสวนหรือดาเนินการสอบสวนเพิ่มเติมเองได้ในทุกกรณี เพื่อให้สามารถอานวยความยุติธรรมได้อย่างถูกต้อง รวดเร็ว และมีประสิทธิภาพตรงตามเจตนารมณ์ของร่างพระราชบัญญัติดังกล่าว
The purposes of this independent study were (1) to study the principles and concepts of the prosecutor's role in criminal investigations, (2) to study the Thai law and foreign laws, including France, Japan, England and United States of America relating to the role of prosecutors in criminal investigations, (3) to study and analyze a problem and suitability of the role of prosecutors in criminal investigations according the Criminal Investigation Act B.E. .... (4) to suggest guideline to amend the law relating to the role of prosecutors in criminal investigations. This independent study was a qualitative research using documentary research which is a study of the relevant laws of Thailand, the draft of the Criminal Investigation Act B.E. …. and foreign laws, textbooks and books, various research reports, thesis, academic articles, supreme court judgments, and internet searches on related matters, including the analysis of data obtained from both studies Thai and foreign laws.The result of this research indicated that (1) in principle, in the criminal justice of Thailand, the prosecutor do not have power to investigate general criminal cases, except stipulated by law such as offense punishable under Thai law committed outside the Kingdom of Thailand. (2) In France, Japan and United States of America, the prosecutor is responsible and plays a key role in criminal investigations and in England, prosecutors are police adviser from the start of the investigation in the special cases. Thailand have the draft of the Criminal Investigation Act B.E. …. which increase prosecutor's power to investigate criminal cases. (3) The researcher analyzes and finds that some provisions in the draft of the Criminal Investigation Act B.E. .... limit the investigative powers of prosecutors and differ from the role of prosecutors in investigating criminal cases abroad. Such limitation are that prosecutors are able to investigate only in the case that inquiry official is police, are not able to active at the beginning of investigation, participate in limited criminal case and only some location and are limited the role in further investigation. (4) the researcher suggested that to reconsider the draft of the Criminal Investigation Act B.E. ....especially the role of the prosecutors since the beginning of the investigation, prosecutors participation may be able to investigate in cases that the Attorney General deems or is requested to be a complex case of investigation or in seeking evidence or cases that affect the public interest or cases that people are interested, enhance prosecutors’ power to investigate in any location and also may join in additional investigation in any case to provide justice, accurately, quickly, and effectively in accordance with the intent of the draft of the Criminal Investigation Act B.E. ....
