Abstract
การศึกษาค้นคว้าอิสระนี้มีวัตถุประสงค์ที่จะศึกษาเกี่ยวกับแนวความคิดทฤษฎีเกี่ยวกับความเสมอภาค ทฤษฎีความรับผิดทางอาญา เช่น ความรับผิดทางอาญาระบบกฎหมายลาย ลักษณ์อักษร ความรับผิดทางอาญาระบบจารีตประเพณี ระบบการดำเนินคดีแบบไต่สวน และ กล่าวหา แนวความคิดการดำเนินคดีอาญาโดยผู้เสียหาย ประชาชนและโดยรัฐ สิทธิของผู้เสียหาย ในคดีอาญาในศาลทหารประเทศสหรัฐอเมริกากับศาลทหารและศาลยุติธรรมของประเทศไทย สิทธิของผู้เสียหายในคดีอาญาซึ่งไม่อยู่ในอำนาจศาลทหาร ตามพระราชบัญญัติธรรมนูญศาลทหาร พ.ศ.2498 (4) สรุปและเสนอแนะ สิทธิของผู้เสียหายในคดีอาญาซึ่งไม่อยู่ในอำนาจศาลทหาร ตามพระราชบัญญัติธรรมนูญศาลทหาร พ.ศ.2498 การศึกษาค้นคว้าอิสระนี้เป็นการวิจัยเชิงคุณภาพ ด้วยวิธีการวิจัยทางเอกสาร จากการศึกษาค้นคว้าข้อมูลจาก หนังสือ บทความ เอกสารราชการ คำพิพากษาและการสืบค้นข้อมูล จากอินเตอร์เน็ต โดยนำมาวิเคราะห์กับปัญหาในทางปฏิบัติที่เกิดขึ้นในปัจจุบัน ผลการศึกษาพบว่า ผู้เสียหายในคดีอาญาซึ่งไม่อยู่ในอำนาจของศาลทหารไม่มีสิทธิที่จะเป็นโจทก์ฟ้องคดีในศาลทหารต้องมอบคดีให้อัยการทหารเป็นผู้ฟ้อง ซึ่งทำให้เกิดปัญหาหลาย ประการ อาทิเช่น ปัญหาคำสั่งไม่ฟ้องในคดีอาญาของอัยการทหาร ปัญหาไม่มีสิทธิในการแต่งตั้ง ทนายความ จึงเสนอแนะให้มีการแก้ไข ปรับปรุง พระราชบัญญัติธรรมนูญศาลทหาร พ.ศ. 2498 มาตรา 49 และมาตรา 55 เพื่อความเสมอภาคกันในการฟ้องคดีของผู้ที่อยู่ในอำนาจศาลทหารและผู้เสียหายในคดีอาญาซึ่งไม่อยู่ในอำนาจศาลทหารและเป็นการอำนวยความยุติธรรมของคู่ความ ในคดีอาญาในศาลทหารอย่างเต็มที่รวมทั้งเพื่อให้สอดคล้องกับวิวัฒนาการของสังคม และสิทธิ ความเสมอภาคที่บัญญัติไว้ในรัฐธรรมนูญแห่งราชอาณาจักรไทย พ.ศ. 2550
This research aims to study (1) the theoretical concept of equality. Criminal liability theory, such as criminal liability in civil law system and common law system , probation and complaints system, concept of criminal procedure commenced by the injured person or public prosecutor (2) the rights of the injured person in criminal cases in the United States military Court, the Thai military Court and the Court of Justice; (3) the rights of the injured person in a criminal case which not in Military Court Jurisdiction according to the Military Tribunal Act BE 2498 (4) Summary and Recommendation the rights of victims in criminal cases which not in Military Court Jurisdiction according to the Military Tribunal Act, 1955. This independent study is a qualitative research. The method of document research is based on the study of information from books, articles, government documents, judgments and Internet search. The analysis of the practical problems that occur today. The study indicated that injured person in criminal cases who are not in the jurisdiction of the Military Court, has no right to file lawsuit in Military Court. To file a lawsuit in Military Court shall be done by the military prosecutor. This causes many problems, such as the problems when the military prosecutor uses their discretion orders not to file the criminal case, the problem in the limitation of the right to appoint a lawyer. It is proposed to amend the Military Tribunal Statute Act, BE 2498 (1955), Section 49 and Section 55, to equalize the prosecution right of both persons under the jurisdiction of the Military Court and the injured party who are not in the Military Court jurisdiction and to comply with the evolution of society, the equality rights according to the Constitution of Kingdom of Thailand B.E. 2550.
