การคุ้มครองผู้บริโภคในธุรกิจรับสร้างอาคารที่พักอาศัย

Abstract

การศึกษาค้นคว้าอิสระเรื่องการคุ้มครองผู้บริโภคในธุรกิจรับสร้างอาคารที่พักอาศัย มีวัตถุประสงค์เพื่อการศึกษา 1) เพื่อศึกษาแนวคิดและทฤษฎีของการคุ้มครองผู้บริโภคจากการผิดสัญญาของผู้ประกอบธุรกิจรับสร้างบ้านหรืออาคารที่พักอาศัย 2) เพื่อศึกษาวิวัฒนาการของกฎหมายไทยที่เกี่ยวข้องกับการคุ้มครองผู้บริโภคโดยทั่วไปและผู้บริโภคที่ได้รับความเสียหายจากผู้ประกอบธุรกิจรับสร้างบ้านหรืออาคารที่พักอาศัย 3) เพื่อศึกษาเกี่ยวกับแนวคิด ทฤษฎี ของกฎหมายต่างประเทศที่เกี่ยวกับผู้ประกอบธุรกิจรับสร้างบ้านหรืออาคารที่พักอาศัย 4) เปรียบเทียบกฎหมายคุ้มครองผู้บริโภคในธุรกิจรับสร้างบ้านกับการคุ้มครองผู้บริโภคตามพระราชบัญญัติการจัดสรรที่ดิน พ.ศ. 2543 และ 5) เพื่อศึกษาแนวทางในการคุ้มครองผู้บริโภคหรือผู้ว่าจ้างก่อสร้างบ้านหรืออาคารที่พักอาศัย ด้านคุณสมบัติของผู้รับจ้าง ค่าเสียหายและแนวทางในการพัฒนากฎหมายคุ้มครองผู้บริโภค การศึกษาค้นคว้าอิสระนี้เป็นการวิจัยเชิงคุณภาพ (Qualitative Research) โดยวิธีการวิจัยทางเอกสาร (Documentary Research) ด้วยวิธีการศึกษาจากบทบัญญัติของกฎหมาย วิทยานิพนธ์ บทความในวารสารด้านกฎหมายที่เกี่ยวข้องกับการคุ้มครองผู้บริโภคในธุรกิจก่อสร้างบ้านหรืออาคารที่พักอาศัยรวมถึงสื่ออิเล็กทรอนิกส์ต่าง ๆ ผลการศึกษาพบว่าสัญญารับจ้างก่อสร้างบ้านหรืออาคารที่พักอาศัย มิได้กำหนดชัดเจนซึ่งรายละเอียดในการกำหนดอัตราค่าจ้างที่ได้สัดส่วนกับเนื้องาน ไม่มีระบบรับประกันผลงานที่มีประสิทธิภาพ และผู้ประกอบวิชาชีพรับจ้างก่อสร้างเอง ก็มิได้เป็นผู้ที่ได้รับการฝึกอบรมจากองค์กรที่มีอำนาจควบคุมดูแลอย่างจริงจัง ทำให้ผู้บริโภคไม่ได้รับความเป็นธรรมจากการใช้บริการ

The Purpose of this independent research is; 1) To study the Concept and Theory on Consumer Protection resultant from a breach of contract of a business operator engaged in the construction of houses or residential buildings, 2) To study the evolution of Thai law relating breach of contract of a business operator engaged in the construction of houses or residential buildings, 3) To study the Concept and Theory of foreign law relating to business operators engaged in the construction of houses or residential buildings, 4) To compare the laws on the protections of consumers in the business on the construction of houses and the protections of consumers in accordance with Land Allocation Act, B.E. 2543 (2000) and 5) To study the way in providing protections over the consumers or employers of contractors to build houses or residential buildings on the aspects of the qualifications of the contractors, damages and way on the development of law on Consumer Protection. This independent research is a qualitative research by way of documentary research with the provisions of all related laws, Thesis, An Article in the Journal of Laws relating to consumer protection in the business on the construction of houses or residential buildings. Include various electronic media. The result of the study, it was found that the Construction Contracts on the houses or residential buildings had not contained clear details on the fixing of the rate of remuneration in proportion with the work; there were no efficient work output guarantee system and persons engaged in the construction occupation never had any serious training from the organization having the power in monitoring controls, thus, resulting in the consumers to receive no justice from using the pertinent services.
